slamic laws for inheritance are to be introduced in UK laws.. also that a Will in Islamic law cannot be for the whole assets, only a certain percentage of assets can be willed in favor of someone, meaning heirs cannot be deprived.
Actually no. According to the UK laws, a person can divide his/her assets in a will in whatever manner they wish to. What this guidance does is provide information to lawyers on what the sharia system of inheritance is and how to go about drafting a will if a person wishes to follow the sharia in the case of inheritance for his/her property.
There are no changes being made to the UK law.
This sort of Sharia type of inheritance using wills is already being made use of by people who wish to use it. However they are more discrete about it. These guidelines which are designed to make it easier for lawyers to help their clients who wish to use this system will make its use a lot more common.
The debate right now is should the UK law society be providing such guidelines which help certain people more easily discriminate against women, children born out of wedlock, etc which is contrary to British sensibilities. Some people also say that such guidelines may be contrary to the spirit of the equality laws in the country.
