Indians arrested in Australia for Drug smuggling

MELBOURNE: An Indian-origin couple, arrested in Australia on drug smuggling charges last year, got respite today from an Adelaide court that released the husband on a 'good behaviour bond' as part of a plea bargain.

The Indian American couple was accused of smuggling 200 gm of opium into Australia and their lawyer told the court today that the man, who was an addict, feared the wrath of his wife more than that of the law, while trying to smuggle in the drug.

56-year old Inderjit Singh appeared in the local district court and pleaded guilty to one count of importing a border control drug, local media reported.

He was sentenced to nine months in prison but the judge ordered that he be released on a two-year 'good behaviour bond' of 500 dollars.

Singh along with his 53-year old wife Jasbinder were arrested in October last year.

They were jointly charged with importing or exporting a marketable quantity of a border-controlled drug and were facing possible 25-year jail terms.

It was alleged that the couple was carrying the drug which was mixed with another substance and was placed inside shampoo and talcum powder tins and packed with chillis.

Earlier, prosecutors had told the court the amount of opium in the couple's luggage was 10 times what is considered, under law, to be criminally marketable.

However, today they tendered no evidence against Jasbinder and downgraded the charge against Inderjit.

In sentencing, Judge Wayne Chivell said he would take Inderjit's assertions into account "with a grain of salt".

"You went to elaborate lengths to disguise (the drug)," he said while jailing Inderjit for nine months. The judge also ordered he be immediately released on a two-year, 500 dollar 'good behaviour bond'.

"I accept you have suffered greatly as a result of this very foolish behaviour," he said.

Immigration Department officers were present in court for the hearing and escorted the couple "for interview".

Singh's lawyer Jessica Kurtzer told the court the plea bargain reflected the unique circumstances of the case. She said an Indian hospital had legally prescribed her client opium for irritable bowel syndrome - only for him to become addicted.

The couple, she said, came to Adelaide as part of a planned tour of Australia and New Zealand.

"Prior to departure, my client's wife confronted him to see if he was bringing his medication (and said) if he was, she would simply not go," Kurtzer said.

"He didn't want to argue with his wife about it (and) decided he would bring it to Australia in the tins, not realising the criminality behind it".

they might be Australian Born Indians, check..... half of the Australian born people have taken drugs at a stage of life. it is said in Australia that if someone hasn't taken drugs in his life then it simply means he didnt take birth in Australia. even too many celebrities, sport stars etc have been caught with drugs but were discharged without penalty, or hardly for $200 to $400 penalty :agree:

in mid 2010, one day I took a computer in my university in Sydney (I was doing part time MBA) and threw it on the main glasses of that main lounge, little harder with full force, where main conferences are help, in front of all the lecturers with my demand for police. and then I had to appear in main Downing Centre Court of Sydney where I saw, a women was caught with drugs 4th time but was released with last warning and around $200 penalty. my hearing was next to her and I too was released with last warning........

drugs problem of Australia is on social level, where parents dont take care of their kids, and in fact they themselves are found with drugs sometimes, mainly during break up with previous girl friends, which affect their kids also to take drugs in tough time. this is a very usual case in Australia.........

Yeah Thank god we are not Contributing to the Image of South Asians like Pakistani's . Sexual grooming of underage girls case in U.K. where whole gang was Pakistani , Terrorist attack to terror suspect list in U.K. U.S etc . So much for South Asian Image . Dayum

They are lucky it was Australia, Asia has very strict rules for drug smuggling the death penalty a British national was set to be executed in Indonesia for smuggling cocaine .

Why is this even a news. The guy walked out free, it was most probably for his personal use. A lot of old timers smoke opium.

In Indonesia, you can be executed for having just a small amount of drugs for personal use. But if you are an islamic terrorist who blows up 100+ people, you are given just 2 years prison.

Pretty much people take drugs at varying levels across all nations.. even countries like Japan and Singapore where these things are strictly forbidden. I feel one of the main reasons for their popularity is simply the fact that they are illegal, and very little information is available about them. Some people get a thrill from just breaking the law. The harder drugs are harmful and much fewer people can use them recreationally and still be in control, that is why we need education about these things.
On another note, lets put an end to the blame game.. India has more than 1 billion people and every nation has its junkies, including Pakistan.

Lastly, I dont think the Australians care about this "Indian" drug user. They have far too many of their own to "rehabilitate".
