No its not specially when he has two sons who can take care of this in his absence. The most the courts should do is to let him and Mariyum to participate in her Janaza once she is in Pakistan. But to allow them to leave does not make sense nor would a similar treatment be handed over to an ordinary Pakistani facing similar situation.
