Pakistan's Latest Ruling Makes Us Want To Bang Our Heads On The Table And Weep

Apparently those who worship judges think judges are only there to say some ruling and not do their work :tsk:

But the system. Honest Judges have been targetted in the past. Does the system protect them is the most pressing question, I feel .

When you remove the fear factor of Judges, Pakistan is going to have judges who start questioning the Parliament.

But what if the SC judges the law to be correct given that it is rooted in Islamic Law? Then the nation must accept the verdicts.

The same. Put the ball in govt court. Its the Parliament which have the power to make and remove laws.
Its the duty of politicians to bring a change, and also the women's of Pakistan are required to hit the streets often to make about a change.

Of course, that is what I said in the very beginning. The judges cannot be vilified for following the law. It is up to the legislators to make and amend laws.

I do not expect a change to happen so drastic in South Asia. We people are so rooted in culture etc. Slowly the change has to happen. Maybe in 15-20 years, the womens in Pakistan will start questioning, get educated, question the law, hit the streets and have the law changed.

The judges cannot be vilified for following the law.
But they can be for not taking it up the ladder! If they dont realize there is a problem and dont initiate the process then they should be "vilified" coz they didnt do their "work"

Calm down ma'am, it's not how article depicts. Courts take into account circumstances and other factors before making such rulings. Young children almost invariably handed over to mothers unless other party can prove beyond doubts that environment she will provide is not conducive for child upbringing (like prostitution, drugs etc). Father gets the right to visit his children. Once grown up, kids can make their decisions. I'm personally aware of court case where children were handed over to mothers and Father lost his right to participate in their upbringing other than contributing money.

Case under discussion is not clear to us. It will be wrong to make assumptions based on this article which is sufficiently biased. If one has access to court proceedings (and you can get them btw) then you will have a clear picture. There have been cases where UK and other foreign mom's fought in our courts and won custody of their kids who were brought here by their Pakistani fathers.

Bashing third world countries sells in western press, you know. Gathering all facts is something else.

My problem is solely with 2 things....courts and their sleepy heads called judges and lawyers AND this statement:

Pakistani women cannot keep their children away from their fathers following a divorce, whatever the circumstances.

The right to protect a child from a predator parent!

THIS is not a 1 case article it is a general article which is true enough shitty in the beginning but as I said I ONLY have 2 problems with this and I mentioned them repeatedly in the thread :tup:

People here are talking about the law and JUDGES can appeal to amend it but IF ONLY they WAKE up first!

I am not against it IF THE FATHER is good... I am against any ruling that paints EVERYTHING with 1 brush!
