Jamaat registration cancelled

The High Court has cancelled the registration of the Jamaat-e-Islami – a ruling that will prevent the party from contesting the forthcoming national election.

It comes at a time when the demand for outlawing the party, blamed for war crimes during the Liberation War, is mounting.

The bench of justices M Moazzam Husain, M Enayetur Rahim, and Quazi Reza-Ul Hoque kept the verdict pending after hearing on the petition seeking cancellation of Jamaat's registration ended on Jun 12.

It will prevent the party from contesting the forthcoming parliament election due end of this year or early next.

The bench of justices M Moazzam Husain, M Enayetur Rahim, and Quazi Reza-Ul Hoque announced the verdict on Thursday.

“By majority, rule is made absolute and registration given to Jamaat by the Election Commission is declared illegal and void,” Justice Husain said.

The verdict comes at a time when the demand for outlawing the party, blamed for war crimes during the Liberation War, is mounting.

The full verdict will be published later.

Hearing on the petition ended on Jun 12 and the bench kept the verdict pending.

On Jan 27, 2009, the High Court issued a ruling after 25 people, including Bangladesh Tariqat Federation’s Secretary General Syed Rezaul Haque Chandpuri, Jaker Party’s Secretary General Munshi Abdul Latif and Sammilita Islami Jote’s President Maulana Ziaul Hasan, filed a joint petition.

It had asked the EC to explain as to why the party’s registration should not be declared illegal. The court’s ruling specifically referred to sections 90 B(1) and B(2), and 90(C) of the Representation of the People Order (RPO).

Jamaat’s chief Motiur Rahman Nizami, Secretary General Ali Ahsan Mohammad Mujaheed and the Election Commission Secretary were given six weeks time to reply, but they did not, according to plaintiff lawyer Tania Ameer.

On the day the hearing ended, Tania Ameer said Jamaat’s charter was in conflict with the Constitution. “It was not eligible for registration.”

Defence lawyer Abdur Razzaq, also a Jamaat Assistant Secretary General, however claimed no clause of his party was in ‘conflict’ with the Constitution.

Ameer had earlier said the defendants were yet to reply to the 2009 ruling.

During the hearing of the petition, Khandaker Mahbub Hossain and Barrister Abdur Razzaq had filed for power of attorney on behalf of the Jamaat-e-Islami, she said.

The petition for cancelling Jamaat's registration was argued on four points.

The first argument is that the Jamaat in principle does not recognise people as the source of all powers and also the undisputed power of the people’s representatives to make laws.

Secondly, the RPO prohibits registration of communal parties, and ‘it is clear from the acts and beliefs of the Jamaat that it is a communal party’.

Thirdly, a registered political party cannot in any way discriminate on grounds of religion or gender. But the Jammat's charter does not allow any woman or non-Muslim to hold its top post.

And fourthly, the Jamaat is a unit of a foreign organisation born in India with units all over the world.

so,court gave verdict against Jammat and supported counsel's logic that Jammat is indeed a religious party who doesn't believe in freedom and sovereignty of Bangladesh..good decision.. :tup: first drinks on me.. :cheers:

by the way,that doesn't stop them to make a new party and contest in the pool,did it???
 
Excellent. Religion and state should be kept separate. Political parties that discriminate on the basis of religion should not be allowed to contest polls, it is quite elementary. And organizations with a background of mass murder and torture should be snuffed out of existence.

I'm waiting for the inevitable outrage of the jamaathi supporters on this forum about India and RAW and chanakya. However, to the real Bangladeshis (not the ones on this forum who wish they never got a nation), congratulations.
 
A very good news indeed. It was a duty of Bangladesh, which was necessary from the first day of the nation's born.These non Bangladeshis should not be allowed in BD or they should have killed. For these bunch of idiots BD never could progress. All the failures of BD orchestrated by these people. They are enemy of the country. So they should be dismantled.
 
Let me clarify - India has NOTHING whatever to do with this. No hindu, chanakya, brahmonical, preotein deficient veggie thinking has gone into this decision. This is an internal matter of bangladesh.

So any jamati supporters, pls keep your comments away from india, RAW, hindu, pagan, kaffir etc etc bashing and try to debate this like civilised people your court has asked you to try to become. Thank you.

An extremely anti democratic move the worth of a political party should be judged at the ballot box. The precedence is hereby set that a political party can be deregistered. BAL inevitably will be the next victim. As for Jamat they will contest under a new name and this just solidifies BNP support. BAL scums throws the last dice of the game as per it's masters dictates.
 
AL is deliberately pushing Bangladesh to a state of war. Banning the 3rd largest political party will have severe consequences. Anyone with common sense will be able to see this regardless whether they agree with Jamaat or not.

Jamaat is 4th largest. And gets some fraction of votes. They are loyal to some other
country. Thats why they still think of war against BD.

if i am the minority thinker then why Jamat always get low votes ? if BNP supports Islam then why it has woman leader ? why Misses Zia does not wear Borqa ? why she always does huge make up ?

well as jamat is not so popular why ban them from elections ..as you assume they wont be a factor in elections.....

1.cry me river... lets say your innocent brother killed by a man and now he is supported by another man, why another man supported the murderer when another person knows that he is a murderer ? thank you come again.
2. BNP is playing religious card just like AL plays secularism card. Islam and secularism was never been against each other. it has shown that way.

majority of Bangladeshi are looking for solution, look at last two elections, one election hugely won by BNP and when people disappointed next election hugely won by AL and now again all city corporation elections won by BNP. it seems majority of bangladeshi does not support any particular party, if some how a party emerge, you will see how game changes and what future comes to these parties.
