lwe're never allies.nobody from india or u.s claimed that we're allies.india has an independent foreign policy something which your allies dont.thats the same reason why we opposed u in u.n number of times.shes is not a criminal.she pays according to her package.if u.s has some problem with it.they must compensate it from their bank accounts.she cant pay more than what she earns.as simple as such.

The Treatment meted out to Devyani Khobragade


The arrest and the treatment meted out to the Indian diplomat Devyani Khobragade deserves to be condemned. The United States unilateralism in narrowing down the scope of diplomatic immunity should not be accepted by India. Article 31 of the Vienna Convention clearly provides that a diplomatic agent shall enjoy immunity from criminal action of the receiving State. The only exceptions mentioned in the Vienna Convention are that if there is a real action regarding the private immovable property located in the receiving State, the action relating to succession in which the diplomatic agent is involved or an action relating to any professional or commercial activity exercised by the diplomatic agent. These exceptions are only in relation to civil and administrative jurisdictions. With regard to criminal action again there is no exception which the Vienna Convention has carved out. Article 41 of the Vienna Convention on Consular Relations also provides that Consular officers shall not be liable to arrest or detention pending trial, except in the case of a grave crime and pursuant to a decision by the competent judicial authority. The Convention clearly states that Consular officers shall not be committed to prison or be liable to any other form of restriction on their personal freedom unless there is a judicial verdict. It goes further to state that if criminal proceedings are instituted against a consular officer, he must appear before the competent authorities but nevertheless, the proceedings shall be conducted with the respect due to him by reason of his official position. Even though the Covenants of the Vienna Conventions are clear with regard to the extent of immunity available to a foreign diplomats and consular officials, the US State Department has displayed scant regard for the established conventions. If the arrest of the diplomat raises serious questions with regard to the infringement of Vienna Conventions, the subsequent treatment meted out to her — the search, keeping the lady diplomat in custody with hardened criminals displays the cavalier manner in which the Americans are treating this issue.

Diplomacy operates on the principle of reciprocity. In the past when an elected representative from India has been denied US visa, the Government of India have taken it lying down because of its own sense of insecurity vis-a vis the concerned elected representative. This has given to the Americans a signal that they can act unilaterally without attracting an adverse reaction from India. The case of Devyani Khobragade is a pointer to the fact that Government of India must now and in future act on the principle of reciprocity. If there is any infringement of any local law, be it even a municipal or State laws, by an American diplomat/ consular official, we must waive off the immunity under the Vienna Conventions. Similarly, if we find the conduct of any US elected representative unacceptable in our subjective opinion, we must reserve the right to reject his or her visa application.

She does not have the right to a maid. The fact that people are claiming that she can't pay more than she earns is WEAKENING HER CASE, STOP REPEATING THAT. STFU PLS.

The fact of the matter is, she works in India (Indian embassy) and therefore is subject to Indian laws. That is what matters. Not whether the diplomat is paying her help according to American laws.

Meanwhile, her husband and child in India were taken into custody, according to the witness. A scared Richard spoke with them, and refused to leave the attorney's office premises.

If true, this is a disaster for India and this diplomat.

It sounds more and more like this unscrupulous and abusive diplomat used her connections to harass the nanny and her family in India. This aside from the fact that she broke any number of US laws.

I don't know how you arrest someone in India, in America, we arrest someone with handcuff and Miranda right. Both procedure are required to perform an arrest

Putting handcuff signified the subject is under remandment and reading the Miranda right let the subject knows his or her right as a detainee.

Set aside if the arrest was made in the public, even if you are already inside a police station and came volunteerly you will still be cuffed and led back to the central booking. As this is a part of police procedure.

Most people also misunderstand the right of diplomat or so called "diplomatic immunity" technically, diplomatic immunity only provide a certain object an exclusion of charge and indictment for certain offence, usually light offence (drink driving or burglary) but this does not apply to detaining the diplomat or arresting the diplomat.

Upon arresting, diplomat can invoke diplomatic immunity to exclude themselves from the criminal charge or criminal investigation. However, diplomat are still arrestable, waving diplomatic immunity does not make you become unarrestable

And finally, regardless of status, US LEO cannot enter the foreign embassy or embassy residence to arrest anyone, basically those are considered as foreign soil and local US LEO have no jurdiction, unless instructed by US State department

Now, I don't know if the arresting officer have arrange the arrest in a more secluded location or more private, that is up to the officer own discretion, but as far as I can tell, the officer exercising proper right and procedure. I don't think the Local LEO have done anything wrong.

Actually it does not matter if the maid is pressing charged, the DA office have the right to press charge on behalf of the plaintiff.

Once the alleged criminal activities is out in the open, DA office does not require the victim to press charge to push forward the case.

Ok you are right.If she did anything wrong ,US can take action.But she is a senior IFS officer,that work for our country .We dont claim diplomatic immunity against arrest.We claim diplomatic immunity over the method she treated by US authorities.We can also take action against a US diplomat in US embassy with 377 article in Indian Constitution.But we dont do that because
we know the human side.

BBC News - Devyani Khobragade: India-US row over diplomat deepens


Senior Indian government officials have refused to meet a visiting US Congress delegation amid a worsening row over the alleged ill-treatment of an Indian diplomat in the US.
Media reports on Tuesday said Devyani Khobragade was "strip-searched" after she was briefly arrested last week.
She was charged with visa fraud and making false statements over allegedly underpaying an Indian housekeeper.
Ms Khobragade, deputy consul general in New York, has pleaded not guilty.
The Indian government said it was "shocked and appalled at the manner" in which the diplomat had been "humiliated" in the US.
Washington has said that New York police followed "standard procedures" during her arrest.
"Diplomatic Security, which is under the state department purview, followed standard procedures during her arrest," state department deputy spokesperson Marie Harf told reporters at a press conference on Monday.
'A snub'
On Tuesday, Home Minister Sushil Kumar Shinde cancelled his meeting with the senior US Congressional delegation and his office said he was busy in parliament, but media reports in India described it as a "snub" to the US.
The governing Congress party vice-president Rahul Gandhi and the opposition Bharatiya Janata Party's prime ministerial candidate Narendra Modi also refused to meet the delegations.
"Refused to meet the visiting USA delegation in solidarity with our nation, protesting ill-treatment meted to our lady diplomat in USA," Mr Modi tweeted.
On Monday, the Speaker of India's parliament Meira Kumar and National Security Adviser Shiv Shankar Menon had also refused to meet the visiting Congressional officials.
Mr Menon said Ms Khobragade's treatment was "despicable and barbaric".
Last week, Delhi also summoned the US ambassador to protest against the arrest and a foreign ministry official said India was "shocked and appalled" at the handling of the incident by the US.
Ms Khobragade, 39, was arrested last Thursday in New York and later freed on a $250,000 (£153,000) bond. Some reports in India said she was arrested while dropping her daughter at school and was handcuffed in public.
Latest media reports said she had been "subjected to a humiliating strip search and kept in a cell with drug addicts".
Law enforcement authorities in New York say Ms Khobragade "allegedly caused a materially false and fraudulent document to be presented, and materially false and fraudulent statements to be made, to the US Department of State in support of a visa application for an Indian national employed as a babysitter and housekeeper at her home in New York".
If found guilty, Ms Khobragade faces a maximum sentence of 10 years for visa fraud and five years for making false statements.

US-India Diplomatic Row over Consul's 'Barbaric' Arrest Escalates


New Delhi has responded furiously to the arrest of one of its consuls in New York, telling American diplomats across the country to turn in their ID cards and stripping them off other privileges.
Responding to the "humiliating" arrest of high-ranking diplomat Devyani Khobragade in the US, India has swiftly imposed a raft of measures against American attachés and diplomatic missions.
Apart from asking the US diplomats and their family members to surrender their identity cards, which bestow on them special privileges inside the country, New Delhi has also withdrawn their airport passes.

Barricades erected by Indian authorities outside various American diplomatic posts are also being removed.
A diplomatic storm was brewing between Washington and New Delhi following the arrest of Khobragade, deputy consul general for political, economic, commercial and women's affairs in New York, on charges of committing fraud in the US visa application for her maid Sangeeta Richard.
Khobragade, 39, was handcuffed by New York police and was reportedly subjected to strip search, angering India. It is believed that she was kept in the same cell alongside criminals and drug addicts.
High-profile politicians from a cross-section of parties have reacted strongly to the manner in which the diplomat was treated. Sonia Gandhi, the chairperson of the ruling coalition UPA, Congress party scion Rahul Gandhi and the opposition's Narendra Modi have all cancelled their scheduled meetings with US delegations.
National Security Adviser Shivshankar Menon said the US action was "despicable and barbaric".
"It is completely unacceptable. We have put in motion what we believe will be an effective way to address this issue and protect her dignity," said India's Foreign Minister Salman Kurshid.
New Delhi has also ordered to collect various details, including the social security payments, of its nationals working in the US in order to press for more action.
However, Washington has defended its action and the way Khobragade was treated.
"Under the Vienna Convention on Consular Relations, the Indian deputy consul general enjoys immunity from the jurisdiction of US courts only with respect to acts performed in the exercise of consular functions. This isn't just in the US; it's all around the world. So in this case, she fell under that specific kind of immunity, and would be liable to arrest pending trial pursuant a felony arrest warrant," said US State Department spokesperson Marie Harf
