Limitation period for Appeal in Criminal Cases:-

1. In capital punishment, 7 days.

2. From Magistrate to Sessions Court, 30 days.

3. From Sessions Court to High Court, 60 days.

4. From High Court to Supreme Court, 30 days.

5. From High Court to Supreme Court in special Leave to Appeal, 30 days.

6. From Magistrate to High Court in acquittal in Challan Case is 30 days and in Complaint Case 60 days.

7. From Sessions Court to High Court in acquittal in Challan Case is 30 days and in Complaint Case 60 days.

8. From High Court when case decide by it in its original jurisdiction and to Division Bench than 20 days in acquittal or conviction as the case may.

کیا عدالت میں کاغذات کی فوٹی کاپی بھی بطور ثبوت پیش کی جاسکتی ہیں ..جانیے اس مضمون میں


قانون شہادت کے مطابق بطور ثبوت صرف اصل دستاویزات یا کاغذات عدالت میں جمع کرائی جاسکتی ہی

اگر کاغذات کی فوٹو کاپی جمع کرائی جاے گی تو انکی بطور ثبوت کوئی اہمیت نہ ہوگی مزید اعلی عدلیہ نے بھی مندرجہ ذیل عدالتی نظائر میں قرار دیا ہے کہ فوٹو کاپی کی بطور شہادت کوئی اہمیت نہ ہے

تاہم ایسی فوٹو کاپی جس کے اصل ہونے کو دونوں فریق مانتے ہوں تو ایسی فوٹو کاپی کو بطور ثبوت جمع کرایے جاسکتے ہیں مثلاً اگر کسی ملازم کو ادارہ نوکری سے نکالتا ہے تو برخاستگی کا حکم نامہ کی کاپی کو ادارہ اور ملازم دونوں مانتے ہیں تو ایسی فوٹی کاپی جمع کرائی جاسکتی ہے

مگر سول مقدمات میں کس بھی دستاویز یا کاغذات کی فوٹو کاپی جمع نہیں کرائی جاسکتی اسی طرح فیملی مقدمات میں کاغذات کی فوٹو کاپی جمع نہیں کرائی جاسکتی

کریمنل یعنی فوجداری مقدمات میں بھی جمع نہیں کرائی جاسکتی صرف سروس کےمقدمات میں فوٹو کاپیاں عدالت میں جمع ہوسکتی ہیں

Conclusion:To Conclude it can be said that photocopy of documents can not be exibited as a evidence in court and court can not be relied upon photo copies of document.

We inherited our laws from Britishers & implemented it with little amendment. For example Pakistan Penal Code originated from Indian Penal Code prepared by Britishers. Instead of improving our Judicial system & transforming this country into a true welfare state, a role model for entire world, unfortunately our society closed all doors of constructive debate. We can improve ourself as a nation by improving our Judicial system.

I think this has been echo-ing but no one moves an inch towards it!

We inherited our laws from Britishers & implemented it with little amendment. For example Pakistan Penal Code originated from Indian Penal Code prepared by Britishers. Instead of improving our Judicial system & transforming this country into a true welfare state, a role model for entire world, unfortunately our society closed all doors of constructive debate. We can improve ourself as a nation by improving our Judicial system.

That is exactly what needs to be done but the problem is you need 2/3 majority in the upper and lower legislative chambers of the Parliament to get things done the way they stay done.
