PHC bars govt from releasing Ehsanullah Ehsan

PESHAWAR: The Peshawar High Court (PHC) on Wednesday once again stated that clemency cannot be granted to former Tehreek-e-Taliban Pakistan (TTP) spokesperson Ehsanullah Ehsan nor can the government release him without a court order.

The court further ordered the authorities to properly investigate Ehsanullah, after the Deputy Attorney General (DAG) Mussarat Ullah informed the bench that he is still under investigation.

PHC directs to seize accounts of striking schools

Ehsanullah was a top leader of Jamaat-ul-Ahrar faction and the former spokesperson for the TTP, and had surrendered himself to security forces in April 2017.

A two-judge bench of PHC, comprising Justice Qaiser Rashid Khan and Justice Ikram Ullah Khan, disposed of a petition filed by Fazal Khan, father of an Army Public School (APS) victim, who argued that the government is planning to grant clemency to Ehsanullah.

Barrister Amirullah Chamkani, Khan’s lawyer, had argued that the government has not clearly stated its intentions regarding granting leniency to the terrorist leader. The lawyer further demanded a clear response and assurance from relevant authorities stating that Ehsanullah would not be pardoned.

He added that Ehsanullah is the prime accused in the case and had announced himself that the terrorist group had carried out the brutal APS attack.

DAG argued that the case is still immature since the former TTP leader is still under investigation, and once completed, Ehsanullah will be produced in the military court. He added that after the military court’s trial is completed, the petitioner has the right to challenge it in the PHC.

PHC continues drive against quackery

The court remarked that Ehsanullah is the prime accused in the heinous attack on APS and he can’t be granted clemency by the government. But under the law, the families of victims can grant leniency or pardon, only if they want.

There is a concept of " waada muaaf gawah". Remember.

If the information he has provided is of very sensitive and useful nature, he can be spared or he can be given a lenient sentence. By sparing him, there is a possibility that hundreds more surrender bringing with them undeniable proofs of foreign intelligence agencies involvement which can be shared on world forum to expose foreign hand and to decrease pressure on Pakistan.

Also observe that such rights groups who claim that he is a killer and should not be spared were silent on drones. It can't be ruled out that such pressure groups are being used by external powers so that they can prove to other fighters who might surrender that leaving ttp etc isnot an option and they will eventually be killed.

In Balochistan, if militants are being given the option to surrender then why not in case of ehsanullah and others of his kind.

After all, ultimate objective is to kill the insurgency. A minimum time limit can be given for ttp, juA etc to surrender and make peace with the state.

That's practically saying the Taliban are really run by GHQ, isn't it? Why should E.E. be executed without his trial proceedings being made public? A lot of Pakistanis died by his actions and if he was allowed to speak at his trial he was likely able to name, accuse, and maybe prove his many Pakistani enablers - information GHQ might want to keep secret in its own interests, but not necessarily in the interests of Pakistan.
