However, what makes him a rascal in my eyes is his track record to the elevation of CJ and his past deeds of self-benefit, nepotism and favoritism that makes him equally as corrupt as anyone else.

Let’s get few things straight here before the discussion on the reinstatement of the CJ of Pakistan proceeds further.

As per the Article 209 [Chapter 4: General Provisions Relating to The Judicature] of [Part VII: The Judicature] of the constitution of Pakistan, only the Supreme Judicial Council of Pakistan can hear the cases of misconduct against the Judges. No other authority including the Senate and/or the President of Pakistan (Dictator or not) can dismiss a Judge let alone the Chief Justice on the basis of misconduct (that includes corruption charges as well). The President can only refer a case of misconduct to the Supreme Judicial Council of Pakistan.

On March 9 2007, President Musharraf suspended Chief Justice and referred his case to the Council on charges of corruption.

On July 20, 2007, CJ was reinstated to his position in a ruling by the thirteen-member bench of Pakistani Supreme Court which also cleared him of the misconduct reference filed against him by the President without investigating the allegations leveled against him. The ruling combined 25 constitutional petitions filed by the CJ and other interested parties, but referred most of the issues raised by the 24 petitions not filed by CJ himself to lower courts for extended adjudication. All thirteen of the sitting Justices agreed that Musharraf's action had been illegal, and ten of the thirteen ordered the reinstatement of gthe CJ and that he "shall be deemed to be holding the said office and shall always be deemed to have been so holding the same."

It is also important to note that the lawyers of Musharraf tendered an unconditional apology for submitting frivilous documents in support of the alleged charges and the Federal Government was fined Rs. 100,000.00

So, anyone who calls CJ names or accuses him publicly for corruption can be "held in contempt". Certainly the 13 Justices who heared the proceedings and the Lawyers nominated by the President were better informed than the few on this forum who let go no chance to insult the honourable CJ of Pakistan. So be careful, do discuss but within the limits of civility and law.

You are right I AM FREE TO DISAGREE and the last time I checked we were living in a democratic Pakistan with freedom of speech rights intact! He is a mere CJ not a holy prophet that he cannot be criticized and labeled the way I feel about his character and personality. He is under the microscope just like the rest of us people.

On the other hand, you should also stop shooting your foul mouth off against Musharraf as he was the COAS of the Pakistan Army which protects our borders day in and out so the likes of you could blabber about having democracy in Pakistan.

So keep your HOLIER THAN THOU attitude to yourself and like I said before, try real hard in growing up and having a more democratic & free mindset. RESPECT IS EARNED NOT DEMANDED! and just because your feel differently about the CJ does not really mean that the rest of the world has to also tow your twisted mindset!

Musharafs actions regarding Chief Justice of Pakistan were illegal and against the constitution. The same was proved by the decision of 13 members full bench of SC.

President can neither sack nor stop a chief justice from working. He did that so violated the constitution.

The reference you are talking about was also not prepared properly. It was merely a document of accusations collected by a spy agency's officer and was filed as a reference which is not correct. The government in the end had to tender an apology for the same and was fined. The same was confirmed three or four days a go by Malik Qayum the then attorney general on 50 Minute at Geo Tv.

One can not question the decision of the SC this is contempt of court with six months jail sentence or a fine or both.

One can only file a review petition under the constitution and perhaps Epool should do the same if he disagrees with the verdict.
