End of the day, India signed a treaty with the Maharaja to hold a referendum in Kashmir.
This deal was not with Pakistan or UN but the Maharaja. And until India fulfills the referendum, it cannot claim Kashmir as it's integral part. (remember, they use this exact treaty to claim so in the first place)

While reacting to Union Home Minister Raj Nath Singh’s statement that no power can snatch Kashmir from us, AIP President Er. Rasheed has said Indian leaders need to answer why they have to cry every time that J&K belongs to India and no power on earth can snatch it from India.

Rasheed said “Least Home Minister and others need to answer is that if they need not to cry about Rajisthan, Bihar, Gujrat or any other Indian state that they are India’s Integral part, what forces them to cry every day that J&K is India’s Integral part. It yet again authenticates that Indian leadership is absolute sure that J&K is a disputed territory on either sides of LOC.

By claiming that no power on earth can snatch J&K from India, Raj Nath Singh has contradicted Indian First Prime Minister Jawahar Lal Nehru’s declaration made at various public forums that India is against forced marriages and will never compel Kashmiris to be part of India against their wishes. As such if Kashmiris ask for right to self determination and New Delhi still threatens them it is simply dishonoring and disgracing Mr. Nehru”. Er. Rasheed rejected Union Home Minister’s claim that Kashmiri youth is being instigated to indulge in violence. He said “Every Kashmiri firmly believes that not only youth should be kept away from politics but their proper place is a college or university.

However Mr. Raj Nath Singh needs to be reminded that it is New Delhi’s arrogance and dumping Kashmiri leaders right from Sheikh Mohammad Abdullah to Mehbooba Mufti and also denying any political space to pro-resistance leaders that pushes youth to wall. No one is forcing youth to take up arms or resort to violence,but the atrocities of men in uniform, denial of justice and the confusing bunch of lies from New Delhi often turn hope into desperation and disappointment, thus forcing youth to take extreme measures”.

Because Government of India fully controls other states of India unlike the state of Jammu and Kashmir which it only controls a part of the state as some parts of the state are under Chinese and Pakistanis control.
