63-A does not say anything about the votes of a defected member being counted or not. This is what the SC interpreted, that the votes cannot be counted. This is what the SC said from it's own understanding in the original reference.
But right now, the case isn't this, keh vote discount hongay ya nhn. The case right now is whether the party head or parliamentary party is binding.
If you go against the direction, votes will be discounted, that part is set in stone. But on who's direction? That is the question. The Dy Speaker says it is the political party, while the law and previous SC judgement and PTI says it's parliamentary party.
So there's two steps, the direction comes, and if a member defects then he gets disqualified.
N wants to skip step 1, and go direct to step 2, keh defected members kay vote count nhn karnay, and they take support of the SC judgement, that is not in dispute. Magr how can you go directly to step 2 without taking step 1?
