No we're not. We're only enforcing the territorial claim we enacted in our constitution in 1949. In more than 60 years, those proclaimed borders did not increase an inch.

In 1949, we did not immediately attack all these countries we had a territorial dispute with, or even after we developed nuclear weapons in 1967, which made them feel like we didn't really mean it when we make our territorial claims.

Today China is strong enough to take back our territory with raw military power so they feel like we have become more aggressive. Even if so, there is nothing to be ashamed of.... we did not collect the debt when it first became due but it is not too late to collect it today.

The sea dispute reflects our lack of control over our territorial waters. Much of the islands are still under Vietnams and the Philippines control. We still do not have enough long range supply capability to control these waters. This is the reason that countries like the Philippines have aggressively attacked our fishing boats and even fatally shot our fishermen. The building of a blue water navy takes time. Only a strong navy can make sure our sea claim is respected.

China did not nullify any commitment to international law. When we signed the UNCLOS, there were two separate documents. One dealt with the boundaries of the territorial water and EEZ etc, and the other dealt with UN court arbitration in case of dispute...Thus, the UN court has no juristiction over us. Second, the PRC maintained the same claim to territories since 1949 -

2. The People's Republic of China will effect, through consultations, the delimitation of the boundary of the maritime jurisdiction with the States with coasts opposite or adjacent to China respectively on the basis of international law and in accordance with the principle of equitability.

3. The People's Republic of China reaffirms its sovereignty over all its archipelagos and islands as listed in article 2 of the Law of the People's Republic of China on the territorial sea and the contiguous zone, which was promulgated on 25 February 1992.

4. The People's Republic of China reaffirms that the provisions of the United Nations Convention on the Law of the Sea concerning innocent passage through the territorial sea shall not prejudice the right of a coastal State to request, in accordance with its laws and regulations, a foreign State to obtain advance approval from or give prior notification to the coastal State for the passage of its warships through the territorial sea of the coastal State.

That is, China agreed to commit to UNCLOS' boundary limitations AND dispute procedure. In 2006 China officially reneged on the U.N. procedure - and, in effect, on its previous commitment to conform to UNCLOS.

We did not have the money, influence or the military forces to back our boundaries in 1949. Today we do, and that's all we should be doing. However, we should never go down the route of United States, constantly invading foreign nations and toppling governments.

Not everything has to be resolved through military means. Quit being such an extreme expansionist. I am not interested in any foreign land, only those described in our constitution since 1949.

Declarations or Statements upon UNCLOS ratification
Introduction:

Article 310 of the Convention allows States and entities to make declarations or statements regarding its application at the time of signing, ratifying or acceding to the Convention, which do not purport to exclude or modify the legal effect of the provisions of the Convention.

Article 310 reads:

"Article 310. Declarations and statements "Article 309 does not preclude a State, when signing, ratifying or acceding to this Convention, from making declarations or statements, however phrased or named, with a view, inter alia, to the harmonization of its laws and regulations with the provisions of this Convention, provided that such declarations or statements do not purport to exclude or to modify the legal effect of the provisions of this Convention in their application to that State."

Article 287, paragraph 1, provides that States and entities, when signing, ratifying or acceding to the Convention, or at any time thereafter, may make declarations specifying the forums for the settlement of disputes which they accept.
As anybody can read from above, the UNCLOS, being a loose convention allowed states to add declaration and statement at anytime.

Below is the list of countries/states that has made some form of declaration at different stages. (also from the UN webpage link at the top).

To characterized China having done the same as one of the states listed above as having "Renege" UNCLOS (while fully allowed by the convention) without further clarification is in my view intellectually dishonest.

We have maintained the same claim to South China Sea since 1949, and the previous government also claim the area. The claims are consistent, and has not changed. The only difference is we clearly defined the 9 dotted lines.

Nobody is stopping Americans with withdrawing back to Europe since they have the money and military to do so. You are also unlikely to face persecution at this day and age in Europe. Better yet, nobody is stopping the Zionists from withdrawing illegally occupied Palestine too. So what's stopping you?

The Philippine Navy does not have the capability to fight your hi tech navy. The BRP Gregorio Del Pilar is the best the navy has while china has Type 54A frigates.
