Religious parties denounce law protecting women from abuse as 'un-Islamic'

Representatives of more than 35 religious parties came together and condemned the women's protection law as un-Islamic.

LAHORE: An all-parties conference convened by Jamaat-i-Islami and attended by powerful religious groups asked the government on Tuesday to retract an “un-Islamic” law that gives unprecedented protection to female victims of violence.

The Women's Protection Act, passed by Punjab Assembly last month, gives legal protection to women from domestic, psychological and sexual violence.

It also calls for the creation of a toll-free abuse reporting hot line, women's shelters and district-level panels to investigate reports of abuse and mandates the use of GPS bracelets to keep track of offenders.

Domestic abuse, economic discrimination and acid attacks made Pakistan the world's third most dangerous country in the world for women, a 2011 Thomson Reuters Foundation expert poll showed.

But since the law's passage, many conservative clerics and religious leadershave denounced it as being in conflict with the Holy Quran, and the Constitution.

On Tuesday, representatives of more than 35 religious parties and groups came together for a conference called by the Jamaat-i-Islami and condemned the women's protection law as un-Islamic.

“The controversial law to protect women was promulgated to accomplish the West's agenda to destroy the family system in Pakistan,” read the joint declaration issued at the end of the concrescence.

“This act ... is redundant and would add to the miseries of women.”

The passage of the new law was welcomed by rights groups but spirits have since dampened as conservative voices have increasingly called for its retraction.

On Monday, JUI-F chief Fazlur Rehman said Prime Minister Nawaz Sharif had promised him at a meeting that he would address the reservations of religious parties.

“Nawaz Sharif heard our reservations against the Punjab Protection of Women Against Violence Act 2016. He promised to amend the law so that it doesn't contravene the teachings of the Holy Quran,” Fazl told journalists at his residence.

Earlier this month, the Council of Islamic Ideology, a religious body that advises the government on the compatibility of laws with Islam, declared the Women's Protection Act un-Islamic.

A prominent lawyer has also filed a petition in the top sharia court asking it to strike down the law.

How it is in conflict with Islam?

In other words they want to say Islam actually encourage abuse to women? (Na auzbillah)

It is power play by these old men. They want to retain control of their women by whatever means necessary. Otherwise why would anyone be for domestic abuse.

Other day I was discussing this with my wife. And she was of the opinion that its not practical. She said that which women in Pakistan would use it against her husband; if she wants to continue relationship with him. And even if some one uses this law, it would mean end of relationship and most women won't want that.

So we came to the conclusion that women are abused in marital relationship not because there wasn't a law present to protect them. But because in our society a divorced women is frowned upon and becomes untouchable.

No one wants to marry divorced women, specially if she has kids. If she has daughters then they face problems getting marriage proposals.

So I think if we want to improve treatment of women, we need to change the societies attitude towards divorced women. So that women don't continue living life in misery out of fear of what society will think if they get/seek divorce.

Similarly attitude towards unmarried women. Because at time even parents know they are marrying off their daughter to wrong man, but they just don't want to face the torture by society in case their daughter remains unmarried.

My 2 cents.

I had exactly same discussion with my wife. And my wife was having same opinion.

My point was very simple. If I slap my wife let's say slowly, or do something with her forcefully. She might not do anything unless I am fulfilling my duties, giving her respect, love, admire but what about those who daily beat their wife after having drugs. Even their wife work and they sit at home, had guilt and to hide their guilt they try to misuse their power to keep their wife down, are unthankful.

And why when we say women, we only talk about wife. What about mother, sisters. General women abuse saying bad words to girls in college.

I think women are rational in this regards in our society. But some men are meant to be tamed.

I agree. I am not against the law.

Obviously, this can be used by women if they decide enough is enough, I am done with this moron and now he needs to pay for his deeds.

But the question remains what percentage of women undergoing domestic violence are actually able to make such strong decision? I think percentage will be very low, given our culture.

So what I am trying to say is that, this law won't change anything for most women experiencing domestic violence and hence will end up being a good but useless piece of legislation.

For example: There is a law in Pakistan which requires a husband to seek permission before second marriage. Like the law under-discussion it has become a good but useless law since most men threaten first wife with divorce. Most women make the compromise.

If we wish to make things better for most women we need to change social attitude towards divorced and unmarried women. This will require involvement from religious centers, educational institutions and parents(during upbringing).

As for other women. I did not discuss those because I think majority of cases of domestic violence are in husband-wife relation. But without doubt sisters, mother and daughters also experience domestic violence, but again social attitude will prevent use of this law in most cases, except may be in case mother. Most Pakistani men irrespective of their male ego are okay with getting a beating from their mother :P
