A territory does not have to have soldiers in it, to be considered occupied. Gaza is not sovereign, because Israel has a blockade against it. It controls its airspace and its waters. So it is a de facto occupation.

Hague Convention disagrees with u:

Art. 42.
Territory is considered occupied when it is actually placed under the authority of the hostile army.
The occupation extends only to the territory where such authority has been established and can be exercised.

After Israeli retreat from Gaza they launched thousands of Iranian supplied rockets, whichj led to two Israeli operations and only then they stopped rocket attacks.

Since Hamas departed from Iran and left to Qatar amount of violence and casualties from both sides dropped to minimum.
