Pakistan Rejects India’s ‘Evidence’ on 26/11

Pakistan has contended that the Indian evidence against LeT founder Hafiz Saeed of his involvement in Mumbai terror attack is not admissible under their laws for prosecution.

In a dossier given to India in which it asked for handing over of Ajmal Amir Kasab, Islamabad has also asked New Delhi to give all additional evidence related to 26/11 to it by the middle of next month, sources said.

In the dossier given by Pakistan in response to the three dossiers given by India, Islamabad said whatever evidence India has given was not credible and not enough to prosecute anyone in a Pakistani court, sources said.

Pakistan said Indian evidence against Saeed and others, accused in the involvement of Mumbai attack, was mainly based on the statement of Kasab, the lone arrested terrorist in 26/11, and it was not admissible under Pakistani law.

Pakistan has termed India’s claims about involvement of a Pakistan Army Major and dreaded terrorist Ilyas Kashmiri as nothing but “figment of imagination”.

The Pakistani response was handed over by Foreign Office officials to Indian Deputy High Commissioner Rahul Kulshreshth in Islamabad yesterday.

Islamabad has also asked New Delhi to hand over Kasab. It asked India to hand over Kasab to facilitate the trial of LeT’s operations commander Zakiur Rehman Lakhvi and six others charged with involvement in the Mumbai attacks in a Rawalpindi anti-terrorism court.

The Pakistani side also made a request for three Indian officials, including two magistrates and an investigator, to be allowed to travel to Pakistan to testify that they had recorded Kasab’s statement.

Can someone please tell me under which laws are Lakhvi and 'six others' charged? Do the Rawalpindi anti-terrorism court have any jurisdiction over Mumbai attacks?

I believe Maulana Mansoor Azhar and Co. were also not prosecuted in Pakistan for the very same reasons. Can someone clarify this?

What's the new thing !!!!! Pakistan has taken oath to reject the 26/11 evidences by any means..

a bit misleading title and incomplete news.
as far as mumbai attack is concerned, pakistan has clearly stated that bec the evidence has been handed over by india therefore they need to verify it as well in front of a pakistani court. similarly for kasab statement, we want him to accept it in pak court or at least appear in pak court.
pakistani courts do not come under indian constitution and therefore some cooperation is required from india to make sure that the arrested lot meet their rightful fate.

That's the point though. I'm just asking this because I'm curious.

Lets say country A and country B do not have an extradition treaty. Citizen in country A are accused by country B of a crime inside country B's territory. They provide evidence for the same. Now can courts in country A prosecute their citizen for crimes committed in country B?

And if so, why was the same procedure not followed in the IC814 case?

Or is the case against 'Lakhvi and co.' that of committing conspiracy against another nation (which they are accused of doing inside Pakistan).

the crime was comitted in india!!!!!!why the hell is the trial in pakistan in the first place?....its pakistan that must hand over people rather than asking india to hand over kasab!!!!!

What about innocents killed by so called stateless terrorists of Pakistan did they die in Pakistan ?
