Musharraf's Treason Case

He did commit a crime, subverting the constitution is a crime in any event. What important to note is that his act/crime of 99 was given indemnity by the parliament in 2002 (LFO), let me add MMA played a big role in indemnification. The gist, he committed a crime that later on got indemnity so he cannot be indicted for his indemnified crime of 99. However his act of imposition of emergency in 2007 is still an uncovered crime & he can be tried for this, in fact SC had already issued a ruling, declaring it unconstitutional.

Thank you for that clarification. Like I said, I am not a lawyer, nor do I pretend to be one. The basic point I do understand is that Gen Musharraf has much to answer for.
 
ISLAMABAD: The Supreme Court on Tuesday adjourned hearing over the treason case against former military ruler Pervez Musharraf until April 15, DawnNews reported.

A two-judge bench of the apex court, comprising Justice Jawwad S. Khawaja and Justice Khilji Arif Hussain heard the case against the retired general seeking his trial under Article 6 of the Constitution for imposing the state of emergency in 2007.

The court rejected the request seeking the arrest of the former military ruler.

Musharraf did not personally appear in court and was represented by Advocate Ahmed Raza Kasuri.

Kasuri sought from the court six weeks’ time from Musharraf to submit his response and said that Musharraf would reply to every point raised against him adding that certain hidden names would be revealed in the response.

The bench replied that it did not mind the pandora box to be opened and granted six days’ time to submit his response, adjourning the hearing until April 15.

No one representing the federal government was present during the hearing.

Talking to media personnel prior to the hearing, Attorney General of Pakistan (AG) Irfan Qadir said that he would perform his duties according to the constitution during the case.

Musharraf’s Facebook account quoted him as saying that: “I have directed my panel of eminent lawyers to forcefully represent me in the Supreme Court of Pakistan tomorrow. These cases do not frighten me and I will fight all the cases in the court of law!”

Earlier on Monday, the bench had directed Musharraf to appear before it today (on Tuesday) to face charges of high treason and also barred him from leaving the country.
 
Treason case: SC rejects plea to arrest Musharraf, seeks reply by April 15

The Supreme Court of Pakistan on Tuesday rejected a plea to arrest former president General (retd) Pervez Musharraf and ordered his counsel to submit his reply by April 15 in the ongoing treason case against the former military ruler.
Musharraf’s counsel Barrister Ahmed Raza Kasuri sought six-week time for submission of his reply but the court did not agree. The court also rejected one of the petitioners’ plea to arrest Musharraf.
The Supreme Court has been hearing five identical petitions against Musharraf seeking his trial under article 6 of the Constitution for imposing the state of emergency in 2007.
This is the first time in the country’s history that the Supreme Court has summoned a former military ruler over allegations of misconduct.
A two-member bench, comprising Justice Jawwad S. Khawaja and Justice Khilji Arif Hussain, is hearing the petitions.
During the hearing, Kasuri said that Musharraf has returned to take the country of present crisis, adding that Interpol had also rejected demands to issue warrants against Musharraf.
Kasuri said this is a unique case in which very crucial constitutional issues will come under discussion. It was for this reason; he sought six-week time to submit the reply in this case.
But the court did not agree with Kasuri’s argument.
On Monday, the apex court summoned the former president to appear before it today and face charges of high treason. The court also barred him from leaving the country.
Musharraf said he would not appear personally in the Supreme Court on Tuesday due to security issue.

Musharraf was destined for the worst possible treatment--yes, worse than even death--by being thoroughly rejected in the upcoming elections and yet he is being made relevant--even a martyr. Shame on the small minded and small hearted judges and politicians.

I wish someone will try these God damned PCO judges from the existing judiciary, all the way up to Justice Munir on the 1950's for their role in validating and supporting dictatorship.

Oh, if Musharraf is jailed or hanged by judicial way then it will NOT go down well in Sindh--especially in urban Sindh. How come mostly leaders from Sindh are being killed, jailed, humiliated? How come Nawaz Sharif--in power directly or indirectly since early 1980's--is strutting around as if he is a 'doodh ka dhoola'. I certainly don't believe that Nawaz has done no wrong in last decades. Double damn standard and recipe for a disaster to come.

As if the hanging of ZAB was not enough to alienate Sindhis, as if the death of Akbar Bugti was not enough to alienate Baluchis now the stupid partial judges and politicians want to take down Musharraf to alienate the Mohajirs?!

Start the accountability from 1977! Zia did enough for PPP up to 1977. Do it for all or start fresh. And leave the irrelevant Musharraf alone. He is not worth being hounded.
