Oz company to sue CWG organisers over unpaid bills

The controversy-marred Commonwealth Games, held in New Delhi last year, finds itself in yet another embarrassing situation with an Australian company deciding to sue event's organisers over the unpaid bills.

An Australian company, which was behind the CWG opening and closing ceremonies, has still not received the bills from the Organising Committee (OC) and hence, is all set to take a legal action against it, reported ABC.net.au.

Ric Birch, who was the mastermind behind the successful opening and closing ceremonies of the mega-event, which took place from October 3 to 14 last year, told the website that his employers have still not paid their bill.

"I supplied the services of 12 people over the course of the year leading up to the Games, which included choreographers, producers and myself as executive producer," he was quoted as saying.

"They're all production people who were intimately involved in the creation, production and direction of the opening and closing ceremonies."

He also added that when he tried to contact the organisers of the Games in relation to the unpaid bills, the calls were first ignored.

"Then finally in December I got a very short note from Lalit Bhanot who is secretary general of the organising committee," he said.

"He sent a note saying that now they wanted to claim a performance guarantee because Mr Birch's performance was not up to the mark. So I am mortified as you can imagine."

Birch is now planning to sue the OC so that they could recover their hundreds of thousands of dollars in outstanding fees.

He has also given his lawyers the names of other businesses, which may also want to take the legal action against Committee.

"There were up to 15 other companies involved with the opening ceremony and many more companies involved with the Commonwealth Games overall," he said.

"Of those about half -- the individuals, not the corporations -- (have been paid) three months late but they were finally paid.

"But none of the companies have received their payments which were due under contract by the end of October last."

Birch said that he had never faced such problems while working on other Commonwealth Games or the Olympics in Mexico or China, Barcelona or Los Angeles.

"We had an anagram which came about by the ceremonies that everyone was heartily sick of the Delhi Organising Committee so we decided that India stood for 'India -- I'll never do it again'," he said.

But it is not only the private sector that is bearing the burnt, even the Australian Commonwealth Games Association is owed more than $100,000 in travel subsidies.

The association's chief executive, Perry Crosswhite, is also in talks with the OC.

"Besides all the usual letters and calls and so forth, we're taking the matter up with our international body, which is the Commonwealth Games Federation who are very concerned about it as well," he said.

"We've also (spoken) with the Indian high commissioner to see whether she could help as well and she's trying to."

Crosswhite said the association is now running short of funds, which is required to prepare local athletes for the 2014 Commonwealth Games.

When Indian foreign minister SM Krishna, who is currently visiting Australia, was asked about it, he said that he was aware of the issue and would take up the matter when he returns home.

"As soon as I go back to India I will take it up with the minister of sports and I will certainly be the interlocutress on behalf of Australia so that the dues can be settled," he said.

Australia has nothing to worry, India has enough money to pay the Bills.

The money is probably in term deposit in Banks earning interest.

Due to the enormous legal fee, in a business world you just dont sue yours customers unless you absolutely have to.

Remote chances for the company to get its dues cleared.Reason-DHK(Di** headed Kalmaadi)and co have already pocketed the money.He and his colleagues will be arrested and tried(hopefully!)so suing them would be better!

Australians sue Delhi over unpaid Games bills

An Australian firm has threatened to sue the Delhi Commonwealth Games organising committee for non-payment of hundreds of thousands of dollars.

The company said it had not been paid for the opening and closing ceremonies, which were held on 3 and 14 October.

Indian Foreign Minister SM Krishna, who is visiting Australia, has pledged to take up the issue when he returns home.

Firms from Europe are also reportedly chasing millions of dollars in unpaid bills from Delhi.

Ric Birch - whose Sydney-based firm, Spectak, helped plan the opening and closing ceremonies - says it is owed A$350,000 ($350,000; £220,000) in unpaid bills.

Class action

He told the Australian Broadcasting Corporation that he had instructed lawyers to launch a class action against the Games organisers. And he said that his was not the only firm chasing unpaid bills from Delhi.

Firms from Britain, France and Germany are also owed millions of dollars in unpaid bills, unnamed officials have told AFP news agency.

They said that Belgian, Dutch and South-East Asian companies were also affected.

UK diplomats told AFP that a broadcasting company, SIS Live, was lobbying the British High Commission to help it collect 30% of unpaid fees it says it is owed for transmitting the Games' TV coverage.

It is believed that some companies have, over a period of several months, been lobbying the organising committee to pay up and that about 250 containers of games equipment remain stuck in Delhi.

Experts say that there are two categories of companies: those who have fulfilled their contractual obligations and will eventually be paid and those whose contractual obligations are in dispute and who have, as a result, launched legal action.

Sleaze allegations

India's foreign minister said he would deal with the matter as soon as possible after his return to India.

"It has been brought to my notice and I would go back to India and take it up with the ministry of sports," news agency Press Trust of India quoted Mr Krishna as telling a news conference in the Australian city of Melbourne.

Lalit Bhanot, secretary general of the organising committee, told AFP in Delhi on Thursday: "Last time we told [the Games accountants] to pay everything in full that is due under all agreements.

"Now we will check what is the position and what is the problem if there is one."

The Delhi Commonwealth Games was overshadowed by revelations of sleaze, incompetence and missed construction deadlines.

The budget for the event ballooned to an estimated $6bn - with the Central Vigilance Commission receiving complaints alleging that up to $1.8bn of Games money was misappropriated.

Earlier this month, India's top investigative agency questioned the organising committee chief Suresh Kalmadi. He denies any wrongdoing.

He quit a Congress party position in November, weeks after the government ordered a probe into the alleged scam.

Two other senior officials from the organising committee were arrested on charges of forgery and cheating over the awarding of contracts before the event.

Last month, Mr Kalmadi's homes in the capital, Delhi, and in the western town of Pune, were raided by investigators.

Investigators also raided about a dozen locations, including the homes of organising committee secretary general, and the director general VK Verma.

It has nothing to do with Indian companies. It has to do with the CWG Organizing Committee and other Govt people involved in one of the nation's biggest theft of wealth.

The australian money which is unpaid is not even a tiny fraction of the total money tucked away in swiss banks.

If a state own enterprise behave in this way then how the world can come to trust private own companies of india?

In which court they will sue???if indian courts then they are sure struck up for next 20 yrs.
