Three Bangladeshi nationals sentenced for illegally entering India in Maharashtra's thane

: Three Bangladeshi nationals were convicted and sentenced by the Thane sessions court to five years rigorous imprisonment for illegally entering India without any valid documents.

Those convicted and sentenced include Ishrafil Shikhadar ,56, Litan Mandal @ Mandol ,30 , and Shamim Mulla, 35. All residents from Nadail district of Bangladesh were convicted by special judge MB Patwari in separate orders.


The prosecution in its submission said that based on information that some people were living illegally in Kopri area, the police carried out a raid in which the trio were arrested by the local police. They had no proper documentation.
Hence, they were tried under various sections of Passport ( Entry into India ) Act, 1920 and under Section 420-cheating and 468 -Forgery for cheating of Indian Penal Code at the Kopri police station.

The judge in his order noted that the accused in their submission pleaded guilty after informing them for the maximum sentence that could be imposed against them for the offences they were booked on; they preferred to confess to the crime which was voluntary and the court accepted the same.

The prosecutor informed that the judge in its order accepted the submissions of the prosecution and held that the prosecution has proved all the charges against the accused who need to be convicted and sentenced on the basis of the sections they were booked.
The court along with the sentence imposed the fine on the trio of a sum of Rs. 1,500 each on the three accused, the prosecutor informed.

The judge further stated that considering the age, antecedent of the accused and nature of the offence, the accused were in the jail since March 2017 will get set off from the sentence for the term served in the jail, the order pointed out.

Further the judge directed the state to seek necessary directions from the concerned authority under the Passport ( Entry into India ) Act, 1920 and Rules 1950 and the accused be deported to their country. The court also directed the concerned police station i.e Kopri police station to submit the report of deportation of the accused.

The detention centre built exclusively to keep illegal foreigners has started operations in Assam. On Friday, the first batch of 68 illegal foreigners was shifted to the Matia Transit Camp in Goalpara district. With this, the process of transferring illegal foreigners from detention camps inside regular jails to the transit camp has begun.

The 68 people shifted to the centre included 45 men, 21 women and 2 children.

Torture nahi yaar. Akhir bigada kya hai? Shoot them dead after confirming their identity. Confirmation is necessary because you know Indian police many a times arrests innocents deliberately. Once confirmed, shooting is the only option because Bangladesh won't accept them.

Since we are talking fantasy, I am all for auctioning them as slaves.

Unless they are treated as 3rd class citizens, it won't stop migration from 2nd class Bangladesh.

Illegal migrants are NOT "innocent". They are criminals in the eyes of the law.

And most of them do ILLEGAL work since they don't have any legal means of earning money.

They are our friends as long as they live in Bangladesh and not invade India. Or live anywhere in the world EXCEPT India.

Illegal migrants are a dilemma, but I disagree strongly with you on their criminality. It takes a lot of desperation and mental fortitude to get up and cross a border illegally. Many do so for economic reasons, but if they felt they could achieve their dreams where they are, they wouldn't have bothered with the sheer torture that is illegal border crossing.

I am not interested in a debate, if you feel so inclined, mull over it and arrive at your own conclusion.

  1. Irregular entry and stay by migrants should not be treated as a criminal offence, because the mere fact of crossing a border or staying in a country irregularly is not a crime per se against persons, property or national security and should not be treated as such.
  2. Criminalizing people on the basis of their migration status can lead to a number of other human rights violations, including discriminatory profiling, arbitrary arrest and detention, family separation, and the inability to access critical health care, housing, education or other rights.
  3. Such approaches further push migrants to live and work in the shadows of society and increase their vulnerability to exploitation and abuse by State and private actors. In the absence of safe pathways for migration, many migrants are compelled to enter and stay irregularly in countries of destination.

If it was about making a better life, they would be doing it in Bangladesh. Why would they infiltrate a poor country of open defecation?

Because the demand for a separate "Pakistan" originally came from Bangladesh. Muslim League was formed in Bangladesh.

Since you don't want a debate, I will keep it short.

India is not a signatory to the 1951 Refugee Convention, the United Nations principle of non-refoulement and impediment to expulsion does not apply in India.

If you are seeking Sympathy for them, You will find NONE.

I hope this is clear enough.

I guess you or your native place haven't faced the swamp of cockroaches.... I do not condone the unnecessary stupid hostility & inhumanly treatment advocated by few deadbeats here. But they should be treated as criminals and accorded harshest possible punishment under IPC followed by deportation. Do remember, this 5-10 illegals are nothing when one has to face the brunt from millions of them. Visit Assam sometimes...

If it was institutionalized, we wouldn't be having this problem.

People will always talk about it.

Most of these people have some form of official Indian document. India never truly has documented her population and faces challenges in application of her citizenship law with most of it being used for personal grievances as hinted by the OP.
