Well a solution could be that the agency is under supervision of an independent body (for example the courts). The agency would require a permission to spy on suspects.
And how we will decide that who is a suspect and who is not ? by monitoring, right ?

In western nations (definitely not the USA though) security agencies need to bring in some form of proof or at least a valid reason to believe that a person is involved in some terrorist activities to get permission to spy on them........... but that has its limitations as well.
There is simply no perfect solution, but we have to ask ourselves whether we want to stick to our core principles or if we want to be forced to abandon them in fear of terrorists..... and I guess that would already be a significant victory for those fundamentalist rats and a defeat for us.
