Yes, if Pakistan submits to it. Which I think will happen. The point is by invoking Article 36, India is admitting him as an Indian national. And its right to have been informed of his capture. Which was not done. Hence, this was a violation of the Consular regulations. Now as per this, there is an optional protocol which says any dispute on interpretation of this lies primarily with the ICJ. Pakistan is a signatory to this and unlike the US has not withdrawn from this part of the treaty.

So in a single word, yes the ICJ can.
