ISLAMABAD: Arsalan Iftikhar, son of former Chief Justice of Pakistan Iftikhar Muhammad Chaudhry, has decided to move the Election Commission of Pakistan (ECP) for the disqualification of PTI chief Imran Khan on his alleged violation of articles 62 and 63 of the constitution.
“I have documentary evidence against Imran Khan which reflects that he does not fulfil the requirements of articles 62 and 63 of the Constitution,” Arsalan Iftikhar said while talking to The News on Friday.
Strong criticism by Imran Khan and some other opposition politicians had forced Arsalan to tender his resignation from the post of Vice Chairman of Balochistan Board of Investment on Thursday.
“PTI chief claims to be sagacious and he starts every political rally with verses from Quran, but he has failed to give justice to his own child Tyrian,” Arsalan said. Son of former chief justice said he will get more evidence against Imran Khan in coming days before filing a formal application with the Speaker National Assembly.
Article 63(2) of the Constitution explains the process of disqualification of a member: “If any question arises whether a member of Majlis-e-Shoora (Parliament) has become disqualified from being a member, the speaker or, as the case may be, the chairman shall, unless he decides that no such question has arisen, refer the question to the Election Commission within 30 days and should he fail to do so within the aforesaid period, it shall be deemed to have been referred to the Election Comission.
“I will raise the simple question regarding the qualification of Imran Khan. Is Tyrian love child of Imran Khan? Does he fulfil the requirement of articles 62 and 63?” Arsalan said.Article 62 of the Constitution states that a person shall not be qualified to be elected or chosen as a member of parliament unless (d) he is of good character and is not commonly known as one who violates Islamic Injunctions; (e) he has adequate knowledge of Islamic teachings and practises obligatory duties prescribed by Islam as well as abstains from major sins; (f) he is sagacious, righteous and non-profligate, honest and ameen, there being no declaration to the contrary by a court of law. “If Imran Khan emerges as sagacious after the ECB decision, I will stand corrected and will accept the decision,” Arsalan said.
