The Supreme Court restored the Congress government in Arunachal Pradesh, ruling that the state government's action of dissolving the government was illegal. This was a verdict on a batch of petitions dealing with discretionary powers of the Governor to summon or advance the Assembly session of Arunachal Pradesh.

A five-judge constitution bench headed by Justice JS Khehar, which had reserved its judgement on 22 February, pronounced the judgement today.

The apex court had said the verdict in this case will not only affect Arunachal Pradesh, but every other state as well.

Modi slapped again, this time after uttarakhand.

Arunachal Pradesh Returns To Congress, Supreme Court Turns Clock Back: 10 Facts

  1. In a landmark ruling, the Supreme Court restored the status of December 15 in the state, when the Congress government was still in power. Arunachal Pradesh had been under President's Rule since January 26.
  2. "Thank you Supreme Court for explaining to the Prime Minister what democracy is," Congress Vice President Rahul Gandhi tweeted.
  3. On December 16, the Nabam Tuki government was dismissed in an assembly session called by Governor JP Rajkhowa. The court said "all decisions taken by the Arunachal assembly after December 9 are quashed and unsustainable."
  4. Mr Tuki told NDTV: "It is a victory of democracy, the law has protected us and protected our country."
  5. The Congress government was dismissed following days of turmoil after 21 of its 47 lawmakers rebelled against the chief minister.
  6. In the dramatic developments that followed, the Governor advanced the state assembly session, in which opposition legislators, along with the rebels, "removed" Mr Tuki and Speaker Nabam Rebia. The session was held in a community centre and a hotel as the assembly building had been locked on the Speaker's orders.
  7. The governor had justified his action saying he believed that a "biased" Speaker would act in support of Chief Minister Tuki even though he had lost his majority.
  8. The leader of the dissident faction, Kalikho Pul, was sworn in as chief minister on 19 February, with the support of the rebels and 11 legislators of the BJP.
  9. "The government is run by numbers. The court doesn't run the government, numbers do. My government will remain," Kalikho Pul said today.
  10. The Congress won back its government in Uttarakhand in May after its chief minister Harish Rawat won a trust vote ordered by the Supreme Court.

very quiet here ?

It's quite ironic that a few days ago Modi made a huge deal about emergency (basically yet another politically motivated PR stunt from him like his every other move) which happened 40+ years ago but at the same time got rebuked by SC for trying to topple two democratically elected state governments.

well i personally feel central leadership acted in haste in both these states, they have just grabbed power on there own and shall do all such things at political level and no need to ape congress of past so soon

But will this judgement change anything on the ground? Does SC has the power to restore an government? I know it can call for a voting inside an assembly.

Even if the old decision is squashed. How can the remaining members run an minority government? Will INC use Whip to disqualify its own MLA to protect its government?

It may not, as far as AP is concerned. If I am not mistaken now there will be a floor test in the assembly and the Congress govt may not survive it. But in the larger scheme of things that's immaterial. This judgement is important because it sets a very clear precedent and now the central govt will think twice before colluding with governors of states ruled by the opposition to enforce president's rule without following the proper procedure.

To the sickulars, Karnataka SP named Congress ministers in his suicide letter. No sickular media, no award wapasi and no debates...Contrast this to Vemula, who in his latter said 'no one' but castigated Left, the narrative was changed to screw the Hindus.

Now that's what I call Sickular liberal BS...
