Dude, I humbly suggest you are wrong here.
I really do not see an issue here, except maybe the refusal of some madrassas to do flag hoisting. It is one of the stated goals of our education system to instill love and respect for our country and our national symbols in young minds, is it not?
- The order is not saying do flag hoisting in mosques (you mentioned church, gurudwara, temples etc)
- The order is for govt assisted madrassas, i.e. schools. All government assisted schools do flag hoisting those days and govt has every right to make them do it in return of govt assistance and recognition
- A purely privately run institution does not have to follow this order, thus have their freedom of choice intact.
Personally I think it is nonsensical for any court of law of the land to enforce a diktat of the national flag being hoisted by any Indian, anywhere.
You cannot enforce patriotism.
What you can do is enforce respect of the flag. By force where necessary.
And what you must do is brutally if necessary clamp down on the flag of a hostile sovereign state being unfurled on our soil.
But you cannot tell Indians, you must hoist our flag. If its not coming automatically from within, its of no value forcing the same.
If anything I feel we have way too many laws about furling our own flag. You go to the US and you see their flag everywhere. Here there is a severe dearth of the tricolor.
I was driving to Mumbai the other day and I was descending the ghat gingerly from Lonavala (with the rock falls etc.) and I see this MASSIVE tricolor fluttering majestically in Khopoli valley as the expressway wound and looped downwards.
All the hairs on my hand stood up, and I acted a bit silly and childish and saluted the flag while holding the steering with my other hand. Oblivious of the other motorists close around, or the others (office folk) in my car.
Its our flag. If we do not feel a surge of emotion for it, no HC or SC is going to plant that into us. We are already a lost cause.
Sir, why are you missing the point? Flag hoisting is to be done in govt assisted schools so that young minds learn love and respect and a sense of brotherhood from it. These young kids do not decide whether to arrange that ceremony, some old bearded mullah does. And he can be and must be forced to do it if he wants govt assistance and recognition.
We are only working towards one of the stated goals of our education system.
