Pakistan Supreme Court strikes down bachelor's degree requirement for lawmakers - International Herald Tribune

ISLAMABAD, Pakistan: Pakistan's Supreme Court on Monday struck down a law requiring candidates for Parliament to have bachelor's degrees, clearing the way for the widower of former premier Benazir Bhutto to run for a seat and possibly prime minister.

The ruling was another sign of the dwindling influence of President Pervez Musharraf, who introduced the requirement in 2002, supposedly to improve the caliber of lawmakers.

Supreme Court Chief Justice Abdul Hameed Dogar said the provision was "declared to be void" after a seven-judge panel heard arguments that it discriminated against a large portion of the Pakistani population.

Bhutto widower Asif Ali Zardari, who took over the party leadership after his wife's December assassination, has indicated that he might run for a seat in Parliament in June. Zardari has said he has a degree, but its nature is uncertain and even his party had admitted it was not sure if Zardari would qualify under Pakistani law.

Zardari has not ruled out becoming prime minister at some point.

no more graduate politicians....
:bounce:
zardari saab would b our PM....loshay baba sainnn....:taz:

May Allah bless this country...

Angootha Chaap days are back again! The government could hail this as a triumph for having given relief to the poor politicians. Now the poor buggers dont have to pay the thousand of rupees they used to pay for getting their fake degrees.

. .
Pretty soon all of the Parliamentarians will go to Parliament House in a School bus. They will be dressed up in uniform and President Musharraf can can drive that bus if he is removed. We can hire Biliwal as the teacher.

:hitwall:ONCE again its proved, that mushy has not any rules as he told all pakistanis in 2000 . whatever he said before , he himself deleted all that theory? why?

this action of our supreme court , shows that there are no laws and no thing above than personal intersts in pakistan.this is very shame full act to both musharaf and who ever is going tobe benifited from that ASIF ZARDARI, or any one else.

it is a slap on the face of the pakistans educated peoples.

.
In a country where more than 60% of the people are illiterate, i think Pakistani SC has done a very justifiable act. Double goes for India. Cant let the minority rule the majority. Everyone under a democracy should have a right to contest, whether they win or lose is upto the people(illiterate or not).

Malay.
I can see where you are coming from. But in order to run a Government you have to have some basic knowledge. I know that a degree from a stupid college is far less valuable than the degree from the school of Life, however, this was put in place to encourage people to understand the importance of education. By striking down this rule, you have downgraded the value of education and therefore the value of Parlianment . Secondly, I would still have accepted this if this ruling was not designed specifically for the benefit of one person---------- Zardari, but keeping in view the general benefit of all the masses. Believe me this rabble rouser lot will not allow any poor "Paan waala " from the street to contest the elections and still maintain their elite club. I have also heard the Churchill debate, but frankly, none of these guys are looking after the interest of the masses.

Malay India's economic miracle is because of Dr singh(economist)now imagine if Dr singh was uneducated person and from a village please don't tell me he could have done the same for India and put her on the right track.
Politics in Pakistan is a family business and is passed on from generations to generation no new blood is allowed in that Field as uneducated Idiots could never compete period.
Minister of finance =Mola jut
Minister of education=mola jut 2
I could go on and on but iam speech less but the good news is now that education isn't required i could be a supreme court judge pretty soon.

perfect reply my dear.... you r absoultely right the no "common man" is going to b benifitted by this action. it was specifically designed to "honor" one man..n u knw who he is....i duno y our student folks dont come on street to address this issue.... they r the best ppl to make r govt recognize this issue...if literate ppl like professors n professionals r going to support the issue others can say that coz it is benieficial to these people therefore it is natural for them fight for it, but if shop keepers, bus / taxi drivers, labours, students, molvis...lolzzz., etc etc will raise their voice on this issue..it definetly will make lices in our govts head to move.....

Manmohan Singh alone could not have done anything as the finance minister(i assume your talking about 1991, when India started its economic reforms under Manmohan Singh as FM), IF the then PM had not told him to do it.

Its the whole ruling govts decision to go for reforms or not. The FM alone might want to do it, but cant unless he has the go ahead from the PM and others. So education is not the main issue here, its about political correctness, and in case of '91, India was practically broke with a BoP problem and forex enough for just a week!

Secondly, as another example Lalloo Yadav, the ex CM of Bihar, is as uneducated in economics or management as they come from the street, but he has been the first Railways Minister in the last 30 years who has turned around the Indian Railways fortunes. IR has been perenially in MASSIVE debt and had to be rescued EVERY year by the central govt. Under Lalloo, IR has posted a working profit of Rs 25,000 Crore, thats around US $6.2 Billion! Its unprecedented and historic. I hope your getting what im trying to convey.

Politics in Pakistan is a family business and is passed on from generations to generation no new blood is allowed in that Field as uneducated Idiots could never compete period.

Its the SAME in Congress(The Nehru-Gandhi family). Though i dont think any other party is like that. But still, its Congress who is ruling. And you just know that Rahul Gandhi would become the PM of India one day!

Those already in power will make sure their sons and daughters are educated, so you have nothing to loose while ensuring that the uneducated can take part in elections. While on removing this law, you can have other people take part as well.

You must understand, this is a controversial decision, its like the freedom of speech. You might not like what the other person says, but you still have to defend his right to say it. Democracy means that the people rule, if today you are barring people from taking part in elections because of education, tomorrow you may make a rule that only the educated are allowed to vote using the SAME justifications you are giving now that the educated can make right choices, others cannot, etc, etc.

So trust me when i say, the Pakistani SC did a right thing though it may not be apparent right now. I think having this law in the first place should have been a huge issue, but atleast its been removed now.

lemme assure u....no poor inter pass will ever b going for election unless he happens to b a miilionre also....
so no need to relaxing the law

This is a stupid thread and should be closed immediately.

I don't know what is the problem with these people who are commenting on a decision given by the superior court of Pakistan. The decision by Supreme Court is not given on the basis of likes or dislikes but on the basis of law and constitution of the Pakistan and this amendment introduced by Mr. Musharaf clearly is in violation of the constitution. Only people unaware of the constituion of Pakistan are commenting on this thread.

The constitution clearly provides a level playing field for all citizens of Pakistan to contest election for the seat of provincial or national assembly. All citizens of Pakistan have right to contest election and education is not a criteria for that.

Any one care to tell me which former Prime Ministers of Pakistan were or are illiterate.

^^^^We have the right to critize the courts. If you may remember right after the Supreme Court ruled in September that President Musharraf is the legal President, their were shouts outside the Court against the verdict. The lawyers said they have the right to critize the courts, and so do I. And besides we know this was not done because of any sort of law, this was done to keep the PPP happy in particular Mr.10% because he is the king right now wether we like it or not.
