Local Bodies Services:

The breadth of the Department’s mandate, and the need to address municipal service delivery issues that are both complex and changing, requires that we continue to develop as a responsive and agile organisation. In line with the public service modernisation principles, the Department has been pursuing an extensive programme of modernisation and change. This has included a range of core public service delivery mechanisms, institutional development of local government institutions, human resource capacity development and enablement of e-governance initiatives to continue providing improved services to the citizens of Khyber Pakhtunkhwa. This ongoing pursuit of the modernisation programme will be key to ensuring that we continue to develop as a flexible and responsive organisation, working with a wide range of partners and stakeholders in delivering on our mandate.

In result of the enactment of the Khyber Pakhtunkhwa Local Government Act 2013, a three-tier local government system has come into presence.



District Council
Every district of the province will have a district council constituted by general seats, seats reserved for women, peasants/workers, youth and non-Muslims as prescribed under the Khyber Pakhtunkhwa Local Government Act 2013. A summary of the key roles and functions of a district council entails:

  • Approving short and long term development plans and annual budgetary proposals of district government
  • Electing Standing Committee of the district council for each office of district government to oversee administrative matters and service delivery obligations
  • Reporting on efficiency, responsiveness, quality and performance of service delivery for progress review
  • Examining tax proposals, budget plans, re-appropriations and supplementary grants by instituting a Finance Committee of the district council
  • Scrutinise accounts showing appropriations of funds granted by the district council through District Accounts Committee
  • Considering matters regarding standard operating procedures to ensure smooth implementation by electing a Committee on Conduct of Business
  • Constituting joint committees of village and neighbourhood councils for overseeing working of district government and municipal administration offices
  • Making recommendations for enhancement of care for disabled, disadvantaged and marginalised segments
  • Reviewing reports presented by the Nazim District Council and consider recommendations of District Accounts Committee
  • Approving master, zoning and land use plans, including classification and reclassification of land, environment control, urban design, urban renewal and ecological balances
  • Evaluating implementation of rules and bye-laws governing housing, markets, zoning, environment, roads, traffic, tax, infrastructure and public utilities
  • Sanctioning proposals for public transport and mass transit systems, construction of express ways, flyovers, bridges, roads, under passes and inter-town streets
  • Reviewing development of integrated system of water reservoirs, water sources, treatment plants, liquid and solid waste disposal, sanitation and other municipal services
Tehsil Municipal Administration
Every tehsil will have a tehsil municipal administration consisting of the tehsil council, tehsil municipal officer, municipal officers and other officials of the local council service. The Executive Authority of tehsil municipal administration shall vest in the Nazim Tehsil Council who is responsible to ensure that the business of tehsil municipal administration is carried out in accordance with the Khyber Pakhtunkhwa Local Government Act 2013. A brief of the key roles and functions of a tehsil municipal administration includes:

  • Monitoring and supervising the performance of government offices located in the tehsil and hold them accountable by reporting to the district government
  • Preparing spatial plans for the tehsil including plans for land use and disseminate these plans for public enquiry
  • Executing and managing development plans for improvement of municipal and infrastructure services
  • Enforcing laws, rules and bye-laws to ensure efficient and quality delivery of municipal services (anti-encroachment drives, affixing of sign-boards, etc)
  • Exercising control over land development by public and private sectors for agriculture, industry, commerce, residence, recreation, entertainment, transport, etc
  • Maintaining data base and information system on services in the tehsil and provide public access to it on nominal charges
  • Collecting taxes, fines and penalties provided under the Khyber Pakhtunkhwa Local Government Act 2013
  • Organising sports events, cultural fairs, recreational carnivals, leisure activities, cattle markets
  • Coordinating and supporting municipal functions amongst village and neighbourhood councils
  • Regulating markets, issuing licenses, granting permissions as well as imposing penalties against violations
  • Developing and managing schemes, including site development, in collaboration with district government
  • Formulating strategies for infrastructure development, improvement in delivery of services and implementation of laws
  • Preparing and presenting reports on the performance of municipal administration in tehsil council at least twice a year
  • Calling for quarterly reports from tehsil based offices of government, presenting them to tehsil council and forwarding them to district government
Village and Neighbourhood Council
Every village council and neighbourhood council shall comprise of ten to fifteen following members:

  1. Five to ten members, determined on the basis of population, elected to general seats
  2. Two members elected to seats reserved for women
  3. One member elected to seat reserved for peasants and workers
  4. One member elected to seat reserved for youth
  5. One member elected to seat reserved for non-Muslims
Candidates securing highest and second highest number of votes in the election to the general seats of the village council or the neighbourhood council shall respectively be elected as the Nazim and Naib Nazim of the village council or the neighbourhood council.

The key functions of village council and neighbourhood council involve:

  • Monitoring and supervising the performance of functionaries of all government offices located in the area of the respective village council or neighbourhood council, including education, health, public health engineering, agriculture, livestock, police and revenue
  • Providing effective forum for out-of-court amicable settlement of disputes by constituting panels of members as conciliators
  • Registering births, deaths and marriages within the jurisdiction of the respective village council and neighbourhood council
  • Improving water supply sources, maintaining water supply distribution system and taking measures to prevent contamination of water
  • Maintaining village level infrastructure, including footpaths, tracks, streets and abating nuisances and encroachments in public ways, public streets and public places
  • Maintaining and improving collective property including community playgrounds, communal graveyards, funeral places, public open spaces and community centers
  • Identifying development needs of the area for use by municipal administration and district government in prioritising development plans
  • Planning and implementing arrangements for sanitation, cleanliness, drainage and sewerage system
  • Mobilising community for maintaining streets, culverts, bridges and buildings
  • Promoting plantation of trees, landscaping and beautification of public places
  • Regulating grazing areas, establishing cattle ponds and providing protection against stray animals
  • Reviewing and approving annual budget presented by the respective Nazim Village Council or Neighbourhood Council
  • Facilitating the formation of cooperatives for improving economic returns and reduction of poverty
  • Electing an Accounts Committee and reviewing its recommendations on the annual statement of accounts and audit reports

Functions:

Functions assigned to LGE & RDD as per Rule of Business are:
  1. All matters connected with the Administration of the Khyber Pakhtunkhwa Local Government Act, 2013.
  2. Child Marriage Restraint Act 1929.
  3. Administrative controls of LLAs, GDA and PDA.
  4. Provincial Delimitation Authority.
  5. North WestFrontierProvince Public Property (Removal of Encroachment) Act, 1977.
  6. Muslim Family Law Ordinance, 1962.
  7. Hackney Carriage Act, 1879 and Stage Carriage Act, 1861.
  8. Conciliation Court Ordinance, 1961.
  9. Special Marriage Act, 1872.
  10. Fire Brigade.
  11. Census.
  12. Burning and burial grounds and Muslim grave yards not taken over by the Auqaf Department.
  13. Matter pertaining to the Election for the Provincial and National Assembly.
  14. Provincial Election Authority and Provincial Election Tribunal concerning Local Councils.
  15. Matters relating to Referendum on a national issue.
  16. Village Police.
  17. Rural Works Programme and Rural Uplift.
  18. German Aid Financial Project (Pakistan Academy for Rural Development), and Budget and Accounts matter of Pakistan Academy for Rural Development (PARD) and Pakistan Provincial Services Academy (PPSA) development plans and development funds pertaining to Local Councils and Local Bodies.
  19. Grant in Aid for Local Council.
  20. Processing of ADP through District Coordination Committees.
  21. Water Supply and Sewerage Schemes of Local Council.
  22. U.S Aid Financial Project.
  23. Asian Development Bank Assisted Projects (Farm to Market Roads through Local Councils).
  24. World Food Programme.
  25. UNICEF Programme.
  26. Women Programme and Overseas Women Foundation.
  27. Adult Education.
  28. Village/Union Council Library Programme.
  29. Local Council Reforms/Local Government Commission.
  30. Matters relating to Kachi Abadi.
  31. Village Electrification Programme.
  32. Registration of Birth, Deaths and Marriage.
  33. Slaughter houses under the Local Councils and Local Bodies (other than those in Cantonments).
  34. Local Councils Services including Engineering and Health Services for Local Councils.
  35. High / Low Selection Boards (LCS) and others matter relating to the Local Councils Services.
  36. Service matters of the defunct Village Aid and B.D. Department.
  37. Delegation of additional power to Local Councils.
  38. Privileges and Protocol of Local Councilors.
  39. Ponds and Prevention of cattle trespass.
  40. Pre-Partition claims relating to Local Bodies.
  41. Seminars, conventions and publications concerning Local Councils.
  42. Local Councils contribution to Provincial Government.
  43. Local Taxation and Local Rates.
  44. Education Cess on Octroi.
  45. Education Cess on Export Tax.
  46. Urban Property Tax payable to Local Councils.
  47. Aerial Spray Surcharges on Gur.
  48. Local Government Pool Fund.
  49. Local Government Research Statistics and Evalution.
  50. Foreign delegations/training of Local Councilors.
  51. Construction and minor repair of Basic Health Units and Primary Schools, Maktabs through Local Councils.
  52. Arrangments of Horse and Cattle shows and fairs.
  53. Jashan-i-Khyber Pakhtunkhwa.
  54. Coordination of National Building Department through District Coordination Committees.
  55. Management of NazoolLand.
  56. Service matters except those entrusted to Establishment & Administration Department.


The key strategies underpinning our functional approach include:
  • Pursuing an ambitious programme of modernisation and change whilst meeting targets in the relation to the Government’s local government reforms agenda
  • Ensuring that staff resources meet the policy and operational needs through supporting them in performing to their maximum abilities to meet the Department’s objectives
  • Maintaining effective management of the Department’s financial provisions and continuing to develop enhanced financial management and internal control systems
  • Delivering efficient and high-quality public services in line with the standards laid down under the Khyber Pakhtunkhwa Local Government Act 2013
  • Sustaining structured coordination and communication mechanisms with Line Departments, Non-Government Organisations, Civil Society and the citizens of Khyber Pakhtunkhwa on matters of common interest with reference to sustainable development
As the administrative Department on behalf of local government in Khyber Pakhtunkhwa, the major functions of the Local Government, Elections and Rural Development Department are classified in the following manner.

  1. Formulating policy frameworks
  2. Setting strategic directions
  3. Coordinating with local governments in Khyber Pakhtunkhwa
  4. Administering and managing resources
Formulating policy frameworks
by framing or reforming laws, rules and guidelines for working of local government units at different administrative tiers (district councils, tehsil municipal administration and village/neighbourhood councils). Besides, the Department is also entrusted with developing and implementing policy guidelines on public service delivery issues faced by the citizens of Khyber Pakhtunkhwa.

Setting strategic directions
to steer the progress and performance of local governments in line with the Government of Khyber Pakhtunkhwa’s development vision for the citizens of the province.

Coordinating with local government in Khyber Pakhtunkhwa
on matters corresponding to the implementation of the Khyber Pakhtunkhwa Local Government Act 2013. The Department also coordinates with Federal and Provincial Government Departments on pertinent matters that relate to its mandate.

Administering and managing resources
in a transparent, optimal and sustainable manner to improve the quality, delivery and frequency of municipal and basic services. This includes management of more than 20,000 employees working in its attached and subordinating units across the province of Khyber Pakhtunkhwa.

Really excited about this. KPK going to lead all other provinces in to holding Local Bodies election. Everything that is happening in KPK is very encouraging. Things are being changed from within, slowly and steady wins the race, each aspect of decades of old culture of governance, etc is being challenged and changed from within from Police to Govt Hospital Management to Public Schools to Traffic etiquette. Pakistan's other provinces are asleep and busy slapping concrete here and there to show 'development' to the gullible simpletons.

I was waiting for this day, although IK promised in 90 days and it took 2 years, due to ECP and PTI's government's own laziness, nonetheless its happening... and that too wth the Local Bodies Law whch will actually empower the representatives at local level, 30 or 37% of the development funds shall be given to LBs and above that yearly audit. and nearly 500 people shall have 1 representative on average. so its definitively a leap forward for KP.

But good that KPK is following too.
Another thing is, remember the 2 major parties which signed charter of democracy?
And now the same parties are refusing to hold LG polls. LMAO Punjab and Sindh had more democracy under Musharraf than they have now.

Oh Bhai, local bodies elections have already taken place in Baluchistan. Yet to take place in kpk and will take place in sept in sind amend Punjab.
Its all happening on court orders.
