LAHORE: A judicial magistrate in Cantonment Courts has sentenced a man to three-month jail and imposed a fine of Rs5,000 on him for contracting second marriage without mandatory permission of first wife.

Rabia Younas filed a complaint through a counsel pleading that her husband Shoaib Zahid contracted second marriage without obtaining her consent required under section 6 of Muslim Family Law Ordinance 1961. The counsel asked the court to punish the man under the law for committing a crime. He also produced witnesses and documentary evidence to prove the offence of the respondent.

The magistrate, Kashif Abbas, observed that verbal and documentary evidence presented by the complainant established the offence the respondent committed. Therefore, the magistrate handed down three-month imprisonment to the respondent and Rs5,000 fine.

Sahi. Its law. You write it on the nikahnama as well where the clause is whether the man is married or not. You need permission for second marriage otherwise the very registration of a false info containing nikahnama is an offence. Surely somebody would have told him the law. 3 months jail mai law seekh. :p

Imprisonment under 6 month is bailable. :D I hope court will not spoil his second honeymoon. :tup:

According to the constitution of Pakistan, no law can be promulgated which is in explicit violation of Quran & Sunnah, and as per Islamic law, the man does not need permission of current wife (wives) for marriage. He can marry up to four without any fear.

Time to look for loopholes in existing law :D

According to the constitution of Pakistan, no law can be promulgated which is in explicit violation of Quran & Sunnah, and as per Islamic law, the man does not need permission of current wife (wives) for marriage. He can marry up to four without any fear.
It has been law since Ayub,s time only difference is judicial ignorance of the masses

Actually as per Quran and Sunnah permission required from first wife but if someone don't take permission and marry second time, his second nikkah is lawful.

No, permission is not required but should inform her. It is good though if it is done through mutual agreement and both reach an agreement like how to share time, money, home etc

Mujhay pata hy tum ghar mein akeli hoti ho isliye tumhari dono doston ko bhi solan bana kar la raha hoan heim kaisa idea hy :D

Or try what my neighbour did. He begged with his second wife for permission and she granted him only in the condition that she would live in another house and there would be no child. The first one got fulfilled. The second did not. :p

Mazay ki baat batao. Permission itna bara issue nahi hai jitni registration aur grandchildren ko inheritance Deena hai. In do pay sahi taptay hain. :p :p
