Key ministries may go to PPP

LAHORE, March 19: After deciding in principle the number of ministries the PPP, PML-N, the Awami National Party and JUI-F will get in the cabinet, the coalition partners have started discussing the allocation of portfolios.

According to sources, the PPP may get the ministries of finance, defence, interior, law, information, education and Kashmir affairs. PPP’s Syed Naveed Qamar is likely to be the finance minister.

The ministries of foreign affairs, commerce and health are likely to go to the PML-N.

JUI-F sources said that the chairmanship of the Kashmir committee and the Council of Islamic Ideology would be given to the party of Maulana Fazlur Rehman.

The ANP has said that it is with the new coalition more to advance its political agenda than to get ministries. However, the sources said the ANP would be given representation in the cabinet according to its numerical strength in the assembly.

PA session to be convened soon, says Governor

LAHORE (APP) - Governor Punjab Lt Gen (r) Khalid Maqbool has said that Punjab Assembly’s inaugural session would be convened soon.
He stated this while talking to reporters after addressing provincial Seerat conference on “Inter faith and cultural harmony in the light of Seerat of Hazrat Muhammad (PBUH)” at Al-Hamra Hall here on Thursday.
The Governor said, “Prime Minister will be elected within a few days and after that provincial assembly’s inaugural session will be convened.”
To a question, he said that Pakistan has the capability to fight terrorism and it is, of course, doing well in this regard.
Earlier addressing the conference, the Governor said that Eid Miladun Nabi is being celebrated with religious fervour all over the Muslim countries, especially Pakistan.
He observed that best way of living a life is to follow the teachings of Islam and Uswa-e-Hasna, which always advocated for ensuring all rights to minorities and respect for all religions.
The Muslims, who have firm belief in Tauheed and Risalat, never undermine any other religion or faith, he added.
The Governor also stressed upon the nation to acquire technological and scientific knowledge that is indispensable to excel in this fast changing world. At the end, the Governor also presented appreciation shields to the authors of various seerat books.
In their speeches, Ulema and Mashaikh highlighted various aspects of Uswa-e-Hasna and urged the Muslim Ummah to follow the teachings of the Holy Prophet Hazrat Muhammad (PBUH) in letter and spirit.

Candidates on tenterhooks as NA convened to elect PM

ISLAMABAD, March 20: President Pervez Musharraf on Thursday called a special session of the new National Assembly for Monday to let his political opponents elect their first prime minister after eight-and-a-half years as a parliamentary momentum seemed to leave his own office at their mercy.

An apparently swift action on a proposal from caretaker Prime Minister Mohammedmian Soomro came only a day after the National Assembly elected its first woman speaker and her deputy by more than two-thirds majorities, which showed the anti-Musharraf camp could muster enough numbers in a joint session of the two houses of parliament to impeach the president if they so wanted.

The announcement came also when the country waited with bated breath for the majority coalition of the winners of Feb 18 election to name their candidate for prime minister to end a bitter controversy that has robbed a historic transition of some of its lustre.

The candidate, under the coalition agreement, must be from the Pakistan People’s Party (PPP), which has added a high drama to a prolonged suspense by calling its boy chairman Bilawal Bhutto Zardari from a studies break in Britain to name the person for the office that his mother, Benazir Bhutto, would have taken without question for a historic third term if she had not been assassinated in a gun-and-bomb attack in Rawalpindi on Dec 27 soon after she addressed a campaign rally.

The selection of the candidate, to be made by the 19-year-old Bilawal’s father and PPP co-chairman Asif Ali Zardari, has led to an unprecedented controversy in the party after one of its senior-most figures, Makhdoom Amin Fahim, who is also the president of its electoral arm PPP Parliamentarians, found his candidacy being blocked by a mysterious propaganda campaign against him and the talk of an alternative being sought from the most populous Punjab province rather than from the hopeful’s Sindh.

The National Assembly secretariat said in a statement the session for what the Constitution calls “ascertainment of the member who commands the confidence of majority of the members of the assembly” would begin at 4pm on Monday, while it would remain open on Sunday to receive nominations of candidates by 2pm and their scrutiny by the Speaker at 3pm.

The election will be held through what is called “division” in parliamentary parlance, in which members go to different lobbies to record their votes for candidates in accordance with the direction of their respective parties as required by an anti-defection clause of the Political Parties Act that forbids floor-crossing.

NO MANIPULATION THIS TIME: It will be the fourth prime ministerial election in a little more than five years and the first time President Musharraf will find himself unable to stop an opponent from taking that office since he seized power in an Oct 12, 1999 coup that toppled then prime minister Nawaz Sharif.

After the previous October 2002 election, the president kept the anti-defection law suspended to inspire defections mainly from the PPP to help his hand-picked Mir Zafarullah Khan Jamali of the formerly ruling Pakistan Muslim League (PML) get elected prime minister in November by only a one-vote majority for a tenure that lasted only 20 months.

Mr Jamali’s two successors to complete the remainder of his five-year term --- PML president Chaudhry Shujaat Hussain for a transitional two months and Shaukat Aziz for more than three years --- were elected with comfortable majorities.

Now, whoever is nominated as the PPP candidate, possibly on Saturday or Sunday, will face only a token contest from Mr Farooq Sattar of the Muttahida Qaumi Movement as the joint candidate of the new PML-led opposition alliance.

Wednesday’s election of Dr Fehmida Mirza as the first woman to become the National Assembly speaker and Deputy Speaker Faisal Karim Kundi, both of the PPP, by more than two-thirds majorities of the 342-seat house --- securing 249-70 and 246-68 votes respectively against the opposition rivals --- served as a stark warning to a strong but an isolated president whom his opponents want to be out of their way to restore full parliamentary democracy.

The vote, which at least two of its members missed, showed the coalition could impeach the president on the oft-repeated charge of violating the Constitution as well as “gross misconduct” as it would have the required two-thirds majority in a joint sitting of the 342-seat National Assembly and 100-seat Senate with the help of a six-member anti-Musharraf “like-minded” group formed in the Senate last month and independents.

The Senate is presently left with 96 members because three members have opted to take National Assembly seats they won on Feb 18 and the death of one PML member from Balochistan.

While the coalition can hope to bag all these four seats to be filled through by-elections, the present Senate strength leaves the pro-Musharraf camp with 50 members (minus the six rebels) and his opponents with 46, whose addition to its 251 supporters in the National Assembly takes the total to 297, which will be one vote more than the 296-vote two-thirds majority of the total 443 members of both houses needed for the passage of an impeachment resolution.

But the new would-be ruling coalition, which had dismissed an impeachment move against the president in the recent past on the ground of not having the required numbers, does not seem to be seeking such a course immediately in order to allow itself to settle down in power.

It still remains short of a two-thirds majority in the Senate to be able to pass constitutional amendments passed by a two-thirds majority in each house, such as one to clip the president of his controversial powers to sack a prime minister, dissolve the National Assembly and appoint provincial governors and armed forces chiefs at his discretion.

PAs sessions summoned

LAHORE/KARACHI/PESHAWAR/QUETTA - The sessions of four provincial assemblies have been summoned on different dates next month.
The Secretary Law and Parliamentary Affairs on behalf of the NWFP government has announced summoning of the Provincial Assembly on April 2.
The first-ever session of the newly elected NWFP Assembly will be held at the Assembly Building on Khyber Road Peshawar. The NWFP Governor has already nominated senior most politician and parliamentarian Arbab Mohammad Ayub Jan for chairing the inaugural session as well as conducting the election of the Speaker.
In the inaugural session, the newly elected MPAs would take oath of their offices. Arbab Ayub Jan would administer oath to the newly elected MPAs. Similarly, Arbab Ayub Jan will also supervise the election process for the office of the Speaker as well.
The ruling alliance comprising Awami National Party, Pakistan Peoples Party and Pakistan Muslim League (N) has already nominated Kiramat Ullah Khan Chagharmatti for the office of the Speaker and Khushdil Khan Advocate for the office of the Deputy Speaker. Both of them have visited the NWFP Assembly to apprise themselves of the arrangements. Before the nomination of Speaker and Deputy Speaker, Arbab Ayub Jan also visited the NWFP Assembly building a couple of days back and chaired high-level meetings.
Schedule for the session of the NWFP Assembly regarding elections of Speaker, Deputy Speaker and Leader of the House would be announced later.
Moreover, foolproof security measures will be taken for the inaugural session of NWFP assembly, this was decided in a meeting chaired by nominated for the slot of Speaker Kiramatullah Khan Chagharmati here on Saturday.
A number of decisions were made at the meeting. Other nominated senior ministers Rahim Dad Khan and Bashir Bilour, nominated Deputy Speaker Khushdal Khan, Tehmash Khan, CCP Tanvirul Haq Sipra and security officials also attended the meeting.
Speaking on the occasion, nominated for the Speaker Kiramatullah Chagharmati said that foolproof security measures would be taken for the inaugural session.
It was also decided no one would be allowed to bring in any arm the assembly building and all the members have been directed in this regard.
Meanwhile, the maiden session of Balochistan Assembly has been summoned on April 7 next in which all the newly-elected members would take oath.
The announcement was made by Governor Nawab Zulfiqar Ali Magsi while talking to a group of newsmen here at his residence after meeting PPP’s nominee for Chief Ministership Nawab Aslam Raisani.
The Governor said that the Assembly session was summoned on April 7 and expressed the hope that there would be a strong and stable government in the province.
The meeting between Governor and Nawab Raisani continued for more than one hour. The sources close to PPP say that the matter relating to government formation was discussed particularly the cabinet.
Agencies add: Sindh Governor Dr Ishratul Ibad Khan has summoned Sindh Assembly session on April 5 at 1100 hours.
During the inaugural session, the newly-elected members will take oath, while the Speaker will be elected the next day, April 6.
The meeting would be presided by Speaker Syed Muzaffar Hussain Shah, while 164 out of total of 168 members will take oath.
Currently PPP enjoys support of 90 members, while MQM enjoys support of 51 members.
Meanwhile, Punjab Governor Lt-Gen (Retd) Khalid Maqbool has convened the session of Punjab Assembly on April 9.
It was stated by a spokesman of the Governor House here on Saturday evening.

Faisal Saleh may be nominated NA parliamentary leader

ISLAMABAD: Makhdoom Faisal Saleh Hayat is likely to be made the parliamentary leader of the Pakistan Muslim League (Q) at the National Assembly.

According to sources, the leadership of the PML (Q) wants to keep the positions of the opposition leader and the parliamentary leader separately.

Makhdoom Faisal Saleh Hayat is being considered a strong candidate for the position of the parliamentary leader.

However, the nomination of the parliamentary leader of the party will be announced after the announcement of the nomination of Chaudhry Pervez Elahi as the opposition leader.

On the other hand, Faisal Saleh Hayat told Geo News that he has no information of his nomination as the party’s parliamentary leader.

PML-Q to file reference against turncoats

LAHORE: The Pakistan Muslim League-Q will file references against the dissidents, said the Leader of the Opposition in the National Assembly Chaudhry Pervaiz Elahi.

Addressing a press conference here on Saturday, Pervaiz Elahi said the Members National Assembly (MNAs) elected on the ticket of the Q-League could not leave the party, otherwise references under Article 63-A, would be filed against them.

He advised the MNAs who had made a forward bloc to come back to the folds of the party to avoid facing defection references.

The former chief minister of the Punjab offered to the Pakistan People’s Party and the Pakistan Muslim League-N that he could be a mediator between the upcoming government and the President House for the sake of protecting the system.

He told a questioner that he had no contact with Makhdoom Amin Fahim.

Chaudhry Pervaiz Elahi, who is also the President of the PML-Q Punjab, announced on the occasion the nomination of Chaudhry Zaheeruddin as the PML-Q Leader of the Opposition in the Punjab Assembly and Ahmad Yar Hiraj as the Deputy Opposition Leader.

He also announced to form a committee to run political and parliamentary affairs in the Punjab Assembly. It comprises Raja Basharat, Aamir Cheema and Moonis Elahi.

The mechanics and numbers of an impeachment vote

ISLAMABAD: The Pakistan People’s Party (PPP) and its allies are in a comfortable position to impeach President Pervez Musharraf in less than two weeks with a combined two-thirds vote in a joint sitting of Parliament.

"A collective two-thirds vote is required from a joint sitting of the National Assembly and Senate irrespective of party strength in one of the Houses," parliamentary and constitutional experts confirmed to The News.

Attorney General Justice (retd) Malik Muhammad Qayyum and PML-Q Senator SM Zafar confirmed in categorical terms that there was no ambiguity in the Constitution about the impeachment process and a collective two-thirds majority vote for its success removing the president.

"You are absolutely right that the two thirds on impeachment motion means a combined vote of total strength of both the Houses," well-known jurist SM Zafar said. Malik Qayyum also responded in a similar manner and said there was no need to ensure the two-thirds majority in both Houses separately but a combined vote was needed. The Constitution clearly provides that the process of a constitutional amendment and impeachment is absolutely different from each other. "An amendment requires two-thirds approval from both Houses separately, whereas the impeachment resolution needs the same vote from their joint sitting," the experts say. A total number of 295 votes in favour of impeachment process can pack up the president after a due course of procedure spanning not less than one week but not beyond 14 days once one-half of either House tables an impeachment motion. The impeachment motion needs signature of at least 50 senators to table it before the Upper House of Parliament or 171 MNAs to submit before Lower House of Parliament and the partners in government-in-waiting fulfil the requirement.

As far as the number game is concerned, the full strength of both National Assembly and Senate stands at 442 and 295 makes a two-thirds majority for a successful impeachment motion. The sub-section of Article 47 (Removal or Impeachment of President) of Constitution makes the things crystal clear. "If, after consideration of the result of the investigation, if any, a resolution is passed at the joint sitting by the votes of not less than two-thirds of the total membership of [Majlis-e-Shoora (Parliament)] declaring that the President is unfit to hold the office due to incapacity or is guilty of violating the Constitution or of gross misconduct, the President shall cease to hold office immediately on the passing of the resolution." The case for bringing a constitutional amendment for enactment is to get at least 228 votes from the National Assembly and 67 from the Senate otherwise there is no methodology within the constitutional ambit. Going by 249 votes the PPP's Speaker Dr Fehmida Mirza obtained on March 19, there is a requirement of 46 more votes whether from the National Assembly or the Senate. The PPP, PML-N and allies constitute a numerical strength of 42 in the Senate and they need six votes to table an impeachment motion. But if the motion is moved in the NA, only four more seats would be needed to make up a two-thirds majority in a joint sitting.

Senator Gulzar, along with his two senator sons, and four Fata senators, are said to be ready to be part of new government, and will be enough to meet the requirement of 295 votes for impeachment without cooperation on the part of the Q-League or its allies, though many individuals are ready to switch over their loyalties.

The Muttahida Qaumi Movement (MQM), that has withdrawn its candidacy in favour of PPP nominee for the office of the prime minister, may add the decisive number if it supports the impeachment. It may also make the difference for constitutional amendments though a large number of Q-League senators are also ready to switch over their loyalties.

Article 47 provides: "Notwithstanding anything contained in the Constitution, the President may, in accordance with the provisions of this Article, be removed from office on the ground of physical or mental incapacity or impeached on a charge of violating the Constitution or gross misconduct." About the procedure, Sub-section 2 of Article 47 provides: "Not less than one-half of the total membership of either House may give to the Speaker of the National Assembly or, as the case may be, the Chairman written notice of its intention to move a resolution for the removal of, or, as the case may be, to impeach, the President; and such notice shall set out the particulars of his incapacity or of the charge against him.] "If a notice under clause (2) is received by the Chairman, he shall transmit it forthwith to the Speaker. The Speaker shall, within three days of the receipt of a notice under clause (2) or clause (3), cause a copy of the notice to be transmitted to the President," the sub-section 3 and 4 said. As the joint session is supposed to investigate the president, who would have the right to appear or be represented, the sub-section 5 says that "the Speaker shall summon the two Houses to meet in a joint sitting not earlier than seven days and not later than fourteen days after the receipt of the notice by him."

PPP’s candidate will secure over 275 votes, says Zardari

LAHORE: Pakistan People’s Party Co-chairman Asif Ali Zardari said on Saturday that while the PPP’s candidate for speaker had secured 249 votes, its prime ministerial candidate would win more than 275 votes in the National Assembly election. Talking to BBC, Zardari said the Muttahida Quami Movement had also withdrawn its candidate for the office of prime minister, and was now backing the PPP candidate.

LAHORE: The new parliament will work as an institution that has full authority and that works according to the wishes and aspirations of the people of the country, Pakistan Muslim League-Nawaz (PML-N) chief Nawaz Sharif said on Saturday. Talking to the media at the residence of Pakistan Tehreek-e-Insaaf Chairman Imran Khan, he said, “The PML-N and its coalition partners have a two-thirds majority in parliament, which is good for the future of democracy in the country.” He said there was complete harmony among the would-be ruling coalition partners on the formation of government, adding, “We will come up to the expectations of the masses, who have given us their mandate, and will fully implement the party’s manifesto.” Review: Nawaz said that different policies, including those pertaining to the country’s role in the war against terror, would be reviewed. On the coalition’s candidate for premiership, he said it was the Pakistan People’s Party (PPP)’s prerogative to nominate a candidate for premiership, adding that the PML-N would extend full support to PPP’s decision. He said that he still had reservations about the Muttahida Qaumi Movement (MQM), despite their move to support the PPP-backed premiership candidate. Imran Khan told the media that the problems facing the country could be resolved by taking wise decisions based on political wisdom. He said there was no difference between the manifestoes of the PML-N and the All Parties Democratic Movement. Earlier, Nawaz condoled with Khan over the demise of his (Khan’s) father and prayed to God to allow the departed soul to rest in eternal peace.

'Q' MNAs boycott Fahmida's dinner

ISLAMABAD (Agencies)- Speaker National Assembly Dr Fehmida Mirza hosted a dinner in honour of the newly elected members of the National Assembly in the Parliament House on Sunday.
Besides nominated Prime Minister from Pakistan Peoples Party, Syed Yousaf Raza Gillani and Deputy Speaker National Assembly Faisal Karim Kundi, a large number of leaders of parliamentary parties and MNAs attended the dinner including Makhdoom Javed Hashmi, Asfand Yar Wali, Ch Nisar Ali Khan, Ehsan Iqbal and Dr Farooq Sattar.
While talking to media persons the Speaker said that the nation was expecting a lot from the newly elected parliament and the parliamentarians will have to resolve peoples problems.
She said that election of a woman as the speaker was historic and unprecedented in the Islamic world. It was a good omen for the empowerment of women and would help in building soft image of Pakistan abroad.
She said that as a Speaker she would strive to run the House with great impartiality and neutrality and would establish a good precedence in this regard.
She said that impartiality and neutrality should be the hallmark of a Speaker in any parliament.
Dr Fehmida Mirza said, “I wish a strong and truly sovereign parliament in the country and it could be achieved through consensus and understanding among all members of the House irrespective of their party affiliation.”
She expressed hope that newly elected parliament will succeed in delivering results and come up to expectations of masses.
Earlier, Pakistan Muslim League-Q (PML-Q) decided to boycott the dinner. Briefing media on the decision, PML-Q MNA Sheikh Waqas Akram said the PML Parliamentary Party meeting had unanimously decided to boycott the dinner in protest to the remarks made by PPP leader Syed Khurshid Ahmad Shah about PML-Q.
“The remarks uttered by Khurshid Shah are not only derogatory but also
uncalled for as no one has the right to humiliate the elected legislators or a political party. This is also humiliation of the people who have elected us,” said Akram.
Nominated leader of the opposition Ch Pervaiz Elahi, on the occasion, said the derogatory remarks were unnecessary and humiliating.
“These remarks are absolute humiliation of the mandate of the people as the PML has bagged more votes than the PML-N while the total votes of former ruling coalition are more than that of the PPP”.
PML MNA and eminent poet Bushra Rahman told APP that all legislators of the party had arrived the capital to attend the dinner but the contemptuous remarks by PPP MNA had enraged the party MNAs and it was unanimous decision of the party to stay away from the dinner.
Reportedly, PPP leader Khurshid Ahmad Shah was asked by the media whether the PPP would also seek PML-Q cooperation as they had won cooperation of the MQM.
Shah in response had said there was no need to consult the PML-Q as 'consulting the PML-Q would be ‘ignominious’ to the mandate given to the PPP by its voters'.
Earlier, announcing name of Chaudhry Pervaiz Elahi to contest the election for the post of the Prime Minister, President PML-Q Chaudhry Shujaat Hussain has said that one-party rule in the country is against the democratic norms.
The Parliament has elected President Pervez Musharraf for five years and he would not tender resignation on demand of former Prime Minister Nawaz Sharif, he said this while talking to media men after meeting of Parliamentary Party of PML-Q and other Opposition parties here at his residence on Sunday.
MQM, he said, is free to form alliance with PPP. “We have no objection in this respect. PML-Q, PPP (Sherpao) and Muslim League Functional have nominated Pervaiz Elahi as joint candidate for the slot of Premiership.”
“We have submitted nomination of Chaudhry Pervaiz for slot of Premiership just to inform PPP and its coalition parties that strong opposition is present in the country,” Shujaat said.
