Murad Sir, i think the Malvi has been proven right in every sense.

He said that 70-80% of Hindu's would support the Muslims in their problems, and that Indian Muslims are capable of handling their own problems.

He has been proven right. The fact that Varun Gandhi is facing criminal charges, the fact that BJP has tried to distance itself from Varun Gandhi's statements, the fact that EC has recomended that Varun Gandhi not be given BJP ticket, and the fact of extreme public outrage in India over his remarks do show exactly that.

It clearly shows that 70-80% of Indian Hindu's are indeed against such statements and are with Indian Muslims. It shows that India does have a system of checks and balances(with flaws -surely) but a system nonetheless. The Election Commision is doing its job well. It shows that people like Varun Gandhi cannot make such statements and get away with it.

Had such statements not created the furor it has, you would have been right in questioning whether what the Malvi said was true or not.
 
Varun gandhi is the grandson of Indira alright, but more importantly he is the son of Sanjay Gandhi, a violent person to the core. He was rightly isolated by Indira after she learned her lesson in implementing national emergency.

And coming to the point of hate speach. He shocked the nation and his mentors in BJP too, BJP was in two minds as to how to deal with it, while Shivsena was more forthcoming.

EC has taken action, UP Highcourt has ruled against cancelling the case. What more is expected of the system? We have again proved that we have checks in place and it works. The very fact that he has comeout saying the CD's are tampered with shows how serious a crime he has committed.

Thus in villages Muslims are denied access to the common village well along with the Dalits. Many other things happen.

Varun Gandhi booked under stringent NSA

Varun Gandhi, BJP's latest Hindutva posterboy and its candidate from Pilibhit, plunged into deeper trouble on Sunday night with the Uttar Pradesh government deciding to book him under the National Security Act(NSA) for inciting communal tensions which may result in him being under detention for upto one year.

In a possible unprecedented action of NSA being slapped for a hate speech, Gandhi, who is in the eye of a storm for his alleged anti-Muslim utterances, the Mayawati government said there were three grounds which were taken into consideration by the state government for the decision.

"An order issued hy Pilibhit district magistrate Ajay Chauhan invoking NSA on the BJP nominee this evening has been served to Gandhi, who is currently lodged in the district jail," Additional Cabinet Secretary Vijay Shanker Pandey told reporters in Lucknow.

Senior Supreme Court lawyer K T S Tulsi said " it seems he will have to stay in jail may be even for a year or more because the government is clearly worried about the implications that it could have in the rest of the country.

Pilbhit district authorities served the NSA notice on Gandhi on Sunday night at the district jail after the NSA decision was taken by the BSP government.

Tulsi was of the view that Gandhi's bail plea on Monday may be "useless" following Sunday night action.

The NSA was also invoked on the grounds of public administration and peace being disturbed by Gandhi, Pandey said.

Pandey said the order had been issued under section 3 (2) of the National Security Act 1980.

Under the provisions of the NSA, a person cannot get bail atleast for six months and if this happens Varun has to remain in jail till elections are over.

Giving details on the basis of which NSA was slapped on Gandhi, Pandey said, "Charges of inciting communal passion by making provocative and inflammatory speeches during meetings held on March 7 at Dalganj and on March 8 at Barkhera area of Pilibhit district have been confirmed."

The NSA action came on a day when Gandhi was slapped with fresh charges by the Pilibhit police including attempt to murder, a non-bailable offence, in connection with yesterday' violence involving his supporters around the Pilibhit district jail following his arrest. Today's charges came on top of earlier charges of "inciting religious hatred" in his alleged anti-Muslim speeches.

The maximum period of detention under the NSA is one year with no provision for bail. The government invokes the NSA on the basis of the District Magistrate's report after which the accused is kept in preventive detention.

During the three-week period, the accused is provided with the grounds for invoking the NSA and he can challenge the detention before a three-member Advisory Board headed by a High Court judge.

If the Board hold that the grounds for detention are justified, then the applicant can only challenge it in Supreme Court.

Pandey said that on March 18 deviating from the programme sent to the Superintendent of Police Varun Gandhi changed his route and timing in a planned manner, thus affecting general administration adversely.

"Besides, he also gave provocative statement outside the court(yesterday) which affected the general administration," said Pandey, who was flanked by Director General of Police Vikram Singh and Additional Director General (Law and Order) Brij Lal.

The additional cabinet secretary said that on March 18, while Varun was being taken to the jail after being remanded into judicial custody, his supporters indulged in vandalism and clashed with police.

"This act of Varun's supporters resulted in fear and terror in the adjoining areas and stampede, which made an adverse impact on the general administration," he said.

Pandey said UP government was committed to ensure free and fair and peaceful conduct of the Lok Sabha elections.

"Any person will not be allowed to disturb the peaceful conduct of the polls and stern action will be taken against those attempting to do so," Pandey said.

The additional cabinet secretary said that the government had issued an order to ensure strict enforcement of the model code of conduct.

"Stern action would be taken against those violating model code of conduct," he said.

Earlier, Varun's mother Maneka Gandhi visited the district jail where the BJP nominee from Pilibhit has been lodged and alleged that the registration of cases were part of a "political conspiracy". Coming to the defence of her son who was arrested after he surrendered amid high drama, Maneka said the cases were "frivolous".

Besides being booked under Section 307 IPC (attempt to murder), the 29-year-old scion of the Nehru-Gandhi family was also hit with charges under sections 147, 148 and 149 (rioting and related offences), 332 (voluntarily causing hurt to deter public servant from his duty), 336 (doing any act that endangers human life or the personal safety of others).

Varun also faced charges under certain sections of IPC relating to public safety and certain state acts after his supporters clashed with the police, officials said. PTI

PILIBHIT: BJP’s Lok Sabha candidate Varun Gandhi has been charged with attempt to murder, rioting and other offences in an FIR filed in

connection with violence that erupted in Pilibhit even as police on Sunday maintained a close vigil to maintain law and order in this district.

29-year-old Varun, along with Uttar Pradesh BJP chief Kalraj Mishra, local MLA Sukhlal and former party MLA BK Gupta, have been named in another FIR registered for violation of prohibitory orders under section 144 CrPC on Saturday when the BJP candidate courted arrest in a case related to his alleged anti-Muslim speeches, Kotwali police sources said.

Varun, who is in judicial custody, has been booked under sections 147, 148 and 149 (rioting and related charges), 307 (attempt to murder), 332 (voluntarily causing hurt to deter public servant from his duty), 336 (doing any act that endangers human life or the personal safety of others) and certain sections of IPC and public safety and certain state acts for the violence around the district jail here, they said.

The FIR relating to rioting and other charges has been filed by Pilibhit district jailor Mukesh Arora against Varun and his supporters after BJP activists fought a pitched battle with the police and laid a siege of the jail premises.

Meanwhile, Pilibhit district magistrate Ashok Chauhan discounted the allegation of BJP MP and Varun's mother Maneka Gandhi that a Muslim officer had injured several of supporters and said he was not deployed there.

Chauhan said, "I strictly don't agree with the comments of Maneka Gandhi. The person she is naming was not at all deployed at that place.

"We checked the records and we were careful about his deployment. He was at another place and the allegation is totally false," he said.

On the situation in Pilibhit, he said, "it is under control. People may be spreading rumours but as of now the situation in the city and rural areas is totally under control".

In Lucknow, additional director general of police Brij Lal, said, "A close vigil is being maintained in Pilibhit with deployment of adequate number of personnel from Provincial Armed Constabulary (PAC) and police".

Asked about the cases registered against Gandhi, who courted on Saturday, he just said, "A case under section 188 of IPC has been registered against all those who violated the prohibitory orders under section 144 CrPC".

During the violence yesterday, BJP workers, who were demanding Varun's release, had indulged in heavy brick batting and laid a siege of the district jail.

NSA against Varun vendetta politics: BJP

NEW DELHI: The BJP on Sunday reacted sharply to the invoking of NSA against its candidate Varun Gandhi, saying it was the "worst kind of vendetta politics at work."

"This is pure vendetta politics aimed at vote bank," party spokesperson Prakash Javedkar said.

"This is not emergency days. The nation is watching. Gandhi has been charged under this Act at a time when a TADA convict (Sanjay Dutt) is seeking his election from Lucknow and many more culprits are in the fray," Javdekar said.


The party would react to the development in a structured way tomorrow. The saffron party is confident that the voters would be giving a befitting reply, he added.

Rajnath meets Varun, assures BJP's backing

LUCKNOW: In jail under NSA for more than a week, BJP's Lok Sabha candidate from Pilibhit Varun Gandhi got his first top-rung visitor with party
president Rajnath Singh calling on him in Etah district jail on Monday and describing his arrest as "harassment by BSP in Uttar Pradesh". He also said BJP will continue to protest against Varun's imprisonment saying, "We back Varun, who is being harassed and tortured by the UP government. Let the law takes its course but we want to make it clear that we will support Varun politically and legally."

Rajnath, who was supposed to reach Etah by 12:30 pm, was an hour late, and spent around 30 minutes talking to Varun. After the meeting, Rajnath told reporters, "Although Varun appeared a bit unwell, his confidence and determination were high. He's not the sort who can be forced to relent."

The BJP chief condemned the BSP government's action saying the state authorities, by slapping NSA on Varun, went needlessly overboard. "He (Varun) has been saying that the CD of the speech is not his. Investigations are still under way. The government should have got the CD examined forensically before taking any action." Rajnath said.

Asked if he thought Varun was getting what he deserved, Rajnath shot back, "Do you think Varun Gandhi can murder someone? It's ridiculous to charge him with attempt to murder." The FIR was lodged against Varun in connection with rioting and arson by his supporters after his surrender on March 28.

But would he give Varun a clean chit? Rajnath said, "There's a rule of law in our country. First, his crime should have been proved and then action taken. He's in jail because the state government thinks the CD contains his speeches.

How can anyone take such harsh action merely because he or she thinks that a crime has been committed?" Rajnath said.

Commenting on BJP's initial reluctance to stand by Varun, Rajnath said, "There has been absolutely nothing of the sort. Senior leaders have been visiting him. We've been there with him from day one."

The state government, in an official release later, denied allegations of harassment of Varun Gandhi. The release stated that Varun was provided all the entitlements as per his status and also served home cook food as per court directives. Doctors at jail hospital are constantly monitoring Varun's health and there is no change in his body weight.
 
Varun Gandhi acquitted in 2009 hate speech case
PILIBHIT: BJP leader Varun Gandhi was acquitted in a 2009 hate speech case on Wednesday. A local court provided relief to Varun Gandhi in one of the cases registered against him. Varun had allegedly made inflammatory comments against a particular community in his speeches at public meetings in Pilibhit during the 2009 Lok Sabha election campaign.

The BJP leader was booked under various sections of the IPC and the People's Representation Act for promoting enmity and acts prejudicial against communal harmony.

The first FIR was lodged on March 17, 2009, at Barkhera police station for an inflammatory speech during a public meeting on March 8, 2009.

The second FIR was lodged at Sadar Kotwali on March 18, 2009, again for allegedly making a speech with communal overtones in Dalchand locality.

Varun had strongly denied the charges and termed the case as an attempt to malign him. He said that in one instance he was referring to bad elements and in the second one, the tapes have been doctored. The cases were registered against him on the directions of the Election Commission. Later, Varun surrendered before the court which sent him to jail under judicial custody.

In 2009, the BSP government slapped National Security Act on the 32-year-old BJP leader and he was shifted to Etah Jail. However, in May 2009, the NSA was revoked on the direction of the Supreme Court and he was released on bail. Varun also won the LS election from Pilibhit.

Significantly, Varun in September wrote to the SP government requesting withdrawal of cases describing them as "politically motivated". On his request, the government sought a report from the Pilibhit administration on whether the cases could be withdrawn or not in public interest.
