As the news of the Peshawar massacre sunk into the Pakistani concious, our judicary through its words and actions showed where it stands when it comes to the terrorism in Pakistan.

  • The politicians joined in the national mourning with the common Pakistanis and the international community reacted with shock and sorrow as soon as the international media ran the breaking news.
  • World leaders from India, America, Turkey & UK were the first to express their solidatity with Pakistani nation and express their grief.
  • Pakistani military launched some symbolic retaliatory strikes on terrorists in tribal region in coordinated attacks with Americans killing scores of terrorists on either side of Pak Afghan border.
  • Goverment revoked the Moratorium on death Penalty and ordered the execution of all those terrorists that were given suspended death sentences.
  • Pakistan army chief signed off thee death warrants for the ex military terrorists involved in GHQ and General Musharraf attack.

AND then suddenly, appeared our Pakistani judiciary out of no where and launched back to back attacks on the concious and grief of Pakistanis.

first it shamed the nation by approving bail to a prme suspect of Mombai terror attacks at the time when the blood of the innocent children had not dired up and Indians from across the spectrum of its nation were offering their respects.
And if that wasnt enough, the Lahore high court suspended the death sentences of 5 condemned terrorists and now recently Malik Ishaq once again is out to add to his 100+ shia kills. one might argue it has nothing to do with judiciary but unfortunately such claim is very weak looking at the hyper active judiciary from the time of former chief Justice who was famous to take sou motto actions on trivial matters like traffic offences.

then again, why this should be seen as a shock. its the same judiciary that has offered prayers to world's most wanted terrorist Osama Bin Laden.

TTP has in the past expressed its gratitude towards Pakistani judges and consider them as their allies. it clearly seems that despite the public outrage and international embarresment, Pakistani judges will continue to act agaisnt the Pakistanis and their actions will continue to look favourable to the terrorists

. . . .
without a doubt judiciary is starting to become a rogue section of the state and the people are once more wondering whether the concept of fighting for free judiciary was worth the present day system of justice where the people dont get any justice and only the politicians, elite and terrorists get favorable justice.

The releasing of such a terrorist and the delaying of hanging on the basis of simple announcement saying " we cannot bypass the legal system" which sounded more like " do not think that you can forget the judiciary and demean our importance otherwise we will fight even if it means releasing monsters to the society" shows that the judiciary has truly become a selfish sector that only looks out for itself but not the people who crave justice for years.

Ofcourse they are also not free from radicalization and have many judged who are taliban sympathizers. The question again comes how to reign in this section of the state who is slowly turning into a rogue section that is not showing any form of improvement.

.
Rogue judiciary is no less a challenge than TTP itself. If death sentences will keep getting suspended, whats the use of speedy trial..? Who on earth can explain release of people like Malik Issaq and Lakhvi at this time..?

.
The judiciary has elements within it who support these people .
but is it only the judiciary??
Don't the extremists find support among our politicians...in the media....in the armed forces???
heck its not even being a week and the apologies are coming in !
The question remains...Is our society as a whole capable of taking on these people head on???

. . .
Well our judiciary has to learn a lesson here other wise they will face the backlash from the civil society also.

.
well judges needs to be hanged too , start from Iftkhar Chuadry.
Amen to that
that vindictive person alone is responsible for freeing countless terrorists caught red handed who went on to re offend.
e.g the red mosque students who were caught on camera shooting at army and media were allowed to walk free and they formed ghazi force that has committed many atrocities together with TTP

This article serves as a counterpoint to the OP for discussion:

Are we any different from the terrorists? - Blogs - DAWN.COM
counter point to that counter point is yes we are

we don't behead anyone let alone children .. shoot them in the eyes and line them up to execute and mutilate their bodies based on who is their father and what is their sect.

Then why execute a 14 year old? Why execute without completing all the legal steps to which we are committed?

military courts needed, not even a single person have faith in our judges ...

.
it is frightening situation, a suspected terrorist getting free is the last news Pakistanis look upto these days.

Military Courts on the other hand may not be able to take on such a huge load of the legal work on terrorism cases when military already needs to conserve resources on capturing terrorists and counter terrorism, here's some discussion on taking these cases to military courts:

Sources said the working group has approved constitutional amendments for the establishment of military courts for swift trials in terrorism-related cases.
“Some of the meeting participants believed that all terrorism-related cases should be handed over to military courts but others said only cases in which civilians are involved in attacks on military installations should be decided by military courts,” a source told The Express Tribune. He said the prime minister’s legal team ruled out handing over all terrorism-related cases to military courts fearing such a decision might be struck down by the superior judiciary.
