Iran seeks access to Kulbhushan Jadhav for interrogation

Pakistan should take the questions and ask them. Or make it a monitored interrogation only.

I think any interrogation by the Iranian authorities should be closely monitored and it should take place in Pakistan. I also think it should only be conducted by Iranian officials who are well-trusted by Pakistani authorities.

Iran has sent a request to Pakistan to get access to an Indian spy, Kulbhushan Sudhir Jadhav, who was awarded death sentence by the military court, for interrogation.

According to BBC, the same was revealed by Iranian Council General Muhammad Rafi during a press conference some two days ago in Quetta.

When asked whether Iranian Foreign Minister Javad Zarif had discussed the issue with his Pakistani counterpart during his recent visit, Rafi said that the issue was not taken up with Pakistani authorities.

He, however, added that the Iranian government has asked the Pakistan to get access to the Indian spy for interrogation. He revealed that no development was made on the request so far as negotiations are underway.

It is important to mention that Pakistan had claimed that Jadhav enter into Pakistan from Iran.

Jadhav was arrested from Balochistan last year on March 3. The Pakistan Military Court sentenced him to death, alleging he was working as a spy for intelligence agency Research and Analysis Wing or RAW. Jadhav was a serving officer in the Indian Navy.

According to India, Jadhav was kidnapped from Iran, where he was carrying on business after retiring from the Indian Navy and was then shown to have been arrested in Balochistan.

On Tuesday, India approached the International Court of Justice (ICJ) and asked to intervene in the matter of the detention and trial of Jadhav.

Actually it is India asking access to Kulbhushan via Iran, seems Iran is now totally with India along with Afghanistan.

Yes they are but the both countries very soon going to say sorry to Pakistan, In fact Iran already apologize for is General's rant and for Afghanistan they worth nothing just trying to show his teeth to his master but master knows puppy can't bite.

First Iran would needs to answer how they allowed RAW's network to run from its territory against Pakistan before requesting counsellor access to a terrorist. And Iran has no legal grounds to claim a counsellor access anyway.

No international law grants them right to interrogate a third national prisoner in Pakistan.

If I'm not wrong, Iran never asked for a counselor access as you might be interpreting. They are asking access to interrogate him which will be very well done by anyone or a team of investigators from there. What is wrong if it help Iran find out the illegal R&AW network inside there soil and enable them to eliminate it ?? Why shying away instead of supporting Iran in its investigation ?? LOL :p:

Legally, Iran can not ask Pakistan for a "counsellor access". They have asked for "interrogation" but Pakistan is not bound to grant them this request as its not about their National under prosecution in Pakistan.

Iran has to answer few questions instead of wanting to ask few. Pakistan' case against Kulbhushan is solid and doesn't need any re-validation or re-verification for anyone's benefit. From our perspective, Kulbhushan is already waiting for his swing.

To add further Iran should be told by our generals, there would be "boots on the ground" inside Iran and RAW monkeys air-lifted if Iran doesnt coordinate(which im sure they would) .

Pakistan has been and will be soft on Iran because our Eastern Border is the main focus. So Pakistan would react calculatedly on provocations from Iran. But as a matter of fact, Iran has been our ally in all wars against India, they offered us more support than we expected and that should be valued.

Their current comments show their resentment towards Pakistan joining Islamic Itihad. While Pakistan has assured them that we are not conspiring against their state but still some of their concerns are real and should be treated with compassion.

You are right. Iran only asked for access to interrogate - but they do not have any legal grounds or international rights on that. It would be up to Pakistan to entertain them or not. But their timing of request is suspicious so they may not get an access at all.

I know there is no legal backing, that's why the specific word "Request" is mentioned. And yes it is upto Pakistan to allow or disallow, but Iran have every moral right to ask for investigation since Pakistan had both officially and unofficially alleged Iran's involvement in KY saga and someone even went to say that Iran is hands in glove with RAW if I can remember.

I would suggest that Pakistan should give their investigators a chance to interrogate him in the presence of your officers, it's never a bad idea, right ?? :)

There are reports emnating from Iranian mainstream media stating that KJ has already been hanged .Another section out here has it that he's been tortured so severely that he's in no position to be presented .

Is it any wonder that the Pakistanis have been refusing visit visas to his immediate family !!

Islamabad: Pakistan Army on Wednesday said it will respond at an "appropriate level" to any query by the International Court of Justice (ICJ) over the death sentence given to Indian national Kulbhushan Jadhav by its military court on the charges of "spying".

Army spokesman Major General Asif Ghafoor told the media that Jadhav was sentenced by a military court after "due process of law".

"If the ICJ requests Pakistan anything about Jadhav, then the government of Pakistan will respond to it at an appropriate level,'' he said.


He said "the process is continuing within the army over the decision by the (military) court? against Jadhav. However, he did not explain the nature of "process".

The statement came after Army chief General Qamar Javed Bajwa called on Prime Minister Nawaz Sharif and discussed the ICJ's stay order on the execution of Jadhav.

Earlier, Adviser to the Prime Minister on Foreign Affairs Sartaj Aziz said the government was analysing the Hague-based ICJ's authority in freezing the execution of Jadhav.

Aziz said the government would issue a statement on the issue in the next few days.

"We are analysing the Indian petition and the ICJ's authority in this case,'' Aziz said after the Hague-based ICJ stayed the execution of 46-year-old Jadhav.

Defence Minister Khawaja Muhammad Asif in a tweet accused India of using Jadhav's death conviction to "divert" attention from its "state-sponsored" terrorism in the country.

"Indian letter to ICJ attempt to divert attention from state sponsored terrorism in Pakistan.

Kulbhushan convicted of offences against national security," Asif tweeted.

The order by the ICJ came a day after India approached it against the death sentence handed down to Jadhav by Pakistan's Field General Court Martial last month.

Pakistan's media rejected India's claim over the order. Geo TV said that the ICJ has no jurisdiction over Pakistan as it can only take cognizance of the matter with the consent of the parties.

Dawn online reported that ICJ has received the application of India, but did not report about the Indian claim on the stay order.

Similarly, The Express Tribune in its report on the issue has not reported about the stay order.

India, in its appeal to the ICJ, accused Pakistan of "egregious" violations of the Vienna Convention on Consular Relations and asserted that Jadhav was kidnapped from Iran where he was involved in business activities after retiring from the Indian Navy but Pakistan claimed to have arrested him from Balochistan on March 3, 2016.

Jadhav's sentencing evoked a sharp reaction in India.

India has warned Pakistan of consequences and damage to bilateral ties if the "pre-meditated murder" was carried out.

In its application, India had also informed the ICJ that it learnt about the death sentence against Jadhav from a press release.

Jadhav was sentenced to death for "espionage and subversive activities".

India acknowledges that Jadhav had served with the Navy but denies that he has any connection with the government. It also said that Jadhav was kidnapped from Iran.

India has also handed over to Pakistan an appeal by Jadhav's mother, initiating a process to get his conviction overturned.

New Delhi: In another development, the International Court of Justice (ICJ) will be holding public hearings in the Kulbhushan Jadhav case on May 15.

The International Court of Justice, the principal judicial organ of the United Nations, yesterday put a stay on the death sentence given by Pakistan to the alleged Indian spy.

The development came after India instituted proceedings against Pakistan, accusing the latter of "egregious violations of the Vienna Convention on Consular Relations" in the matter of detention and trial of Jadhav, and sought a stay on his death sentence.

India earlier on Monday contended that it was not informed of Jadhav's detention until long after his arrest and that Pakistan failed to inform the accused of his rights, an official release from the ICJ said.

India further said that, in violation of the Vienna Convention, the authorities of Pakistan were denying it its right of consular access to Jadhav, despite its repeated requests. It's also pointed out that India learned about the "death sentence against Jadhav from a press release."

India submitted that it had information that Jadhav was "kidnapped from Iran, where he was carrying on business after retiring from the Indian Navy, and was then shown to have been arrested in Baluchistan" on March 3, 2016, and that the Indian authorities were notified of that arrest on March 25, 2016.

India also asked the ICJ to declare the decision illegal being violative of international law and treaty rights and restrain Pakistan from acting in violation of the Vienna Convention and international law by giving effect to the sentence or the conviction in any manner, and directing it to release the convicted Indian National forthwith, if Pakistan is unable to annul the decision.

Pakistan had claimed that Jadhav was arrested from the Baluchistan province last year. A military court sentenced him to death, alleging he was involved in espionage and anti-national activities. Pakistan also claimed that he was "a serving officer in the Indian Navy."

This led to an outrage in India and other countries, which criticised Pakistan for sentencing Jadhav to death with formally informing New Delhi.

India outrightly denied the claims, saying Jadhav was kidnapped from Iran where he was running a business, and adding he was a retired Navy officer.

Pakistan has turned down 16 requests from India for consular access to Jadhav.

What is the special message which Iran has to deliver to terrorist, which India has failed to deliver via Pakistan bureaucracy and politicians!?
