Political Interest Litigation On Sunanda Pushkar, Subramanian Swamy Told

This is not about Shashi Tharoor; I believe that the death needs to be investigated, without pressure from a prominent politician. He has to face investigation, if the authorities believe that his actions need to be investigated.

This is not about the Congress; I have said before and I will say it again: having opposed that party from 1968 onwards, there is no reason for me to plead anything in its favour, except that when there are egregious instances of clandestine adoption of its policies and their display as NDA initiatives, there is every reason to point to those instances as instances of intellectual bankruptcy and the general lack of talent in the NDA.

This is about perhaps the most obnoxious politician in India, and his being put firmly in his place by the highest court. The court's remarks are not generic; they are specific and relate to him in particular. I enjoyed reading it. I hope bhakts of both pigmentations also enjoy it. However, I shall not be lying awake wondering if they did.

The Delhi High Court today dismissed BJP leader Subramanian Swamy's plea seeking a court-monitored SIT probe into the death of Congress MP Shashi Tharoor's wife Sunanda Pushkar, terming his PIL as a "textbook example of a political interest litigation".

A bench of Justices S Muralidhar and I S Mehta said the petition by Swamy cannot be entertained as a PIL. The bench also said that from what was placed before the court, it was unable to be persuaded that the probe, being carried out by the SIT, is botched up or under the influence of any party.

The court was also of the view that Swamy concealed information, based on which he had made "sweeping allegations" against Tharoor and Delhi Police, as he today offered to file an affidavit disclosing his source or reason based on which he had made the accusation.

"Although Subramanian Swamy claimed he has not concealed any data or information, when asked specifically about the basis of his allegations in the petition, his response was to seek time to file affidavit thereby clearly showing that what was to be disclosed at the first instance was not done," the court said.


The bench also said that "Courts need to be careful that judicial process is not used by political persons for their own purposes".


"This is not to say that political persons cannot file PILs, but courts have to be extra cautious when allegations are made against other political persons," the bench added. The court said the petition by Swamy cannot be entertained as a PIL as it appears to be "a textbook example of political interest litigation being dressed up as a PIL".

During the hearing, Additional Solicitor General Sanjay Jain, appearing for the Centre and the Delhi Police, said that they do not subscribe to the views expressed by Swamy that the Congress leader continues to interfere in the investigation.

Pushkar was found dead under mysterious circumstances in a suite of a five-star hotel in Delhi on the night of January 17, 2014.

Doesn't they want that the killers of Pushkar, who so ever they may be, brought to justice?? Tharoor is the biggest source of information and they all are protecting him.Why so much sofe corner, all benefit of doubt to Tharoor.?

First, nobody is insensitive to the Pushkars. I said right at the outset

It is despicable that you should deliberately leave out my qualifying remarks.

Second, Tharoor has not been protected. You obviously make a practice of picking and choosing what to read. Just to rub your face in it,

Why Swamy is after Tharoor? The poor chap tries his best to give positive image of India and is as anti-Pakistan as Swamy claim to be.

My question was, what beef Swamy got against him?

Nothing specific. He attacks any Congressman in sight. He's got a case going on against Sonia Gandhi and Rahul Gandhi about breaches of the law in the matter of keeping a newspaper going, later, in disposing of its assets. It's quite another matter that he might be right in that case.

Tharoor is India best weapon against Pakistan when it comes to intellectual debates over media. Atleast he tries to put across points and India's narrative eloquently. Swamy is doing a massive favor to Pakistan.

He has a different look towards Muslim rulers. Which is kind of agreeable too to a certain aspect. He is not anti Pakistan only against some bodies which run the country by keeping issues of hate mongering.

Swamy is just a confused person he contradicts himself at times.

He is the saying the same things but in different tone to what likes of brash Modi and his gang would utter. Pakistan just brings the inner animal out of them all. But hey, do you hear us complain? I wish Swamy all the luck!

Shashi-baba was always smooth and well-spoken. In those days, two debates that we all looked forward to were the two run by a veddy uppah cwust Calcutta college, Loreto Convent. Everyone waited with bated breath to see if his (or her) college would be invited, and then elbowed and kicked their way into the team. Except our college; from the time my junior from school joined Physics, it became a settled matter, and our school team went on into college (and then into the Institute, but that's another story). In Calcutta, it was more or less Tilottama Mukherjee against the two of us, and she fought a good fight, irrespective of whichever washout was her partner. And then Shashi descended on us. After that, the game was up; all the girls lost their collective hearts to him (think of him forty years younger), and then, injury upon insult, Tilottama married him.

He was a smooth talker, always. What people forget is his debating partner, Ramu Damodaran, short, bow-legged and buck-toothed, but a brain! He gave as good as he got from my team-mate, Kalyan Chatterjee, who is now Emeritus something or the other of Economics at PSU; Kalyan was one of the all-time greatest intellects I have met in my life, and, although a year junior, my mentor in western philosophy, who balanced that rather heavy stuff by giving me LOTR to read (this was 68-69). Ah, those were the days, Ramu and Kalyan hurling MIRVs at each other, while the rest of us watched awe-struck, and then Shashi-baba (he had a Calcutta connection, his Dad worked for The Statesman) came on stage with his pyrotechnics, which HUGELY impressed the females :mad:

The burning smell went all the way up to Delhi.

Enemy will always be enemy and one has to identify the intelligent ones among them. The likes of Manmohan Singh and Tharoor have done more damage to Pakistan then these motor mouths of RSS and co. I wish you another term of Modi and co.

Let me ask you this? Do you really think a fair investigation is being done in Sunanda's murder?
Just for parity, imagine if the same fate were to befall on the murder investigation of Gauri's murder investigation, would you be naming the parties that go to court to demand a fair investigation?
