It's not Bangladesh's internal matter. Mujib ur Rehman signed agreement with Pakistan and India that there will be no such prosecutions. In return Pakistan recognised Bangladesh as state. Current government of BD is violating an international agreement with us. Matter is not internal.

Revoke the recognition of Bangladesh then (i.e actually take some action instead of this banter and diplo-trolling back and forth)

They have not held up their end of the deal, so why should you?

They were Pakistani citizens at the time of war.

I don't have the exact text. No prosecution under Mujib and since then consecutive governments including Haseena's own should tell you that such agreement was in place.

Because of three major reasons, Bangladesh is unable to detach itself from the events of 1971. First, anti-Pakistan rhetoric has become an integral part of Bangladesh’s political discourse. It is one thing which has been used by various regimes since 1971 to remind people of the liberation war and the value of freedom. Dec 16 in Bangladesh is celebrated as Victory Day. In fact, most of the national days celebrated in Bangladesh are based on anti-Pakistan rhetoric.

Feb 21 is celebrated as Language Day to mark the struggle launched in East Pakistan to oppose the imposition of Urdu as a national language. March 26 is celebrated as Independence Day to mark the launch of the brutal military operation by the West Pakistan-dominated regime to quell the Awami League-led civil disobedience movement.

Second, some political parties, particularly the Awami League, which fought the liberation war consider it useful to exploit 1971 for political purposes. By diverting people’s attention from ‘real issues’ like corruption, nepotism and bad governance, the AL government is targeting what it calls ‘war criminals’.

Finally, the sufferings caused to the people of Bangladesh in view of the exploitative and unequal relationship with the West Pakistan-dominated regimes have nurtured anti-Pakistan feelings, which persist even after 41 years of independence from Pakistan. The military operation of 1971 alienated the Bengali population of the former eastern wing, and became the source of Bangladesh’s national identity. It is perceived that no government in Bangladesh can detach itself from the events of 1971 and the liberation struggle because the survival of that country rests predominantly on keeping these memories alive

The Foreign Minister of Bangladesh stated that the excesses and manifold crimes committed by those prisoners of war constituted, according to the relevant provisions of the UN General Assembly resolutions and international law, war crimes, crimes against humanity and genocide, and that there was universal consensus that persons charged with such crimes as 195 Pakistani prisons of war should be held to account and subjected to the due process of law. The Minister of State for Defense and Foreign Affairs of the Government of Pakistan said that his Government condemned and deeply regretted any crimes that may have been committed.

14. In this connection, the three Ministers noted that the matter should be viewed in the context of the determination of the three countries to continue resolutely to work for reconciliation. The Ministers further noted that following recognition, the Prime Minister of Pakistan had declared that he would visit Bangladesh in response to the invitation of the Prime Minister of Bangladesh and appealed to the people of Bangladesh to forgive and forget the mistakes of the past in order to promote reconciliation. Similarly, the Prime Minister of Bangladesh had declared with regard to the atrocities and destruction committed in Bangladesh in 1971, that he wanted the people to forget the past and to make a fresh start, stating that the people of Bangladesh knew how to forgive.

In the light of the foregoing and, in particular, having regard to the appeal of the Prime Minister of Pakistan to the people of Bangladesh to forgive and forget the mistakes of the past, the Foreign Minister of Bangladesh stated that the Government of Bangladesh had decided not to proceed with the trials as an act of clemency. It was agreed that the 195 prisoners of war might be repatriated to Pakistan along with the other prisoners of war now in the process of repatriation under the Delhi Agreement.

they were in india .You know the pak army surrendered to indian army . Indian army never wanted Pakistan army face civil justice because both are regular and professional force .Mujib was forced and Mujib had nothing to do or go against indias will .So there was an agreement between mujib and Indira not to face justice of those 193 army officer of Pakistan .

For the people like you Pakistan lost its most precious territory . Bangladesh is not getting down 200 years past but the Bangladesh economy is better than Pakistan now . Nizami can die today doesn't mean that he will not face justice for what have he done! The arms race with the India will suffocate Pakistan soon . Bangladesh is more stable now.

Its a sad tragedy that war criminals walked free (and the role that IG and India played in allowing/seeking for this to happen). Bangladesh honour was trampled on so cheaply by all sides concerned.

Are you saying that India had already coerced/advised Mujib to let these 195 officers go before it was "agreed" upon officially between Pak and B'desh?....or that it was purely a decision by Mujib to go for recognition from Pakistan at earliest opportunity and let bygones be bygones etc? Or some combination of both?

It is the first time I have come across this 195 officer thing specifically...but I have not read in depth about the POW release process. I always thought everyone was released in one go together....but obviously some initial persons of interest process had initiated for some very clear cut criminal cases. I think @asad71 and @Md Akmal posted some information about this in another thread some time back.

Military and civil investigation were carried out by BD and both India and Pakistan knew the charges were true,that's why while they disagreed to prosecute but never denied or rejected the investigation or charges.The investigation were never made public though. But there is a possibility that BD will reinvestigate and made both public.

But there is a possibility that BD will reinvestigate and made both public.

Too much international pressure. Mujib were never a very strong administrator.

He certainly kept a soft spot for Pakistan even after what had happened in 1971....otherwise he would not have folded so easily to that pressure from IG and other quarters. This is one of my strong fundamental grievances with that woman and Mujib to some extent...a horrible blunder and travesty of justice.

Were the names of these 195 officers ever declassified/made public?
