Chakmas Refuses to Vacate Encroached Arunachal Land
Singpho Youth Organization has expressed concern over failure of administration to clear the Arunachalee tribal land encroached by Chakma refugees at M- Pen, near Miao. The encroached land belongs to one Thuing Singpho and major clash had broken between locals and Chakma refugees over thesaid plot of land 2 years ago. The organization claims that ADC cum Judicial Magistrate, First Class, Miao vide Case No. Crl. Revn (P) No. 08(A.P) 2009 on 31/03/2010 had issued an order directing the illegal encroachers to vacate the land within 4 days from the date of pronouncement of his orderfailing which, the Officer In charge, Miao Police Station along with the Deptt. of Land Management, Govt. of Arunachal Pradesh will pursue eviction of the land at M¡¯pen and handit over to it¡¯s legal owner Thuing Singpho immediately and maintain law and order on the disputed land.
In response to the above judicial order, 131 Chakma refugees, headed by one Samaran Chakma filed a Criminal Revision Petition at Gauhati High Court, Itanagar Permanent Bench vide Order Dated.07/07/2011, against the ADC cum Judicial Magistrate, First Class, Miao, the Circle Officer, Miao Revenue Circle, Deptt. of Land Management, Miao, the Officer In- charge, Miao Police Station, Miao and Thuing Singpho, W/o Lt. P. J. Singpho stating that the land at M¡¯pen belongs to them. The High Court in its judgment rejected the appealand advised both the parties to move the Competent Civil Court, to decide their right and title under Civil law. Further the Gauhati High Court Permanent Bench, Itanagar passeda judgment dated 15th February 2010, directing both the above parties to maintain Status- quo as on 10/09/2008 (as passed in Crl. Revn. No. 285/ 2008) in respect of the disputed land at M¡¯pen Village. Thereafter, theChakma refugees of M¡¯pen Village filed a case COP( c ) No. 01/2009 violating the order of the status- quo.
The organization further claimed that the Singpho community during last September decided to move to M¡¯pen village for taking possession of the said land, but surprisingly the police prohibited them stating that it will be a violation of the status- quo and immediately imposed Sec.144 CrPC at Miao township. This decision offered a golden opportunity for the Chakma refugees as they started constructing dwelling houses and cultivates vegetation free from any obstruction, even from the administration and police, which is a biased move from the government¡¯s side, the Singpho Youth Organization rued.
On 22nd September this year, police authorities of Miao Sub Division went to M¡¯pen Village for eviction of the encroached land, but they returned back empty handed stating that they didn¡¯t have enough lady constables, which again proves the failure of administration and police and the very concept of justice delivery system culminates to nowhere. After the above failure, the Deputy Commissioner, Changlang, met with the Singpho leaders and Youths at Miao on 27th September and assured them of delivering immediate justice. But, even after 23 days, nothing positive on the above case is witnessed. Though the administration has pronounced judgments in favour of the Singpho community who are original land owners of M¡¯pen Singpho village, it has much more mechanisms to materialize, since the illegal Chakma refugees still are in possession of the Singpho land in question. ¡°Therefore it is our fervent appeal to all the government departments concerned and the political leaders to help us resolve the case as soon as possible, before those illegal migrants intrudeinside our own doors,¡± stated Singpho Youth Organization.
