Pakistan on Wednesday declined India's request to allow PM Narendra Modi's plane to fly through its airspace for the upcoming US visit. India had formally requested Pakistan to allow the plane to use its airspace during the journey to New York. This decision of the neighbouring country is violative of the International Civil Aviation Organisation charter, which Pakistan is a signatory to.

Pakistan on Wednesday declined India's request to allow PM Narendra Modi's plane to fly through its airspace for the upcoming US visit. India had formally requested Pakistan to allow the plane to use its airspace during the journey to New York. This decision of the neighbouring country is violative of the International Civil Aviation Organisation charter, which Pakistan is a signatory to.

According to sources New Delhi wrote to Islamabad last week, seeking the nod for use of airspace. It is mandatory for Pakistan to respond to India’s request before September 20.

As per the provisions of the charter, unless there’s a special situation like war or other emergency conditions, singled out decisions cannot be done with regards to any individual flight. If India goes to the global body against any violation, Pakistan can be slapped with a heavy fine.

This comes less than a month after Pakistan denied permission for the use of its airspace by President Ram Nath Kovind, who was slated to go on a three-nation tour of Iceland, Switzerland and Slovenia. Pakistani government sources had said that country's Prime Minister Imran Khan had himself endorsed this decision to decline use of Pakistani airspace for Indian President's movement.
Reacting to Pakistan’s move, India had termed it as a “futile” unilateral action. In a statement, Ministry of External Affairs (MEA) spokesperson Raveesh Kumar had said, "We regret the decision of the Government of Pakistan to deny overflight clearance for the VVIP special flight which is otherwise granted routinely by any normal country. We call upon Pakistan to recognize the futility of such unilateral actions."

Prime Modi had, however, used the Pakistani airspace in August, the first time since the Balakot airstrike in February, to travel to France for a bilateral meet.

Indian Prime Minister denied overflight access by Pakistan

ISLAMABAD: India had sought permission from Pakistan to use its airspace for Indian Prime Minister Narendra Modi’s flight to the United States earlier today, ARY News reported on Wednesday.

New Delhi had requested Pakistan for the usage of its airspace for Modi’s flight to the United States (US) on September 20, which was denied by Pakistan.

Foreign Minister, Shah Mehmood Qureshi speaking on the matter in a video message said that the Indian High Commission had been apprised of Pakistan’s decision on the request.

FM Qureshi said that Pakistan denied airspace access to the Indian Prime Minister over the situation prevalent in Indian Occupied Kashmir (IoK).

FM Qureshi also said that another reason for denial is India’s persistent behavior which had been unsavory on matters pertaining to Kashmir, the region and peace.

Pakistan had refused a request made by New Dehli earlier, to use its airspace for the plane of Indian President Ram Nath Kovind, owing to New Dehli’s consistent human rights violation in occupied Kashmir.

India had requested Pakistan to fly over its airspace for the Indian president who is scheduled to visit Iceland.

Earlier in June, Indian Prime Minister Narendra Modi had refused the overflight of his aircraft from Pakistani airspace, despite receiving the permission from Islamabad.

The Hindu reported that India had forwarded the request to Pakistani officials to let Modi’s overflight to Bishkek in Kyrgyzstan during June 13-14 to attend the Shanghai Cooperation Organisation (SCO) summit.

Islamabad had approved in principle the Indian government’s request in this regard. Nevertheless, Modi opted to fly via Oman-Iran route instead of Pakistani airspace.

In May, Pakistan had also granted the request of India to let its former Minister for External Affairs Sushma Swaraj overflight to attend the SCO summit in Bishkek.
