I say go for it, the Italians can't do jack and India has it's pride on the line.

In such a scenario the most interesting thing to watch out for will be the reaction of US, UK and another NATO countries

The killing was not pre meditated and the circumstances when the killing happened are different than usual, hence should not fall under rarest of rare cases.

It has nothing to do with rarest of rare. But, what the penalty is provided if prosecution happens under certain laws.

Its an election year. Any other time they could have wriggled its way out of this massive diplomatic **** fest and given both themselves and the Italians a face saver.

Read my post above. Supreme court categorically defines "the rarest of the rare" cases where a death sentence can be given. This is not one of those cases. There is no chance of them getting a death sentence. Italy knows it too. This false bravado is for their domestic consumption.

Please read the Act under which they NIA is recommending them to be tried. Sentences are awared as per the list of penalties depending on which IPC/ Act the case is filed. If the NIA has its way, then the only penalty is the death penalty.

The problem for the NIA is that, the NIA Act doesn't allow the agency to prosecute a simple murder case, under the IPC's section 302, so it has no choice but to invoke SUPA.

To give you an idea of how rare it is in India, there have been only 52 executions carried out in the last 66 years. Most other death sentences have been commuted to life terms.
