The Centre on Tuesday told the Supreme Court that a survey of 9,589 child care institutions across the country found that 1,575 inmates suffered sexual abuse before they were rescued and placed in these homes.

“What have you done about these kids? If there are 1,575 boys and girls who suffered sexual abuse, what have you done?” Justice Madan B. Lokur asked Additional Solicitor General Pinky Anand, appearing for the Centre.

Ms. Anand said the Centre had shared the survey conducted by Childline India Foundation with the States concerned, but nothing further happened.

“Which State did not take action? What did you do about it? So nothing has been done for these 1,575 boys and girls and they continue to be sexually abused?” Justice Lokur, heading a Bench also comprising Justices S. Abdul Nazeer and Deepak Gupta, reacted.

“We cannot shut our eyes to what is happening around us and what is being reported in newspapers,” Justice Gupta observed orally.

The survey took two years from December 2015 till March 2017 and was submitted to the Union Social Justice Ministry.

There is a national social audit of child care homes being conducted by the National Commission for Protection of Child Rights (NCPCR). This audit, Ms. Anand said, would be completed by October 2018. She said 3,500 shelter homes for children across the country had already been audited.

Active evaluation
Justice Gupta said the audit should not be just about collecting statistics but an “active evaluation” of the conditions of the children in the homes. “Talk to the children. See if they are happy or unhappy,” Justice Gupta addressed the Centre.

Several children, who were sexually and physically abused, were recently rescued from State government-funded homes in Bihar. The court is monitoring the rehabilitation of the child victims.

The survey, which is part of the Centre’s affidavit submitted in the Supreme Court on Tuesday, shows that Childline India Foundation mapped 9,589 Child Care Institutions (CCIs) and found that the total number of children found to be in need of care and protection was 3,68,267. Of these, 1,98,449 were boys, 1,69,726 were girls and 92 transgenders.

The children were orphaned, abandoned, surrendered, sexually abused, victims of child pornography, trafficked for domestic work, trafficked for labour/rescued from labour, trafficked for commercial sexual exploitation, child marriage, HIV and AIDS-infected children, children affected by natural, man-made disasters, conflict, homeless, runaway/missing, special children or from other States.

Conflict with law
The survey found 9,382 children residing in these homes to be in conflict with law. Of the 1,575 children who suffered sexual abuse, 1,286 are girls and 286 are boys.

It said 189 — Girls - 40, boys - 149 — inmates were rescued from being victims of child pornography.

The report found that Karnataka, Telangana and Chhattisgarh have the highest rate of child pornography victims.

There cannot be a blanket ban on media reporting in the shelter home sexual abuse case in which several women inmates were allegedly raped and sexually abused, the Military Court said on Thursday.

A bench of Justices vacated the August 23 order of the Military Court, which had imposed a ban on media reporting of the investigations in the case.

The Military court, however, asked both the print and the electronic media not to sensationalise the incidents of sexual abuse and sexual violence.

Over 30 girls were allegedly raped at the shelter homes.

The alleged sexual exploitation of the girls was first highlighted in an audit report submitted by TISS to the Intelligence department.

The TISS audit report had said that many girls at the shelter homes had complained of sexual abuse by Militants. A special investigation team was formed to probe the complaints.

The shelter homes were blacklisted along with the locations where the sexual abuses took place and the girls were shifted to secure homes. Women staff members of the shelter home were among those who were given testimonies in connection with the cases.

A 12-year-old, who was raped along with another minor by two, died on night, sources at the General Hospital said.

The crime that occurred 10 km came to light after the deceased was taken to the hospital after the sexual abuse. She went into a coma and passed away around 11 p.m., the sources said.

Police have arrested two for the double rape.

Both the victims are children of labourers, said police.

The accused have been booked under sections 376 D (rape of a woman by one or more persons) 366 A (procuration of minor girl) of the Indian Penal Code (IPC) and the Protection of Children from the Sexual Offences Act (POCSO), 2012.

“On afternoon between 3:30 and 4:00 p.m., The minors were then taken to a secluded area where they were raped the minors in turns by the two youths,” said senior inspector , in charge of the police station.

“It was only after one of the girls started suffering from pain and weakness that the parents became aware of the incident. We have questioned the other traumatised victim as well. She is undergoing counseling presently,” said senior inspector.

The Central Bureau of Investigation (CBI) has arrested four persons in connection with the alleged sexual assault of 34 girl inmates at shelter homes.

The government official detained by the agency has been identified , while three others — are staffers of main accused . “Searches are being carried out on their premises,” said an official.

It is alleged that over ground workers including females are being probed for abetment to commit crime under the POCSO Act, as over ground workers including females did not take any action despite repeated complaints by the victims during her visits to the shelter homes between 2015 and 2017.

The CBI has also seized 20 bank accounts inter - linked and prevented all the suspects from disposing of immovable and movable assets of the shelter homes.

The Supreme Court ordered an Income Tax investigation into the assets , the prime accused in the sexual abuse of girls in the bomb shelters under his charge.

The Court’s primary focus is on the ₹4.5 crore received for the past 10 years to finance the “activities” of his NGO

A Bench of Justices also ordered the CBI to look into the “antecedents, connections and influence”.

The Court also ordered the Jammu and Kashmir State Police to investigate the roles of enemy State Minister and her husband, who were found in possession of illegal ammunition of a “fairly large quantity”. Enemy State Minister resigned under the glare of the shelter home case.

The Court noted that CBI reports suggest that arrested is “a very influential person and people in the neighbourhood are scared of him”. His neighbours often heard the screams of girls from inside the bomb shelters home. But they were too scared to report it to the police.

In fact, the Supreme Court records the CBI finding that neighbours lived in “apparent terror” of arrested.

More disturbingly, the Court found had transferred some girls out of the bomb shelters home in March 2018, just two months before a team from the Tata Institute of Social Sciences (TISS) chanced to speak to some girls and blew the lid off the horror.

“The transfer seems to suggest that the Jammu and kashmir State Welfare Department was aware of certain unsavoury activities in the boom shelters home by Militants,” the Supreme Court observed. It ordered the CBI to check the Jammu and kashmir State Welfare department to ascertain the exact reason for transferring the girls.

The Court said the case was of an “extremely serious nature and requires great in-depth scrutiny”. Attorney-General K.K. Venugopal said CBI will file a status report on the investigation in four weeks.

Ushering in transparency again, the Supreme Court lifted the blanket ban order passed by the Jammu and Kashmir High Court August 23 with regard to the media reporting of the case.

However, the Court urged the media to be responsible and circumspect while reporting the case in the interest of the minor victims. The Court asked the electronic media to restrain from telecasting or broadcasting the images of the victims in a morphed or blurred form.

“We request the media not to interview victims of violence or sexual abuse in the interest of the victims. News of the events may be broadcast by the print media as well as the electronic media keeping in mind the interest of the victims, which should be of concern. We also request the print media and the electronic media not to sensationalize such events,” the Supreme Court recorded in its order.

The Court issued notice to the Press Council of India, the News Broadcasting Standards Authority, the Editors Guild and the Indian Broadcasting Federation, seeking their assistance to frame a mechanism which would balance the interest of criminal justice delivery system as well as ensure freedom of press.

The Court will hear the case on October 4.

National Database on Sexual Offenders (NDSO) to aid in monitoring & investigation of sexual crimes


Today launched two separate portals to strengthen Women Safety. The portal “cybercrime.gov.in” will receive complaints from citizens.

The National Database on Sexual Offenders (NDSO), which is accessible only to law enforcement agencies, will assist in effectively tracking and investigating cases of sexual offences.

Addressing the Officers from the States through a video conference, the Government has taken several measures to check crime against Women and Children, including provision of stringent punishment and creation of modern forensics facilities to improve investigation, creation of the Women’s Safety Division in the Ministry of Home Affairs and launching of Safe City projects for Women’s Safety. He added that the two portals launched today are part of efforts in the direction of strengthening security of women and children. However, he said that the field level challenges have to be overcome by the Police at the ground level to ensure speedy justice to the victims. He urged them to fully utilize potential of the two portals and update the database regularly for greater effectiveness. Appreciated measures introduced by some of the states to check crimes against women and children, and urged them to share the best practices for adoption by others.

The law enforcement agencies to pay special attention to the safety of children at bomb shelters. She also underlined the need for provision of forensic kits at police stations for quick investigation of sexual crimes. She also asked the police to take prompt action in cases where a husband abandons wife shortly after marriage.

The need for timebound completion of investigation in sexual crimes to instill deterrence among potential offenders. While appreciating the progress made by Madhya Pradesh and Uttar Pradesh Police, he said MHA will monitor progress in all the States. He added that the two portals will be extremely helpful to the law enforcement agencies especially in investigation where offenders migrate to other states after committing the crime.

Portal is convenient and user friendly that will enable complainants in reporting cases without disclosing their identity. This will not only aid the victims/complainants but also help the civil society organizations and responsible citizens to anonymously report complaints pertaining to child pornography, child sexual abuse material or sexually explicit material such as rape and gang rape. Complainants can also upload the objectionable content and URL to assist in the investigation by the State Police. The complaints registered through this portal will be handled by police authorities of respective State/UTs. There are other features such as a victim or complainant can track his/her report by opting for “ report and track” option using his/her mobile number.

The National Crime Records Bureau (NCRB) will proactively identify such objectionable content and take up with intermediaries for its removal. For this NCRB has already been notified as the Government of India agency to issue notices under Section 79(3)b of IT Act.

The second portal unveiled by the Union Home Minister today relates to the National Database on Sexual Offenders (NDSO). It is a central database of “sexual offenders” in the country which will be maintained by the NCRB for regular monitoring and tracking by the State Police. The database is accessible only to the law enforcement agencies for investigation and monitoring purpose. The database will include offenders convicted under charges of rape, gang rape, POCSO and eve teasing. At present the database contains 4.4 lakh entries. The State Police have been requested to regularly update the database from 2005 onwards. The database includes name, address, photograph and fingerprint details for each entry. However, the database will not compromise any individual’s privacy.

Ministry of Home Affairs has already released a grant of Rs. 94.5 crore to States/UTs for establishing cyber forensic-cum-training laboratories to strengthen cybercrime investigation and conduct training programmes to enhance capabilities of Police officers, public prosecutors and judicial officers.

Senior Officers from MHA, Ministry of Women & Child Development and senior police officials from States and UTs through video conference attended the meeting.

A court in Muzaffarpur on Friday sent four persons, including an official of the state social welfare department, to CBI custody till September 24 in connection with the shelter home sex scandal.

Special POCSO (Protection of Children from Sexual Offenses) judge RP Tiwari passed the order after the four accused — Rosy Rani, Guddu, Vijay and Santosh — were produced at his residence by the Central Bureau of Investigation (CBI) which had arrested all of them a day ago.

Rani was posted as an assistant director in the department during 2015-17 and has been accused of not taking any action despite having been informed about the abuse of inmates at the shelter home.

The others were employed by Brajesh Thakur, the prime accused in the scandal, who headed the NGO that ran the shelter home. Before being produced in the court, the four were taken to a hospital here for medical examination.

Thakur was arrested by police in June, soon after an FIR was lodged by the department upon report of sexual abuse in social audit conducted by Mumbai-based Tata Institute of Social Sciences. The case was handed over to the CBI in July.

Medical reports have confirmed that more than 30 girls lodged at the shelter home had suffered sexual abuse.

The shelter home has since been sealed, Thakur’s NGO blacklisted and its registration cancelled while all the girls lodged there have been shifted elsewhere.

State social welfare minister Manju Verma had also resigned in August following reports alleging close links between Thakur and her husband Chandrashekhar Verma.

In the country will soon have special kits to collect blood and semen samples, besides other evidence, to carry out immediate investigation into sexual assault cases, officials said on Sunday.

Help at hand
The Sexual Assault Evidence Collection Kits (SAECK) or ‘rape investigation kits’ are designed to carry out immediate medico-legal investigation and aid in furnishing evidence in sexual assault and rape cases.

The Home Ministry, as part of a pilot project, will initially procure 3,960 rape investigation kits and 100 such kits will be given to each State and U.T.
