লঙ্কাকান্ড ঘটে গেছে সুপ্রীমকোর্টে। আইন সচিব জহিরুল দুলালের নেতৃত্বে সশস্ত্র ব্যক্তিরা প্রধান বিচারপতি সুরেন্দ্র কুমার সিনহাকে অপহরণের চেষ্টা করে ব্যর্থ হয়েছে। তবে জোর করে সই নিয়ে প্রচার করা হচ্ছে, প্রধান বিচারপতি এক মাসের ছুটিতে গেছেন!

৭/৮ জন অস্ত্রধারী ব্যক্তি আজ দুপুরে প্রধান বিচারপতির বাসভবনের অফিসে গিয়ে তাকে অফিস থেকে বেরিয়ে যেতে হুমকি দেয়। তারা বলে যে, “তোকে ছুটি দেয়া হয়েছে এক মাসের। তুই জয়েন করেছিল কেনো? প্রাণে বাঁচতে চাইলে চলে যা। রিটায়ার্মেন্ট পর্যন্ত তোর চেহারা যেনো এই আদালতে কেউ না দেখে। তবে তুই বাঁচতে পারবি এক শর্তে তা হলো রায়ের পর্যবেক্ষন বাদ দিতে হবে স্বপ্রনোদিত হয়ে। অন্যথায় মৃত্যুর জন্য প্রস্তুত হও।” জানা গেছে সেনা গোয়েন্দা সংস্থা ডিজিএফআই’র কতিপয় অতি উৎসাহী কর্মকর্তা ও সদস্য, আইন সচিব জহুরুল হক দুলাল এবং শেখ হাসিনা বিশেষ অনুগত দুই ক্যাডার নেতার সমন্বয়ে গঠিত একটি বিশেষ টিম এ অভিযানে চালায়। রোববার রাত থেকে সোমবার দুপুর পর্যন্ত নানাকৌশলে তারা এ অভিযান চালায়। সোমবার দুপুরের পর এ খবর জানাজানি হলে সুপ্রিম কোর্ট বারের নেতৃবৃন্দ সোমবার বিকেলের দিকে প্রধান বিচারপতির বাসভবনে যান। তবে নিরাপত্তার নামে প্রধান বিচারপতির বাসভবনে থাকা প্রহরীরা তাদেরকে ঢুকতে দেয়নি। প্রধান বিচারপতিও স্বাধীনভাবে তার বাসা থেকে বের হতে পারেননি। এমনকি সুপ্রিমকোর্টের কয়েকজন বিচারপতির বাসভবনে গিয়ে প্রধান বিচারপতির সাথে দেখা করতে পারেননি।

সূত্রমতে, শেখ হাসিনার পাঠানো বিশেষ টিমের সশস্ত্র ব্যাক্তিরা নরম গরমে এস কে সিনহাকে পর্যুদস্তু করার চেষ্টা করে। সূত্রমতে, রোববার মধ্যরাতে সশস্ত্র টিমের সদস্যরা প্রধান বিচারপতি এস কে সিনহার কাছে ব্যক্তিগত কারণ দেখিয়ে রাষ্ট্রপতির কাছে ছুটির জন্য আবেদন করতে বলে। এস কে সিনহা রাজি না হলে দু’জন এস কে সিনহার সামনে অস্ত্র বের করে। এর আগেই প্রধান বিচারপতির বাসার নিরাপত্তা প্রহরীদের কাছ থেকে তাদের অস্ত্র কেড়ে নিয়ে তাদেরকে একটি রুমে আটকে রাখা হয়। প্রধান বিচারপতিকে ছুটির আবেদন পত্রে স্বাক্ষর করতে ব্যর্থ হয়ে তারা এক পর্যায়ে প্রধান বিচারপতিকে অপহরণেরও চেষ্টা চালায়। তারা প্রধান বিচারপতির ফোন কেড়ে নেয়। এ সময় তারা প্রধান বিচারপতি এস কে সিনহাকে যাচ্ছেতাই ভাষায় গালাগাল করে।

একজন প্রত্যক্ষদর্শী সূত্রমতে, উত্তেজিত সশস্ত্র ব্যক্তিরা এস কে সিনহাকে গালি দিয়ে বলে, “তোর মতো বিচারপতি হজম করা শেখ হাসিনার জন্য ডাল ভাত।” আইন সচিব জহুরুল দুলাল হুঙ্কার দিয়ে বলে- “তোকেও মেরে ফেলা হবে তোর পরিবারকেও তুলে নেয়া হবে।” এ সময় দু’একজন প্রধান বিচারপতি এসকে সিনহার দিকে তেড়ে যায় বলেও দাবি করে সূত্র।

এক পর্যায়ে প্রধান বিচারপতিকে একটু সময় দিয়ে সশস্ত্র দুর্বৃত্তরা বাইরে এসে দাঁড়ায়। সূত্রমতে, এ সময় একজন সেখানে থেকেই আমেরিকায় শেখ হাসিনার সঙ্গে কথা বলেন। শেখ হাসিনার সঙ্গে কথা শেষে তারা নিজেদের মধ্যে শলাপরামর্শ করে প্রধান বিচারপতিকে ধাক্কা দিয়ে চেয়ারে বসায়। দু’পাশ থেকে দু’ জন প্রধান বিচারপতির মাথায় বন্দুক ধরে তাকে এক মাসের ছুটির দরখাস্তে স্বাক্ষর করতে বাধ্য করে। এরপর তারা কাগজটি নিয়ে বেরিয়ে যায়। রাতের অভিযান শেষে সোমবার সেনা গোয়েন্দা সংস্থার উর্ধতন কর্মকর্তাসহ কয়েকজন প্রধান বিচারপতি এস কে সিনহার বাসভবনে যায়। প্রায় এক ঘন্টা সেখানে থাকার পর তারা বেরিয়ে আসে। এরপরই এটর্নি জেনারেল মাহবুবে আলম এবং আইনমন্ত্রী এডভোকেট আনিসুল হক সাংবাদিকদের জানান, প্রধান বিচারপতি এস কে সিনহা এক মাসের ছুটির জন্য রাষ্ট্রপতির কাছে ছুটির আবেদন করেছেন।

জানা গেছে, এক মাসের অবকাশ শেষে সুপ্রিম কোর্ট খুলছে মঙ্গলবার। এ দিন থেকে ছুটি চেয়েই রাষ্ট্রপতির কাছে প্রধান বিচারপতি এসকে সিনহা আবেদন করেছেন বলে গণমাধ্যমে প্রচার করা হচ্ছে। এদিকে এরইমধ্যে প্রধান বিচারপতি এসকে সিনহা’র এক মাসের ছুটির ফাইল এখন প্রধানমন্ত্রীর কার্যালয়ে। প্রধানমন্ত্রীর কার্যালয় ফাইলটি ই- ফাইলে রুপান্তর করে যুক্তরাষ্ট্রে অবস্থানরত প্রধানমন্ত্রী শেখ হাসিনার কাছে পাঠিয়েছে। প্রধানমন্ত্রী শেখ হাসিনা ইতেমধ্যে নথিতে সই করে দিয়েছেন। তা প্রেসিডেন্টের কাছে পাঠানো হয়েছে।

বঙ্গভবন সুত্রও মিডিয়াতে জানাচ্ছে, এক মাসের অবকাশ শেষে সুপ্রিম কোর্ট খুলবে মঙ্গলবার। ওই দিন থেকে ছুটি চেয়ে রাষ্ট্রপতির কাছে আবেদন করেছেন প্রধান বিচারপতি এসকে সিনহা। প্রধান বিচারপতি ছুটিতে গেলে আপিল বিভাগের জ্যেষ্ঠ বিচারক হিসেবে প্রধান বিচারপতির দায়িত্ব পালন করবেন বিচারপতি মো. ওয়াহহাব মিয়া।

The chief justice, SK Sinha, on Monday sought leave for a month on the ground of his ‘illness’ with effect from today, when the Supreme Court will resume after a 37-day long vacation.
The minister for law, justice and parliamentary affairs, Anisul Huq, told New Age that the chief justice submitted an application and it was forwarded to the president’s office.
Attorney general Mahbubey Alam at a briefing at his office said that issuance of a government order was under process assigning the duty and functions of the chief justice to senior most Appellate Division judge Justice Md Abdul Wahhab Miah under Article 97 of the constitution.
The Article 97 reads, ‘If the office of the chief justice becomes vacant, or if the president is satisfied that the chief justice is, on account of absence, illness, or any other cause, unable to perform the functions of his office, those functions shall, until some other person has entered upon that office, or until the chief justice has resumed his duties, as the case may be, be performed by the next most senior judge of the Appellate Division.’
Mahbubey Alam said that since the chief justice went on a one-month leave, he would not sit in the court today, he said.
Justice Sinha’s name was not on the cause list, the list of courts and cases to be heard, for today posted on the website.
Supreme Court Bar Association president Zainul Abedin and secretary AM Mahbubuddin Khokan told reporters that taking such a long leave by a chief justice is unprecedented in the history of the country’s judiciary.
‘We cannot understand why the chief justice left office seeking leave after inviting lawyers for the traditional get together of the judges and lawyers scheduled for Tuesday after a long vacation for 37 days ,’ Zainul said.
Zainul said that bar association leaders failed to meet the chief justice at his residence as the security guards told them that the chief justice was willing to meet nobody right at the moment.
‘The security guards told us that the chief justice was not ill,’ he added.

According to court officials, the chief justice was at his office from 9:00am to 2:30pm on Monday.
The officials said that before leaving the office, the chief justice sent a computer-composed letter to Bangabhban through a court staff.
The Supreme Court Bar Association called an emergency meeting of its executive committee this morning ‘following the sudden decision of the chief justice.’
In August, lawyers toeing ruling Awami League’s political line held countrywide demonstrations demanding that observations Justice Sinha made in the judgement in the 16th amendment case be expunged.
The verdict, which was written by the justice SK Sinha, had scrapped the 16th amendment to the constitution empowering the parliament to remove Supreme Court for misbehaviour and incapacity.
The full verdict was released on August 1.
Bangabandhu Awami Ainjibi Parishad, a platform of pro-Awami League lawyers, demanded that the chief justice should immediately expunge the observations relating to the country’s founding president Sheikh Mujibur Rahman saying that the remarks had undermined Mujib’s leadership in the Liberation War.
The AL lawyers later demanded resignation of the chief justice unless he expunged the observation.
Earlier, prime minister Sheikh Hasina, also the Awami League president, censured the chief justice and asked the party leaders to criticise the verdict.
On September 13, Jatiya Sangsad unanimously resolved that appropriate legal steps be taken for the cancellation the declaration of the 16th amendment to constitution as ‘ultra vires’ and unconstitutional, objectionable and irrelevant observations made by the chief justice about parliament and other important issues in the verdict in the 16th amendment case.
Lawyers toeing BNP’s political line, however, supported the apex court’s unanimous verdict and the observations and blasted the government and the ruling AL for making ‘contemptuous statements’ against the Appellate Division.
The chief justice and the government were at loggerheads for long over publishing Supreme Court-drafted disciplinary rules for lower court judges in official gazette.
SK Sinha assumed office on January 17, 2015 as the country’s 21st chief justice. His retirement is scheduled for January 31, 2018.

সুপ্রিম কোর্টের প্রধান বিচারপতি সুরেন্দ্র কুমার সিনহার আকস্মিক ছুটিতে যাওয়াকে কেন্দ্র করে জরুরি সভায় বসেছে সুপ্রিম কোর্ট আইনজীবী সমিতি।

মঙ্গলবার (০৩ অক্টোবর) সকাল ৯টা ৫৫ মিনিটের দিকে এ সভা শুরু হয়। সভায় উপস্থিত আছেন সমিতির সভাপতি-সেক্রেটারিসহ কার্যনির্বাহী কমিটির সদস্যরা।


এর আগে গতকাল সোমবার (০২ অক্টোবর) সন্ধ্যায় প্রধান বিচারপতির ছুটিতে যাওয়ার খবরে তার বাসভবনে দেখা করতে যান বার সভাপতি অ্যাডভোকেট জয়নুল আবেদীন ও সম্পাদক এম মাহবুবউদ্দিন খোকনসহ সমিতির নেতৃবৃন্দ। কিন্তু বাসভবনের নিরাপত্তার দায়িত্বে নিয়োজিত পুলিশ কর্মকর্তারা জানান যে, প্রধান বিচারপতি দেখা করবেন না। পরে বার নেতৃবৃন্দ সুপ্রিম কোর্ট আইনজীবী সমিতি ভবনে ফিরে আসেন।

এ সময় বার সভাপতি অ্যাডভোকেট জয়নুল আবেদীন সাংবাদিকদের বলেন, ‘দীর্ঘ অবকাশ শেষে কাল মঙ্গলবার সকালে প্রধান বিচারপতির সঙ্গে আইনজীবীদের পুনর্মিলনী অনুষ্ঠান ছিলো। কিন্তু আমরা জানতে পারি প্রধান বিচারপতি এক মাসের ছুটিতে গেছেন। হঠাৎ করে কি এমন ঘটনা ঘটল যে দীর্ঘ অবকাশের পর তিনি আবার ছুটিতে গেলেন? শুধু আইনজীবীরা নয় দেশবাসীও এটা জানতে চায়।’

Chief Justice Surendra Kumar Sinha has written to President Abdul Hamid to take a month-long leave.

The chief justice has asked for the leave on medical grounds.

Minister for Law, Justice and Parliamentary Affairs Anisul Huq confirmed it to the Dhaka Tribune. He said the application will be sent to the prime minister’s office within Monday. The PMO will then forward the letter to the president. He said: “The seat of the chief justice cannot be vacant for a single day. An acting chief justice will be appointed as soon as possible.”

Attorney General Mahbube Alam told the Dhaka Tribune that as per the law, the next senior-most judge of the Appellate Division will be made acting chief justice. Justice Abdul Wahab Miah will fulfil the duties.

Meanwhile, the Supreme Court Bar Association’s leaders went to visit the CJ’s official residence on Monday evening but failed to meet him.

Bar association president Zainul Abedin said: “Staff of the residence told us that the chief justice was not willing to meet anyone.”

The chief justice was scheduled to join a programme organised by the bar association on Tuesday and the lawyers’ leaders went to his residence to confirm his attendance.

Zainul Abedin told reporters that such a long leave by a chief justice just before the opening of the court after a long vacation is rare in the history of the judiciary.

Bar association Secretary AM Mahbubuddin Khokan said they would arrange a press meet on Tuesday morning over the issue.

সুপ্রীম কোর্ট নিয়ে দিন ভর চরম উত্তেজনার পরে মুখ খুলেছেন প্রধান বিচারপতি এস কে সিনহা। তিনি জানিয়েছেন, “কোনো কাগজে সই করি নি। ছুটিতেও যাচ্ছি না। যা ঘটেছে বিচার বিভাগের চরম অবমাননা। ধংস করা হয়েছে বিচার ব্যবস্থা। এর কঠোর বিচার হওয়া প্রয়োজন।” দুপুরে প্রধান বিচারপতির বাসভবনে একদল অস্ত্রধারী লোকের হানা দেয়ার পরে প্রধান বিচারপতি তার স্টাফ, এবং সহকর্মীদের এ কথা জানান।
আজ বেলা ১২টার পরে বিচারপতির বাসভবনে ঢুকে পড়ে একদল অস্ত্রধারী লোক। তার নিজেদের সরকারী সেনা গোয়েন্দা সংস্থার পরিচয় পত্র দেখায়। বাইরে ২০/২৫জন অস্ত্রধারী থাকে, ভেতরে ঢোকে ৮/১০ জন। তার মধ্যে একজন নেতৃত্ব দিয়ে প্রধান বিচারপতির অফিসে ঢুকে বিচারপতি সিনহার সাথে কর্কশ ভাষায় বলতে থাকেন- “তোকে ছুটি দেয়া হয়েছে এক মাসের। তুই জয়েন করেছিল কেনো? প্রাণে বাঁচতে চাইলে চলে যা। রিটায়ার্মেন্ট পর্যন্ত তোর চেহারা যেনো এই আদালতে কেউ না দেখে। তবে তুই বাঁচতে পারবি এক শর্তে, তা হলো রায়ের পর্যবেক্ষন বাদ দিতে হবে স্বপ্রনোদিত হয়ে। অন্যথায় মৃত্যুর জন্য প্রস্তুত হও।”

অস্ত্রধারী লোকেরা প্রায় ঘন্টাখানেক ঐ বাড়ির ভিতরে থাকে। পরে বেরিয়ে যায়। যাওয়ার পর থেকে এটর্নী জেনারেল মাহবুবে আলম, আইনমন্ত্রী আনিসুল হক, এবং রাষ্ট্রপতির অফিস থেকে জানানো হয়- প্রধান বিচারপতি সুরেন্দ্র সিনহা কাল থেকে এক মাসের ছুটিতে যাচ্ছেন। ধারণা করা হচ্ছে আনিসুল-মাহবুবে চক্রটি অস্ত্রধারীদের সঙ্গে পূর্ন যোগসাজসে কাজ করছেন।

জানা গেছে, প্রধান বিচারপতির বাড়িতে গোয়েন্দা সংস্থার লোক দিয়ে অস্ত্র সহ ঢুকে হুমকি ও হানা দেয়ার ঘটনাটি গাড়িতে বসে পরিচালনা করেন প্রধানমন্ত্রীর নিরাপত্তা উপদেষ্টার পদে কর্মরত অবসরপ্রাপ্ত মেজর জেনারেল তারিক সিদ্দিক ও নবম পদাতিক ডিভিশনের জিওসি মেজর জেনারেল আকবর।

বিকালে সুপ্রিমকোর্ট আইনজীবী সমিতির সভাপতি এডভোকেট জয়নুল আবেদিন ও সম্পাদক ব্যারিস্টার এ এম মাহবুব উদ্দিন খোকনের নেতৃত্বে আইনজীবি সমিতির বেশ কিছু নেতা এসে প্রধান বিচারপতির সঙ্গে সাক্ষাতের চেষ্টা করেন। কিন্তু ফটকের বাইরে প্রচুর আইন শৃঙ্খলা বাহিনী ও গোয়েন্দা সংস্থার লোকেরা তাদের ভিতরে ঢুকতে দেয়নি। এতে প্রতীয়মান হয়, বিচারপতি সিনহাকে গৃহবন্দী করা হয়েছে।

সুপ্রিম কোর্টের প্রধান বিচারপতির এমন ছুটি চাওয়া নজিরবিহীন ঘটনা বলে মন্তব্য করেছেন সুপ্রিমকোর্ট আইনজীবী সমিতির সভাপতি জয়নুল আবেদিন। সোমবার বিকালে সুপ্রিমকোর্ট আইনজীবী সমিতির এক ব্রিফিংয়ে জয়নুল আবেদিন এসব কথা বলেন।

প্রধানমন্ত্রী দেশে ফিরছেন না এবং সরকারী গোয়েন্দা সংস্থা প্রধান বিচারপতিকে অস্ত্র ঠেকিয়ে ভয় দিচ্ছে, এ অবস্থায় দেশময় খবর ছড়িয়ে পড়ছে- দেশে অস্বাভাবিক পরিস্থিতি বিরাজ করছে। যে কোনো সময় সামরিক বাহিনী হস্তক্ষেপ করতে পারে।

Government made Appellate Division senior most judge Md Abdul Wahhab Miah as acting Chief Justice approving 30-days leave of the Chief Justice SK Sinha for his ‘illness’.

The Law Ministry issued a gazette notification regarding this on Monday night with effect from October 3 to November 1.

The court official told New Age that the government notification was reached to the resident of Justice Md Abdul Wahhab Miah Monday night.

A five-member bench chaired by Justice Md Abdul Wahhab Miah started the court proceedings on Tuesday morning.

Supreme Court judges joined a traditional get together with its lawyers at 10:30am on the court premises.

‘We cannot understand why the chief justice left office seeking leave after inviting lawyers for the traditional get together of the judges and lawyers scheduled for Tuesday after a long vacation for 37 days ,’ Zainul said.

Zainul said that bar association leaders failed to meet the chief justice at his residence as the security guards told them that the chief justice was willing to meet nobody right at the moment.

‘The security guards told us that the chief justice was not ill,’ he added.

According to court officials, the chief justice was at his office from 9:00am to 2:30pm on Monday.

The officials said that before leaving the office, the chief justice sent a computer-composed letter to Bangabhban through a court staff.

The Supreme Court Bar Association called an emergency meeting of its executive committee Monday morning ‘following the sudden decision of the chief justice.’

In August, lawyers toeing ruling Awami League’s political line held countrywide demonstrations demanding that observations Justice Sinha made in the judgement in the 16th amendment case be expunged.

The verdict, which was written by the justice SK Sinha, had scrapped the 16th amendment to the constitution empowering the parliament to remove Supreme Court for misbehaviour and incapacity.

The full verdict was released on August 1.

Bangabandhu Awami Ainjibi Parishad, a platform of pro-Awami League lawyers, demanded that the chief justice should immediately expunge the observations relating to the country’s founding president Sheikh Mujibur Rahman saying that the remarks had undermined Mujib’s leadership in the Liberation War.

The AL lawyers later demanded resignation of the chief justice unless he expunged the observation.

Earlier, prime minister Sheikh Hasina, also the Awami League president, censured the chief justice and asked the party leaders to criticise the verdict.

On September 13, Jatiya Sangsad unanimously resolved that appropriate legal steps be taken for the cancellation the declaration of the 16th amendment to constitution as ‘ultra vires’ and unconstitutional, objectionable and irrelevant observations made by the chief justice about parliament and other important issues in the verdict in the 16th amendment case.

Lawyers toeing BNP’s political line, however, supported the apex court’s unanimous verdict and the observations and blasted the government and the ruling AL for making ‘contemptuous statements’ against the Appellate Division.

The chief justice and the government were at loggerheads for long over publishing Supreme Court-drafted disciplinary rules for lower court judges in official gazette.

SK Sinha assumed office on January 17, 2015 as the country’s 21st chief justice. His retirement is scheduled for January 31, 2018.

The president granted Chief Justice SK Sinha’s application for a month’s leave
Law Minister Anisul Huq has said Chief Justice SK Sinha informed President Abdul Hamid that he is suffering from several diseases, including cancer.

He made the statement while talking to the journalists at the secretariat on Monday.

The minister said: “We came to know about the matter after the letter of the chief justice came to the Law Ministry via the Supreme Court’s registrar.

“Later, we sent it to the President and Prime Minister’s offices.”

অবকাশকালীন ছুটি কাটিয়ে আদালতের এজলাসে আর বসা হলো না প্রধান বিচারপতি সুরেন্দ্র কুমার সিনহার। সাবেক বিচারপতি শামসুদ্দিন চৌধুরী মানিকের পরামর্শের আলোকেই প্রধান বিচারপতি এসকে সিনহাকে বাধ্যতামূলক ছুটি দিয়েছে সরকার। কিছু দিন আগে বিচারপতি মানিক একটি অনুষ্ঠানে বলেছিলেন, প্রধান বিচারপতিকে যেন আর আদালতে বসতে দেয়া না হয়। তিনি আদালতে বসতে পারলেই দুইটি কাজ করবে। একটি হলো ১৫৪ জন এমপিকে অবৈধ ঘোষণা করবে। দ্বিতীয় হলো তত্ত্বাবধায়ক সরকার ব্যবস্থা ফিরিয়ে আনবে।

আর সরকারের কাছেও এ তথ্যটা ছিল যে, প্রধান বিচারপতি এসকে সিনহা ছুটির পর এজলাসে বসে প্রথম সপ্তাহেই বিনাভোটে নির্বাচিত ১৫৪ জনকে এমপিকে অবৈধ ঘোষণা করবেন। তাই ছুটি শেষে এজলাসে বসার আগেই তাকে বাধ্যতামূলক ছুটি দিয়েছে সরকার।

অ্যানালাইসিস বিডির অনুসন্ধানে জানা গেছে, সরকারের একটা পক্ষ মনে করছে প্রধান বিচারপতিকে বাধ্যতামূলক ছুটিতে পাঠানোর কারণে বিপদ কেটে গেছে। সংসদ ভেঙ্গে যাওয়ার যে ভয়টা ছিল সেটা আর নেই। এখন নিশ্চিন্তেই মেয়াদের বাকি সময়টাও পার করা যাবে।

তবে, সরকারের বড় একটা অংশ এখনও চরম অস্বস্তি ও ভয়-আতঙ্কের মধ্যে আছে। তারা মনে করছেন, সংবিধানের ষোড়শ সংশোধনী বাতিলের রায়ে প্রধান বিচারপতি এসকে সিনহা রাষ্ট্রের সামগ্রীক বিষয়ের ওপর যে পর্যবেক্ষণ দিয়েছেন সেটা তার মাথা থেকে আসেনি। পরিকল্পিতভাবেই তিনি সরকারের বিগত ৯ বছরের সকল ব্যর্থতা রায়ের পর্যবেক্ষণে তুলে ধরেছেন। এর পেছনে অন্যকোনো শক্তির হাত রয়েছে। বিশেষ করে ভারতের গোয়েন্দা সংস্থা ‘র’ এবং সরকারের ভেতর থেকেই একটি অংশ জড়িত আছে।

তাদের মতে, প্রধান বিচারপতি ছিলেন দাবার গুটি। শুধু তাকে চাপ প্রয়োগ করে ছুটিতে পাঠানোর মাধ্যমেই সংকট কেটে যাবে না। তাকে মাঠে নামিয়ে যারা পেছন থেকে খেলছে তারাতো আর মরে যায়নি। তাদের খেলা বন্ধ হয়নি। প্রধান বিচারপতিকে চাপ প্রয়োগ করে ছুটিতে পাঠানোর কারণে তারা এখন প্রতিশোধের নেশায় মেতে উঠবে। সংসদ ভেঙ্গে গেলে আওয়ামী লীগের যে ক্ষতি হওয়ার সম্ভাবনা ছিল, তারা এখন এরচেয়ে আরও বেশি ক্ষতি করতে পারে। যার খেসারত হয়তোবা দলকে আরও কয়েক যুগ দিতে হতে পারে।

জাতিসংঘের উচ্চপদস্থ প্রতিনিধি দলের সঙ্গে সৌজন্য সাক্ষাৎ করেছে সেনাবাহিনীর প্রধান জেনারেল আবু বেলাল মোহাম্মদ শফিউল হক।

মঙ্গলবার ঢাকা সেনানিবাসের সদর দফতরে এ সাক্ষাৎ অনুষ্ঠিত হয়েছে। জাতিসংঘের প্রতিনিধি দলের নেতৃত্ব দিচ্ছেন জাতিসংঘের ফিল্ড সাপোর্ট বিভাগের সহকারী সেক্রেটারি জেনারেল লিসা এম. বোটেনহেম।

প্রতিনিধিদলের অপর দুই সদস্য হলেন, জাতিসংঘ সদর দফতরের উপ-সামরিক উপদেষ্টা মেজর জেনারেল হাগ ভেন রোসেন এবং সদর দফতরের স্ট্র্যাটিজিক ফোর্স জেনারেশন অ্যান্ড ক্যাপাবিলিটি প্ল্যানিং সেলের প্রধান এডাম স্মিথ।
আইএসপিআর এর ওয়েব সাইটে প্রকাশিত সংবাদ বিজ্ঞপ্তিতে এ তথ্য জানানো হয়েছে।
বিজ্ঞপ্তিতে বলা হয়েছে, সাক্ষাৎকালে তাঁরা পারস্পরিক কুশলাদি বিনিময় ছাড়াও জাতিসংঘ মিশনে বাংলাদেশের অবদান, কার্যক্রম, প্রশিক্ষণ ও পেশাগত বিভিন্ন বিষয়ে আলোচনা করেন।

প্রতিনিধিদলটি জাতিসংঘ মিশনে বাংলাদেশ সেনাবাহিনীর কার্যক্রম ও পেশাদারিত্বের ভূয়সী প্রশংসা করেন।
এ সময় প্রতিনিধিদলের সঙ্গে ছিলেন শান্তিরক্ষা কার্যক্রমের উপ-সামরিক উপদেষ্টা মেজর জেনারেল হিউ ভ্যান রোজেন ও স্ট্রাটেজিক ফোর্স জেনারেশন এণ্ড ক্যাপাবিলিটি প্যানিং এর দলনেতা অ্যাডাম স্মীথ।
প্রসঙ্গত, প্রতিনিধিদলটি গত ৩০ সেপ্টেম্বর জাতিসংঘ ডিফেন্স পিসকিপিং মিনিস্ট্রিয়াল মিটিং ২০১৭ এর প্রস্তুতিমূলক সম্মেলন এ অংশগ্রহণে জন্য বাংলাদেশে এসেছেন।

এছাড়াও তাঁরা ভারপ্রাপ্ত নৌবাহিনী প্রধান ও বিমানবাহিনী প্রধান এর সঙ্গে সৌজন্য সাক্ষাত করেন।
পরে প্রতিনিধিদল বাংলাদেশ ইনস্টিটিউট অব পিস সার্পোট অপারেশন ট্রেনিং (বিপসট) পরিদর্শন করেন। সফর শেষে আজ তাদের ঢাকা ত্যাগ করার কথা রয়েছে।

The chief justice’s leave on health grounds until November 1 started on Tuesday
Chief Justice Surendra Kumar Sinha has gone on his one-month leave to address his ailments, including cancer treatment, and there was no external pressure on him, say the law minister and the attorney general.

Both of them on Tuesday refuted assumptions among different quarters that the chief justice’s sudden decision to go on such long vacation could be related to the recent wave of strong criticisms from Awami League leaders over the scrapping of the 16th Amendment to the constitution.

The chief justice’s leave on health grounds until November 1 started on Tuesday.

Law Minister Anisul Huq said Chief Justice Sinha was suffering from different diseases including cancer, for which he is still receiving treatment. “That is why he decided to take the leave and get some rest. The allegations of pressurising him are totally baseless.”

Attorney General Mahbubey Alam also echoed the minister’s claims. “He [CJ Sinha] received such treatment for cancer before,” he said.

Asked whether the chief justice’s leave would affect the trial proceedings in court, Mahbubey Alam said: “The judiciary will continue to work just fine. Absence of one or two judges never hindered the proceedings before.”

Ruling party lawmakers have been demanding Chief Justice Sinha’s resignation since he led the Appellate Division in July into scrapping the 16th constitutional amendment, which had empowered parliament to impeach judges on grounds of inefficiency and misconduct.

Meanwhile, leaders of the Supreme Court Bar Association (SCBA), which is led largely by pro-BNP lawyers, following a meeting on Tuesday issued a statement, saying that the chief justice was forced to take the medical leave.

SCBA President Zainul Abedin also told reporters: “Everyone knows that a particular political party and the government put immense pressure on the chief justice in different ways following a verdict. We think he was sent on leave as part of that pressure.”

However, about the SCBA claim, the attorney general told reporters that the association was trying to tarnish the judiciary’s reputation.

“The SCBA is controlled by a certain political party and they have been using this matter as a political tool. Their claims have no credibility. Several other parties have also been trying to gain politically over this,” he said.
‘Leave and amendment verdict not related’
Law Minister Anisul Huq on Tuesday also told reporters that there was no nexus between the 16th Amendment verdict and the chief justice’s leave.

“Those trying to connect these matters have ill intentions,” he said, adding that he hoped Chief Justice Sinha would resume work after his vacation period was over.

Meanwhile, Attorney General Mahbubey Alam, responding to a query, told reporters at his office that he had not contacted the chief justice before he decided to go on the leave.

Asked whether he would go to meet the ailing chief justice now, he said: “Maybe … if needed. But I will not forcefully visit him if he does not want to see me. Also, I am not supposed to know his whereabouts always.”
Justice Wahhab made acting CJ
Following a Law Ministry gazette notification issued on Monday night, senior judge of the Appellate Division Justice Md Abdul Wahhab Miah started discharging duties as the acting chief justice on Tuesday.

Justice Miah and four other judges heard several cases starting from 9am. Later, he and the judges from both Appellate and High Court divisions held a courtesy meeting with the lawyers later in the morning.

A full court meeting of all judges from both divisions was also held in the afternoon.

At that meeting, Justice Miah urged the judges to discharge their duties properly, announce and write verdicts in time.

A decision was also taken not to reconstitute the benches. They will be the same as they were before autumn vacation.

ভারপ্রাপ্ত প্রধান বিচারপতি মো. আবদুল ওয়াহাব মিঞার নেতৃত্বে আপিল বিভাগের কার্যক্রম শুরু হয়েছে। মঙ্গলবার (৩ অক্টোবর) সকাল সোয়া ৯টার দিকে আপিল বিভাগের কার্যক্রম শুরু হয়।

সোমবার (২ অক্টোবর) প্রধান বিচারপতি সুরেন্দ্র কুমার সিনহার একমাসের ছুটিতে যাওয়ার পর আইন মন্ত্রণালয় ভারপ্রাপ্ত প্রধান বিচারপতি হিসেবে আব্দুল ওয়াহহাব মিঞায় নাম ঘোষণা করে প্রজ্ঞাপন জারি করে। সে অনুযায়ী মঙ্গলবার (৩ অক্টোবর) সকালে আপিল বিভাগে মামলা পরিচালনায় বসেন মো. আব্দুল ওয়াহহাব মিঞার নেতৃত্বধীন আপিল বেঞ্চ। সকাল ৯ টা থেকে শুরু হয়ে ১০টা পর্যন্ত আপিল বিভাগের কার্যক্রম চলে।

এরপর নিয়ম অনুযায়ী ভারপ্রাপ্ত প্রধান বিচারপতির সঙ্গে অন্যান্য বিচারক ও আইনজীবীরা মত বিনিময় করবেন। এদিকে প্রধান বিচারপতির অনুপস্থিতি নিয়ে সুপ্রিম কোর্ট আইনজীবী সমিতি ভবনে মিছিল করেছে বিএনপি পন্থি আইনজীবীরা। তাদের অভিযোগ প্রধান বিচারপতিকে অবরুদ্ধ করে রেখেছে সরকার।
