The Islamabad High Court (IHC) is set to hear today (Thursday) a petition that claims that two lawmakers from the Federally Administered Tribal Areas (FATA) have allegedly concealed their Afghan nationality and violated their oath.
The petition – filed on Wednesday by Nisarul Haq through his counsel Sher Afzal Khan – has challenged qualification of MNA Bismillah Jan and his son Senator Hidayatullah, claiming that they do not fall within the purview of ‘Sadiq and Amin’.
Apart from the two MPs, the petition has also included secretary interior, secretary foreign affairs, Election Commission of Pakistan (ECP), secretary Safron ministry, National Database registration authority chief and Intelligence Bureau chief as respondents.
ECP to announce PTI foreign funding case verdict on May 8
Referring to some documents enclosed with the petition, the petitioner has urged the court to direct the respondents to examine documents and verify their status from the Afghanistan government.
The petitioner claims that Bismillah Jan is an Afghan ‘Tazkira’ or ID cardholder and the department of Population and Census of the Afghan government has certified this fact in an official declaration.
He claims that one of lawmakers’ relatives is a serving brigadier in the Afghan National Army while another is the deputy lieutenant general in Afghan Special Forces.
Being dual nationals, both the lawmakers were under oath to have declared such status at the time of filing nomination papers. They are ineligible in terms of Article 63 (1) (c) of the Constitution, he says.
He has requested the court that both the MPs ‘being usurpers and ineligible’ to hold the offices of the member National Assembly and Senate be called to explain under what authority they hold the offices.
“If they both fail to show any legality, appropriate orders may be passed,” he said. Currently, Hidayatullah is the chairperson for the Committee of Industries and Production while he is also a member of 11 other committees.
