China on the Matter of Jurisdiction in the South China Sea Arbitration

The international law of the sea, UNCLOS is clear. The whole world has accepted it except China. It's a shame especially when it is a permanent member of the UN Security Council. Breaking international law with impunity is irresponsible and sets a bad example in international relations.
Pending for the US join this law & obey. If they don't, we have to say NO & ignore it too.

Worst than west? We don't let our bad eggs go on other soil, raped and killed and still protect them like angel. Those rapist and murderer deserve to be lynch. Your US master will not do that. They think Pinoy life is cheaper than American even that American is bastard like the US marine.

So in the end you lose few island must at least you retain your pride. But with US master and marine on your soil. You never retain your pride. Pinoy will always be second class citizen unless you are some Pinoy big shot or politician.

Ok, that's fair. But the US has got a minor gripe and that is defining if the extended territorial limit of waters, including oil and mineral rights, are under State or Federal control.

That's where the hold-up is.


But where China is concerned they are claiming the whole of South China Sea as personal property!

No. Every country has a right to either join/ratify UNCLOS or not. Joining it is entirely is voluntary.

The US has refused to join. China joined. Both had the right to make their respective choice.

Here's the thing, UNCLOS is a legally binding convention and law. Since China has joined, it is binded to UNCLOS law. If China ignore UNCLOS, then they are breaking an international law that they themselve have ratified. The bottom line is, China has a legal obligation to obey UNCLOS regardless of whether the US join or not. However, If the US ignore UNCLOS, the US is not breaking any law because it has never ratified UNCLOS.

So you cannot compare China to the US in terms of the UNCLOS law.

As for the common suggestion that the US is a hypocrite for not joining UNCLOS, or that they must not have any say in the dispute until they join/ratify UNCLOS, these suggestions has bad reasoning.

Suppose both of you two have voluntarily entered into a legally binding business partnership contract and then both of you later on have a contractual dispute.

Suppose I'm a lawyer being hired by one of you to participate in your legal dispute. I, as a non-signatory third party to your business partnership, can still make comments and have a say in your legal dispute. Eventhough I have never myself joined your legal business partnership contract, I can still participate in your dispute resolution/mediation process because I have been asked(hired) by one of the dispute party to participate in it. For example I, as a lawyer, can argue on behalf of the plaintiff that the defendant has broken its contractual obligations, argue for certain ruling against the defendant, etc.

So it is the same thing for the SCS dispute. The US is not signatory to UNCLOS while both the Philippines and China are signatories. But it doesn't mean that the US cannot have any say in their UNCLOS dispute case. If the Philippines welcome the US to do so, then the US can.

no the whole south china sea, only the area in nine lines that we claim. and ships without hostility & criminal action, can pass this area freely.

You either remain a signatory to UNCLOS and its laws, conventions and rulings will be legally binding to you.

Or you can stay out of UNCLOS like the US and the law and conventions of UNCLOS will not apply to you.

It's like someone offering you a business contract. You can choose to enter into that contract or refuse it. If you refuse, then you are safe from that contract and no one can use that contract against you.

But if you sign that business contract, then you will be legally binded to that contract. If you break a contract clause, some one else can then use that contract against you and a court can make a legally binding ruling against you. You can ignore the ruling, but under the law, you will be regarded as a law breaker (criminal).

So you can either stay out of UNCLOS or stay in. If you stay in and ignore its law and ruling, you will be regarded as a law breaker (criminal).
