India threatens BBC over rapist interview

So whats so great about having a non functioning judiciary and executive system? Reminds me of some failed African "state" without a government.

Had this incident been happened in BJP ruled stated ... Indian media would have jumped on this news like a b!tch in heat. Claiming a Muslim was lynched by RSS Bhakts.

I have some personal opinion.

First the film has been made and shown on BBC. Jo ho gaya so ho gaya!! Yeh gali (accusations) chalta rahega. I also want some portion of the movie(edited) to be show to public. The parents of the girl are also equally right as to how the law is taking unnecessary long time to be delivered. They must be having many sleepless nights over the outcome of the judgment.

Secondly the Govt. is also right from legal point of view. No one can interview a such a dastardly heinous convict, let alone make a complete documentary movie. The movie must have taken a lot of time to make under the very nose of the Law enforcement agencies.

BBC also showed its arrogant and adamant nature. Heavens would not have fallen if the film were not shown for a couple of weeks and with sufficient explanation to the Govt. or after showing it to the Govt. Now what should the Govt. do in such a case?

1. Ask judiciary to expedite the case by putting it through fast track and deliver the judgement within a or two months.

2. Find out who gave the permission and who allowed him into the jail. Monetary consideration cannot be ruled out.

3. Even if the former Govt. has given the permission, find out if any condition has been violated.

4. If the conditions are violated then take the journalist to court. (I am sure as long as the case will be there, she will not come to India again).

5. Debar the defending Lawyers from further practice.

6. Make a systematic campaign in every media as to make aware people against rapes (like swwach abhiyan) including education.

7. Make a documentary on Rotherham Sex scam by some independent film maker and show it to the world and also mention in it what is the rank of India in number of rapes across the world and with number of convicts. Ask the Indian Journalist to ask British authorities for interview with Rotherham convicts to see if they give permission!!

And lastly make a documentary of Missionary sects in India and about their activities. I have always suspected their activities in this also.

Anyway this movie should give the Parents of Nirbhaya a quick and just judgement. That's all I can say!!

It seems people are missing a critical aspect here. I can't post a link, but this article is from opindia.com:

According to the Home Minister’s statement, The Ministry of Home Affairs, in July 2013 had given an NOC to shoot the said documentary. Subsequently, Tihar Jail authorities also gave the required permissions, subject to fulfilment of the following conditions:

(i) Prior approval of jail authorities is to be taken for publishing the research paper or for releasing the documentary film which is being made for purely social purposes without any commercial interest as conveyed.

(ii)To interview only such convicted prisoners who give written consent.

(iii)The complete unedited footage of shoot in the Tihar Jail premises will be shown to the jail authorities to ensure there is no breach of Prison security.

On 7th April 2014, once the Jail Authorities realised that the conditions had been violated, a legal notice was sent to return the unedited footage within 15 days and also not to show the film as it violates the permission conditions. Subsequently, the documentary film was shown to the jail authorities where it was also noticed that the film shown was the edited version and not the unedited as per permission conditions. Hence, they were requested to provide full copy of the unedited film shoot for further review by the authorities and that they were asked not to release/screen the documentary till it is approved by the authorities.

As per this report, a notice was sent to BBC in November 2014. There was no reply to this notice from BBC. As of March 3rd, Tihar jail officials were drafting a second notice to BBC, highlighting the conditions that have not been met. There are questions whether the documentary is still being used only for “social” and “non-commercial” use, as per the initial conditions, agreed by the film-makers.

As things stand, The documentary makers haven’t shown the unedited version of the documentary to the Jail Authorities, as promised by them. Hence they don’t have the permission of the Jail authorities. As mentioned above, there is also doubt whether the documentary is being used only for “social” purposes. Yet, in gross violations of the conditions, BBC has already aired the documentary in United Kingdom and it is now available on YouTube.

These highlight the legal concerns. India has every reason to terminate BBC's license for airing in India.

That was one totally bullshit article... We cannot claim a moral high ground when such dastardly acts happen in our country. This holier-than-though attitude of the GOI is depressing. Stop being afraid of the truth, and accept. Only then will out country be better.

And this is not govt only decision.Entire Parliament including womens are shouting against this documentary.We have our own system in here including media and others .We dont need outsiders help .Do we?

Exactly my point friend
The documentary will have no impact atleast on the class of the society from where rapists belong as you can see in the video. It will only impact on creamy layer of the society which I think don't relates to problem. I find the purpose of this documentary unwarranted it only more propagated negative image of country in an common indian youth . Basically everyone knows what problem is but we are moving maybe little but moving and there will time in 1-2 decade where our society will completely change in way it looks Now.

Rest 5 have either died of heart attack or were hanged

Isn't the case still under appeal in the SC?
