You are talking about Section 498A slapped by police where its a non Bailable offence, this has been used by most of the wives against their husband, Husband and his family cannot avoid going to Jail. Its a tool given by GOI to all wives.
Police has agreed and slapped 498A because its convinced of Ayesha's marriage with Shoaib. Only allegation is sufficient for 498A.
This seems to be personal matter of Shoaib and Ayesha and Sania why blame GOI ?
Shoaib Malik is too naive to travel to India.

your 123 blah blah law does not apply to a Pakistani citizen visting india , you know this very well. Shoib Malik is player of the national team , indian government will look very foolish if there is a diplomatic row over this issue. It will make the whole of india look even more stupid than it is looking now.

HYDERABAD DECCAN: Ayesha Siddiqui, who claims to be the wife of cricketer Shoaib Malik, created a flutter on Sunday alleging that while Shoaib claims he never saw her, the two had shared an "intimate'' relationship. She also said she was pregnant at one point of their marriage. The pregnancy ended in a miscarriage, she said in a telephonic interview.

Ayesha refused to give details of when she had become pregnant and when and where she had the miscarriage, only saying that her gynaecologist was a certain Dr Fatima in Hyderabad. The doctor could not be traced, there being over a dozen of them in the city by that name.

Her statement left reporters guessing about what she would say next, particularly because Ayesha also said she would produce proof at the appropriate time.

NEW DELHI: Shoaib Malik cannot leave Hyderabad Deccan without permission, Hyderabad police chief said Sunday.

Indian immigration officials have been requested to stop Shoaib Malik from leaving India, Indian police said.

Hyderabad police’s move came after the father of Ayesha Siddiqui, the alleged wife of Shoaid Malik, lodged an FIR with the police against Malik.

ACP Ravender Reddy talking to Geo News said a case has been registered against Shoaib Malik. However, he said no interrogation has far been initiated against Malik.

Madurai: Twenty members of the Hindu Youths Federation were arrested for allegedly tearing and burning pictures of Tennis star Sania Mirza to protest against her proposed marriage withPakistani cricketer Shoaib Malik.
The members held a demonstration earlier condemning Sania Mirza for choosing a Pakistani, and demanded that she should instead marry an Indian Muslim.

They were arrested as they tore and burnt the pictures in the middle of the road disrupting road traffic, police said.

Muzaffarnagar, Apr 4 (PTI) Adding to her woes, a court here will tomorrow take up a complaint against tennis star Sania Mirza for allegedly insulting the national anthem during a function in the town two years ago.

Four separate complaints were filed against Sania by locals under Prevention of Insult to National Honour Act on November 8, 2008.

The remaining three complaints have also been set for hearing in Additional Chief Judicial Magistrate Vikas Goel's court on April 21, April 22 and May 18.

According to the complaints, Sania was allegedly not standing in attention when the national anthem was being played during the closing ceremony of an international women's tennis tournament where she was the chief guest.

Even surveys are being carried out asking questions whether this marriage shall improve relationship between Pakistan and India. I don't know about Pakistan India relationship but the couples relationship could be in danger.
