(Reuters) - Two Italian sailors charged with killing two Indian fishermen on Friday lost their Supreme Court bid to be tried on home soil, a victory for New Delhi in a diplomatic tussle over jurisdiction that has strained ties between the two countries.

The sailors, members of a military security team protecting the cargo ship Enrica Lexie, say they mistook the fishermen for pirates off Kerala in February 2012.

The Supreme Court ruled that a special court should be set up to try the marines, lawyers who attended the hearing told reporters afterwards.

Centre told to set up special court to try Italian marines

In a setback to the two Italian marines accused of killing two Indian fishermen, the Supreme Court on Friday turned down their government’s plea that Indian courts had no jurisdiction in the case and directed that their trial be conducted by a special court.

A bench headed by Chief Justice Altamas Kabir said the Kerala government has no jurisdiction to prosecute the two.

It said the trial of the case be conducted by a special court to be set up by the Centre after consulting the Chief Justice of India.

The bench passed the order on a petition filed by the Italian government through its ambassador questioning the jurisdiction of Indian courts in hearing the case against its marines.

The bench also comprising Justice J. Chelameswar did not specify where the special court is to be set up for the trial and left it to the Centre to decide on the issue after consulting the CJI.

The court had on September 4, 2012 reserved its order on the Italian government’s plea challenging the jurisdiction of Indian courts to try its two marines.

The case pertains to the killing of two Indian fishermen allegedly by two Italian naval officers — Massimiliano Lattore and Salvatore Girone — on board merchant vessel Enrica Lexie.

Then why the fcuk were they allowed to travel to celebrate X mas after they killled 2 people? Does Kerela have No Churches?

I was referring to those who were talking about some Italian-Congress conspiracy and that they will be set on free foot. I did not bring religion in here genius.

This unusual and extraordinary act of 'mercy' It certainly seems like a Italian-congress conspiracy. Maybe there is hope in the relatively independent judiciary.

I brought in the religion, ethnicity and nationality here because it is the elephant in the room no one wants to talk about.

Or is it 'not secular' to talk about it ?

I dont think it was a bad idea to send them for chrismas. We want to show the world that they will be treated fairly and do not need to be tried in europe. They returned to face trial in India anyway.

Nothing to do with secularism mate, they might as well be atheists. :)

Death sentence to Italian marines will be an act of war


ROME: Giving death sentence to two Italian marines charged with the killing of Indian fishermen will be an act of war, a top Italian lawmaker has warned.

"(If the punishment is approved, it will be) an attack on Italy," chairman of the lower house foreign affairs committee Fabrizio Cicchitto was quoted as saying by ANSA news agency on Thursday.

He recently met the marines — Massimiliano Latorre and Salvatore Girone, currently lodged at the Italian Embassy in New Delhi.

The two marines were deployed on the Italian-flagged oil tanker MT Enrica Lexie when they shot dead two Indian fishermen off Kerala coast in February, 2012, sparking diplomatic tensions between India and Italy.

They had said they mistook the fishermen for pirates. India's National Investigation Agency (NIA) has sought sanction to prosecute the two marines under the 'Suppression of Unlawful Acts Against Safety of Maritime Navigation and Fixed Platforms on Continental Shelf' Act (SUA), a provision which has only death penalty as punishment.

India has, however, given an assurance to Italy that the two would not be awarded death penalty.

The NIA on Thursday told a special court in New Delhi it was "ready" with a chargesheet against the marines and would file it after the Supreme Court decides on the issue raised by the Italian government.

According to the agency, the apex court is scheduled to hear the plea of Italian government challenging invocation of anti-terrorism law against the marines on February 3.

Rome wants the marines to be tried in Italy, claiming the incident took place in international waters. However, India said it has the right to try the Italian personnel as the victims were Indians on board an Indian fishing boat.

Purely for domestic consumption, I suppose...

Most probably. But seriously, the only time I am 'interested' in Italian politics is when there is some scandal about Berlusconi. :P Practically, I think there will be a compensation deal and they will be provided a light sentence. But, then this is election year. So can't say. But, death penalty is far fetched.
