SC annuls amendments to NAB laws, restores all corruption cases in landmark verdict

The Supreme Court on Friday declared null and void amendments to the National Accountability Ordinance (NAO) 1999 laws and restored corruption cases against public office holders abolished under the amended law.

A three-member bench of the apex court, headed by Chief Justice Umar Ata Bandial, announced the reserved verdict on PTI chief’s petition challenging the amendments to the law. It was the last day of CJP Bandial in office as he is retiring today.

The bench announced the verdict by 2-1 majority with third member of the bench, Justice Mansoor Ali Shah, writing a note of dissent.

It may be recalled that the apex court had reserved its verdict on Sept 5. A three-judge special bench, led by Chief Justice Umar Ata Bandial and comprising Justice Ijazul Ahsan and Justice Mansoor Ali Shah, heard the plea.

The bench appeared to be visibly divided over the issue during 53 hearings on the former prime minister's petition.

Justice Shah consistently questioned the maintainability of the petition, whereas CJP Bandial and Justice Ahsan remained critical of some of the amendments made to the NAB law by the Pakistan Democratic Movement government.

The CJP was expected to announce the ruling in this case before his retirement, and the judgement “could have far-reaching implications on national politics.”

Now NAB can take-up ToshaKhana Case against Bushra Bibi and Imran Khan, Imran Khan and Bushra Bibi would not be able to get a bail before 90 days.

Hazrat Mian Bhagora sharif of Raiwind would still come on 21 October 2023 after this verdict?

Considering the fact that he is coming back after 4 years itself makes him a bhagora

We have another thread for this topic. Coming back to the topic, only two Prime Ministers were in the list of NAB presented to SC who got benefit from these ammendments, Imran Khan and Shahid Khaqan, their cases will be reopened.

Case should be heard and proceed as per the law since that would mean this bogus case would fall like platelets of Nawaz sharif.

Now NAB can take-up 190Million pounds Corruption Case, ToshaKhana Case and Al-Qadir Case against Bushra Bibi and Imran Khan, they would not be able to get a bail before 90 days.
Before wetting your pants plz remember 90 days remand and no bail law was changed in 2023 NAB amendments.

These are 2022 NAB amendments which are annulled.

So now these NAB cases give military junta more leverage over politicians as NAB has always been controlled by GHQ. Junta already knew/dictated this SC decision and they conveniently appointed one of their generals as chief of NAB ahead of time.

Now every one please start dancing on the tune of pied piper, Sayed Asim Munir.

It was actually quite naive of the endangered species of "patwaris" and "jiyalas" to believe that the establishment, after sidelining the most popular political party in the country with the help of PDM, would simply hand over authority to them on a silver platter.

NAB is now all set to target PTI leaders who won't abandon their captain IK. But it will also keep those PDM leaders from barking too loudly at or trying to bite their owners, aka the "jurnails." In the end it's the civilian supremacy and democracy in Pakistan that have taken a hit

I don't think even NAB knows what jurisdictions they have and not. It's a lame and maimed institution which has outlived its usefulness after successive governments outright engineered the institution's policy.

They should just handover the institution to the military courts and reconsider all the cases under financial terrorism act.
