On Monday (April 29) local time, the Pakistani Senate passed a Child Marriage Restriction Act that determined the legal age of marriage for women to be 18 years old.

The bill was proposed by Sherry Rehman, a Senate of the People’s Party of Pakistan, who set the minimum age for marriage to the election and the minimum age for obtaining an identity card to be 18 years old.

She said: "We are not promoting Western values, but trying to save innocent lives, because every 20 minutes, a Pakistani woman dies because of early marriage."

A recent survey conducted by the Punjab Commission on the Status of Women in Pakistan showed that early marriage deprived girls of the opportunity to receive education, making it easier for them to give birth to adolescents and encounter domestic violence.

According to the report, nearly 24% of women in the 20-24 age group who were physically and sexually abused were married before the age of 18, and 8% of women were married before the age of 15.

The survey shows that early childbearing brought about by child marriage will result in more children per child and increase infant and mother mortality.

The survey also noted that as more and more women are married in their early 20s, the country’s age of marriage has steadily increased.

In Pakistan, 21% of marriages occur in adolescents under the age of 18. Compared with other Muslim countries, Algeria has a marriage age of 19 years. Bangladesh, Egypt, Turkey, Morocco, Oman, United Arab Emirates and Saudi Arabia are all 18 years old.

However, some lawmakers objected that this restriction runs counter to Islamic law - that is, women can get married when they enter adolescence. The bill may be submitted to the Islamic Ideology Committee (IIC) for further discussion.

Raza Rabbani, the former chairman of the Pakistani Senate and Senator Raza Rabbani, supported the bill and told the House that the bill was submitted to the IIC earlier.

National Mutual Affairs Minister Ali Mohamed Khan said that although the intention of the bill is sublime, there are some issues that should be discussed because the country was established in the name of Islam.

Nasreen was only 12 when she married a man 16 years older than her. Shortly after her marriage, she began to suffer from domestic violence and divorced her husband when she was third pregnant at the age of 18, and then began to receive help from a non-governmental human rights organization.

Child marriage is one of the main problems that Pakistan cannot solve all the year round. A large number of women have similar experiences with Nasreen. According to UNICEF, 21% of Pakistani women get married before the age of 18, 3% get married less than 15 years old, and the overall child marriage rate ranks sixth in the world.

On April 29, the Pakistani Senate passed the Child Marriage Restriction Act (Amendment), raising the minimum legal age of marriage to 18 years.

The new bill is based on an amendment to the 1929 Child Marriage Restriction Act, proposed by Senator Sherry Rehman. According to the amendment, marrying a woman under the age of 18 may result in a fine of Rs. 200,000 for the client and assist the conspirators to be sentenced to three years in prison.

The amendment was proposed once in 2017 but was rejected by the Senate Standing Committee because it “is contrary to the religious ban”.

The legal age of marriage for women in the old bill is 16 years old, but even so, it is rarely strictly enforced because in Sharia, any woman who enters adolescence can marry. Although some provincial governments have legislated on this issue, trying to set a higher minimum age for marriage, or to impose harsher penalties on those who commit child marriage, Pakistani courts still prefer Shari'a.

Child marriages often occur in the most marginalized areas of Pakistan, and these women are more likely to drop out of school than their peers and face health risks associated with pregnancy. Women who are married are more vulnerable to domestic violence and bring a range of poverty problems.

The bill was passed in the Senate’s secret ballot, but sparked a heated debate on the issue. The bill may then be sent to the Islamic Ideology Committee (CII) for further discussion - CII is a constitutional body that provides Islamic legal advice to the Pakistani government.

Federal Minister of Religious Affairs Noorul Haq Qadri stated that “the marriage in Islam has no age limit” and reminded the House of Representatives that a similar bill was once considered by the CII to be “against Islamic law”.

Senator Rehman pointed out that because the voting age and national identity card (NIC) qualification is 18 years old, the age of puberty should also be determined accordingly. “Muslim countries that have declared adolescence at the age of 18 include Bangladesh, Egypt, Turkey, Morocco, Oman, the United Arab Emirates and even Saudi Arabia.”

“We are not promoting Western values, but we are trying to save innocent lives,” she added. “Every 20 minutes, a Pakistani woman dies due to early pregnancy.”

Have nothing to do with religion. Why do you ask ? Do hindus have some special religious requirement to marry before 18 ? If no. They how it matters ? Silly question then.

my dear phellow, I ask because Muslims have their own marriage laws in India under Personal law board. and despite laws, underage marriage is not unheard of. how is it in pakistan ? I have no clue.

We also have Hindu marriage act. That’s a different thing. Minimum age for marriage is something different. And yes, the underage marriage issue exist here too. Hence, the new LAW.

Finally some sense prevailing. I hope this gets cleared and gives females a better life to choose for. Baby steps towards modernizing and catching up with new world basic requirements.

FYI: The legal minimum marriage age for Chinese men is 22 years old, and the legal minimum marriage age for Chinese women is 20 years old. It is impossible to register marriage if the age is not met.

Thats good actually , underage marriages are a huge problem in south Asian societies and also its a good way to control the population

For urban population and educated class, the minimum age requirement don’t matter that much. As when a person complete his 18 years education he is already post 22. He then search for job. Find one. Save money for a year or 1.5 and then marry.

A person who is not 18 years old is not an adult according to Chinese law. He or she has no civil capacity at all, how can they get married?
Under normal circumstances, A person who is 18 years old should be at the first year of college.

18 years old still ,as far as i am concerned, not good enough,but I am very appreciative of the bill passed by the Pakistani Senate.

Not aware of your people. But we here in Sub-continent (Pakistan, India, bangladesh etc) use too much spices in food and some other factors also play their role due to which a normal person attain his adulthood at 13th-14th year of his life. I can say with 100% confidence that 99% of youngster attain their adulthood before they turn 18. So 18 is a good age to get married.

Good step, irrespective of race religion country etc the minimum age of marriage should be 18

I support raising legal age for marriage to 18yrs for bride and groom. Anyone in Pakistan can perform a wedding with presence of two witnesses. It is not necessary to register marriage in Pakistan. People in Pakistan can ignore this law and some could challenge this law in a court.
