I think it was a brilliant move which even the most narrow minded of Hindus appreciated. If Abhinandan had stayed back he would only have been a guest of Imran khan in Adiala jail and would have consumed a lot of tea. So at least we did not have to bear the expenses of having him as a guest. In accordance with islamic law, and this is where it gets interesting, if he is caught again fighting against Pak forces, he should be shot outright. I dont know whether this is the case under Geneva convention but I am writing about islamic teachings only.

Because we are weaker and lower than scum these days. We have no standing in the world. However Geneva convention applies to POWs not to other situations. But the answer to your query is in the first sentence.
