Status of russian prisoners in Ukraine

Some users here posted videos where captured russians got executed by ukrainian forces and claimed this to be war crimes.

Its not war crimes. Russia denies that there is a war in Ukraine and calls it special military operation. It is illegal in russia to call it a war and punishable up to 15 years prison.

Russia did not declare war on Ukraine and simply attacked. Its forces hold the status of irregular combatants and the geneva convention cant be used on them. Since there is no war according to Russia, its forces cant be prisoners of war. Captured soldiers are thus irregular combatants, similar to ISIS or partisan groups.

The "detaining power" may choose to accord the individual the rights and privileges of a prisoner of war as described in the Third Geneva Convention, but is not required to do so.

Which means Ukraine can take them prisoner or execute them.

War or no war, you are still not allowed to execute prisoners of another nations military, as per the geneva convention.

If they were terrorists then Geneva convention doesnt apply, but since they are regular military, it does applh regardless of the situation

No,they are soldiers of the regular army of an internationally recognized State and moreover they were in full uniform.

There is absolutely no comparison to ISIS or partisan groups.

According to Russia, there is no war. How you know its russian soldiers? Could be anyone wearing their uniform. If Kremlin denies there is a war, it obviously cant be regular troops of russia.

Ukraine can execute them if it wishs to do so.
Its irrespective of whether there is a war or isnt one.

If a soldier surrenders, and the offer of surrender is accepted by the Ukrainians (which it was), then the Ukrainians are not allowed to execute them as per the geneva convention.

Should Ukraine had not accepted the surrender then they couldve executed them. However since they did accept them surrendering, they cannot execute them.

Also quote the full geneva convention stance on POW status. Dont just pick and choose


Article 2

In addition to the provisions which shall be implemented in peace time, the present Convention shall apply to all cases of declared war or of any other armed conflict which may arise between two or more of the High Contracting Parties, even if the state of war is not recognized by one of them.

Article 3
In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties, each party to the conflict shall be bound to apply, as a minimum, the following provisions:

1. Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, colour, religion or faith, sex, birth or wealth, or any other similar criteria.

To this end the following acts are and shall remain prohibited at any time and in any place whatsoever with respect to the above-mentioned persons:

(a) Violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;

(b) Taking of hostages;

(c) Outrages upon personal dignity, in particular, humiliating and degrading treatment;

(d) The passing of sentences and the carrying out of executions without previous judgment pronounced by a regularly constituted court affording all the judicial guarantees which are recognized as indispensable by civilized peoples.

2. The wounded and sick shall be collected and cared for.

An impartial humanitarian body, such as the International Committee of the Red Cross, may offer its services to the Parties to the conflict.

The Parties to the conflict should further endeavour to bring into force, by means of special agreements, all or part of the other provisions of the present Convention.

There is a military operation going and the Geneva convention applies to it.

Technically speaking it's really a special military operation not war.
There is hardly any involvement of Russian air force and there is no full use of other two forces as well. That's not what happens in a war.
If Russia really wants to end Ukraine there is no match between Russian and Ukrainian military strength.

But nevertheless, when a military in uniform fights all those ethics of a battlefield applies.And hence the rights of a prisoners taken during the conflict be it a war or special operation doesn't matter.

Yes, @Apollon, there is a Special Military Operation going on so what do you mean by "There is no war" ? How do you think Russia should treat all the psychopaths coming from various parts of the world into Ukraine to help the Ukrainian Nazi criminals ?

As i said, taking the russians prisoner is optional.

I wouldnt kill them and dont support it. But who am i to judge. I think the ukrainians are qualified to make those decissions

And there's thousands of Ukrainian militiamen and reserves in civilian clothes. That's why they wear armbands,to signify that they are militia members. Just like the Volkssturm of the Third Reich in 1945.

In this war though,the armbands consist mostly of a ribbon or duct tape.

As you said yourself "should". Its optional.

In my opinion they should not be killed. They can dig out graves for the killed russians and also rebuild infrastructure.

On the other hand its Ukraine that gets attacked and i dont judge them.
