MANILA—The Philippines’ top court ruled that U.S. troops can deploy to the Southeast Asian country, approving a contested defense pact that stands to enhance American power in the region at a time when China is asserting itself more forcefully there.

Tuesday’s ruling ends months of speculation about the Enhanced Defense Cooperation Agreement, designed to revitalize the 65-year-old U.S.-Philippine alliance two decades after American forces pulled out of the country. The 2014 pact had been stalled for nearly two years by a legal challenge.

The Supreme Court’s 10-4 decision came hours before U.S. Secretary of Defense Ash Carter and Secretary of State John Kerry were due to hold security talks with their Philippine counterparts Voltaire Gazmin and Albert Del Rosario in Washington, D.C. While confronting Chinese assertiveness in the disputed South China Sea will still be high on the agenda, the two sides can now focus on implementing a key part of the Obama administration’s strategy of rebalancing to the Asia-Pacific region.

Both countries welcomed the ruling. In a statement, the U.S. Embassy in Manila called the security pact “a mutually beneficial agreement that will enhance our ability to provide rapid humanitarian assistance and help build capacity for the Armed Forces of the Philippines.” The Philippines said the two countries “can now proceed in finalizing the arrangements for its full implementation.”

By ruling that the deal isn’t a new treaty requiring Senate approval but an “executive agreement” legally signed by President Benigno Aquino III, the court ensures that it won’t be abandoned when the term-limited leader leaves office in June. Instead, the U.S. can now deploy thousands of Marines to the Philippines and increase the presence of aircraft and naval ships to Philippine facilities.

The Philippines is banking on a restored American presence at Clark Air Base and Subic Bay—once two of the U.S. military’s biggest overseas bases, located near the South China Sea—to provide “deterrence against further Chinese provocation” and “enhance their security alliance,” said Richard Javad Heydarian, a security expert at De La Salle University in Manila.

On Monday China defended its decision to start operating flights from a newly built airstrip in the disputed Spratly Islands, calling the flights “totally within China’s sovereignty.” China claims most of the South China Sea, parts of which are also claimed by Brunei, Malaysia, the Philippines and Vietnam.

During a visit to Manila late last year, U.S. President Barack Obama pledged to provide two ships to the Philippine Navy, and the Philippines are expected to seek additional military support during the talks in Washington.

“The laundry list of needs for the Philippine military is almost endless,” said Gregory Poling of the Center for Strategic and International Studies, a U.S. think-tank. He said the “U.S. can, and should, regularize and broaden the operations it conducts in the Spratlys via the Freedom of Navigation Program” in support of its ally.

In return, Manila might commit to joining the U.S.’s freedom-of-navigation operations, which Washington began last year to assert the right to sail and fly close to artificial islands recently built by China, said Mr. Heydarian.

The immediate focus, though, will be on upgrading Philippine military facilities to prepare for the arrival of U.S. forces. “The Philippine and the U.S. will have to move quickly” given the pace of Chinese construction in the disputed region, he said.

This is a very good reason not to vote for Binay. As long as there is money in it for him, he will give the entire West Philippine Sea to China. It's "doomsday" at its finest if that really happens this coming May election, we have reason to believe, that the Vice President and his family's doesn't deserve to be in Malacañang and in power to control our destiny... the nerve to have them at the Palace.

:sarcastic:Since when did USA started this business of asking for other nations' permission on where or how her military choose to operates? This is only for local consumption and political mileage.

The truth is with or with any defense agreement, SUPERPOWER like USA has never ever recognized the sovereignty of smaller states e.g. Caribbean, Philippines, etc.

In history, USA has illegally and unilaterally invaded many smaller and weaker nations e.g. Haiti, Panama, etc and even annexed some of them illegally e.g. the Kingdom of Hawaii without ever seeking their consent.

Many years ago, when Malaysia & Indonesia officially informed USA that their approval are needed in order for the US Naval Fleet to sail in the Strait of Malacca. The US Admiral laughed and arrogantly reply was: "Then tell them to try and stop us if they dare". Both nations back out.

:sarcastic:Once, USA has threatened to send their special force to hunt for terrorists inside Malaysia, the indignant Malaysia PM Mahathir repy was "Then we treat American troops as terrorist".

:laugh: Philippines should be more concern with a recent law just assed by China Parliament.

If I am not mistaken, the law empowered China Military to may send their troops into any hostile state to rescue her citizens kept hostages by terrorists or radical groups, etc. Since Philippines does not have any rapport with China, China special force may just enter Mindanao without informing Philippines to rescue the hostages held by radical Islamic terrorist group e.g. Abu Sayyaf, etc.

Just like USA, China is beginning to behave like the other SUPERPOWER USA. Observed how China send her Naval Warship to ship her citizen out of warn torn Libya.

Hopefully americans will learn to respect Filipinas (and transgenders), I don't want to hear any more tragic news about american soldiers raping a women from my country or killing someone just because he's a transgender.

I'm still trying to figure out how those troops are eroding Japan or Korea's liberty, neither of the countries are under a military government. Both countries also have their own armed forces. (though in Japan's case they are self-defence forces)

Both countries are free to ask the US to leave at anytime, just like the Philippines did.

So where are they endangering Korean or Japanese liberty?

Is it just the troop presence that is considered an occupation? Does this mean the US is occupied by Japan?

Not reversed, i doubt he has the political capital to do that, given the political situation in the country, with various party factions. Perhaps he might find a way to engage the Chinese through more bilateral channels. Tho i think Duterte can do the same thing. Anyways, the winter of discontent has to end sometime, my friend. :)

There is much money to be made!

Caribbean is not a country, hence it does not have sovereignty, and you used the wrong grammar too, it should be "the" Caribbean

Kingdom of Hawai'i is not annexed by the US, it was bought by the US from the British and French by American Businessman, same as Alaska just the American bought Alaska from the Russian.

You do know Strait of Malacca is an international waterway, right? No country needed Malaysia and Indonesia permission to transit thru the strait under international law. Of course the US admiral laughing off this "suggestion" as it was violate the UN convention of the seas. Blocking off or denied access is constitute as an act of war.

If Philippines can give sovereignty to United States, it can give sovereignty to China too. This just shows that Philippines does not have the balls to hold up their sovereignty. Chinese sovereignty in SCS is getting stronger and stronger. In the end, Philippines will give up their claims peacefully.

Well I don't know that anyway sure they can send their military to go Mindanao if they can :lol:

If Philippines can give sovereignty to United States, it can give sovereignty to China too. This just shows that Philippines does not have the balls to hold up their sovereignty. Chinese sovereignty in SCS is getting stronger and stronger. In the end, Philippines will give up their claims peacefully.
