Israeli Court Calls Lying for Sex Rape

A married Arab man who lied to a Jewish woman to get her to sleep with him telling her that he was a single Jew interested in a long-term relationship was convicted of rape in a Jerusalem court on Tuesday for the consensual sex the couple engaged in two years ago.
As the Israeli newspaper Haaretz reported, the man, Sammy Kashur, was sentenced to 18 months in prison by the Jerusalem District Court for rape by deception. The newspaper explained:
According to the indictment, Kashur met the complainant in September 2008 in downtown Jerusalem, presenting himself as a Jewish bachelor looking for a serious romantic relationship. The couple then went to a nearby building and had sex, after which Kashur left the building without waiting for the woman to get dressed.
When the woman found Kashur was not a Jew but an Arab, she filed a complaint that resulted in charges of rape and indecent assault.
The judge who handed down the ruling, Tzvi Segal, refused to consider a request from the Mr. Kashurs lawyer that his client, who has been under house arrest for two years as a result of the complaint, perform community service instead of jail time, writing: The court is obliged to protect the public interest from sophisticated, smooth-tongued criminals who can deceive innocent victims at an unbearable price the sanctity of their bodies and souls.
After the verdict Mr. Kashur, who is 30, said, If I were Jewish they wouldnt have even questioned me. Thats not called rape. I didnt rape her in the forest and throw her away naked. She agreed to everything that happened. He added, that when he met the woman, who was in her late 20s, outside a grocery store in Jerusalem, I didnt pretend. I said my name is Dudu because thats how everybody knows me. My wife even calls me that.
On Wednesday, Elkana Laist, who works as a public defender in Jerusalem, told Haaretz, The test the court adopted is problematic, because it means that every time a man tells a woman he loves her, based on which she sleeps with him, he could be convicted of rape.
In an interview with Al Jazeera on Wednesday, Merav Mor, a representative of the Association of Rape Crisis Centers in Israel, said I really, really, dont think there was any discrimination on any racial ground. I think this was a man giving false information.
Given the demographic concerns that are often at the front of Israeli minds, sexual relationships between Jews and Arabs are actively discouraged in some parts of the country.
As the Israeli blogger and activist Dimi Reider noted last year, a public service announcement encouraging Israelis to prevent Jewish friends overseas from marrying non-Jews mournfully noted that 50 percent of young Diaspora Jews intermarry, and get lost. The ad depicted young Jews who married non-Jews as being lost.
Last Setember, Noam Sheizaf, an Israeli journalist and blogger, discussed reports that the local government of Petah Tikva, a Tel Aviv suburb, had launched an initiative to locate and help Jewish girls that are meeting with Arabs.
The following month, Sheera Frenkel of National Public Radio spent an evening on patrol with vigilantes from the Jewish settlement of Pisgat Zeev in Jerusalem who prowled the streets at night trying to spot and disrupt romantic encounters between Jewish women and Arab men.
One member of that patrol told Ms. Frenkel, My heart hurts every time I see a Jewish girl with an Arab. Its extremely upsetting. I asked myself: How did we get to this situation? How did we descend to this level? It is a serious step backwards, in our eyes.
