Madurai high court refused to order GOI to deploy its tri-forces for protecting TN fisherman.

No other states supporting us , we tried in courts as well as in Parliament no improvement accomplished. So why you people crying when I say we may take china side?. Just think problem is from whose end.

Kachathieevu case is in the Supreme court since 2008 after Jayalalithaa filed a petition to invalidate the transfer.

...I have no reason to 'cry' if you take china's side :disagree: In lot of mattes I take china's side too .....sometimes I take even pakistans side. But this is only as long as the matter is debated......however I dont plan to act against the GoI once they take a decision on anything (except maybe vote against the govt. that made the decision). If 'anybody' takes an action that is against the GoI then its the classic definition of 'illegal' activity and it gets that person a Jail term.

Kachchatheevu island was transferred to Sri Lanka in 1974 by Indra Gandhi without ratification by the Indian Parliament. Strictly by Law this is an illegal transfer.

There is documentary evidence that the island belonged to Raja of Ramnad (in Tamil Nadu) which was regularly leased out by him and over which he had land ownership rights that was acknowledged by the British.

Any ruling by Supreme Court is applicable to the GoI unless it is overturned by the parliament in the form of a new law.

If the 1974 Indo-Sri Lanka agreement is deemed illegal then it will have to be renegotiated between the two countries. After all an agreement is valid only if it is 'agreed' to by both the parties.

“In 2011-12 for instance, 820 Sri Lankans undertook training in Indian Military Establishments. In the current year (2012-13), 870 officers are undergoing training in India. This includes two senior officers doing the prestigious National Defence College (NDSC) course in New Delhi,” it said.

As Indian Army Chief General Bikram Singh lands in Colombo later today, he is certain to hear from his hosts about many unfulfilled aspects of Indo-Sri Lanka Defence Cooperation.

One of the unfinished agendas between India and Sri Lanka is a formal Defence Cooperation Agreement (DCA), in discussion between the two countries since 2003.

Top Defence sources in both the capitals say most aspects of a formal pact have been agreed upon but domestic compulsions on either side have prevented the final signing of the DCA.
The lack of a formal defence cooperation pact has however not prevented the two countries from furthering their defence ties, opposition in Tamil Nadu to the presence of Sri Lankan military personnel in various Indian training institutions notwithstanding.

In fact, according to highly placed sources, the first ever platoon level combined military exercise between the two countries is currently underway at the Special Forces Training Centre at Nahan in Himachal Pradesh. Given the sensitivities involved, both the countries have however decided not to publicise the event.

Despite the political controversy that erupted in Tamil Nadu earlier this year, India continues to host and train a large number of Sri Lankan officers across the three armed forces. While it is a fact that China and Pakistan have increased their military involvement with Sri Lanka in the past decade, India remains the preferred destination for training of Sri Lankan officers.

In 2011-12 for instance, 820 Sri Lankans undertook training in Indian Military Establishments. In the current year (2012-13), 870 officers are undergoing training in India. This includes two senior officers doing the prestigious National Defence College (NDSC) course in New Delhi.

Four Indian officers also do three different courses in Sri Lanka since 2010. While one officer each tarin at the Defence Services Staff College and the Counter-Insurgency and Jungle Warfare School, two Indian Officers have been doing a course in the Special Operations and Jungle Warfare School in Sri Lanka since 2011.

New Delhi and Colombo also started a formal Annual Defence Dialogue (ADD) in February this year when Sri Lanka's Defence Secretary (in reality, Defence Minister) the all-powerful Gotabaya Rajapakse held talks with India's defence secretary Shashikant Sharma in New Delhi. The next round of this dialogue is slated for February 2013 in Colombo.

Last year (2011) also saw the initiation of the Army to Army Staff Talks between the two countries. Held again this year, these talks between the two armies actually finalises the training and exchange visit schedules.

In February 2009, India also helped Sri Lanka open its Military Intelligence School in Kandy. A 10-strong Indian Army Training Team (IATT) has a mandate to be stationed in Sri Lanka till December 2013.

Although India has steadfastly maintained its policy (at least in public) about not supplying offensive military hardware to Sri Lanka, it has quietly decided to extend a 100 million dollars credit line to Colombo for purchase of non-lethal weapons.

In fact since 2000, India has supplied 24 L-70 anti-aircraft guns, 11 USFM radars, 10 Mine Protected Vehices and 24 Battlefield Surveillance Radars to Sri Lanka.

Ever since the military defeat of the Liberation Tigers of Tamil Eelam (LTTE) in May 2009, New Delhi and Colombo have tried to reset their defence relationship.

This island isn't dispute island, it is in Sri Lankan waters and Indian supreme court orders does not valid to another country. I read that agreement they haven't given any rights for fishing to Indian fishermen in SL waters. And the both parties have agreed with that!

The Island is not in dispute because of the 1975 Indo-SL agreement (which was not ratified by parliament).

If the agreement is deemed invalid / illegal by SC then the island becomes disputed again.

Not much but I can point out one - the gifting away of Katchatheevu illegally by GOI(illegal as any Indian territory to be given away to another country by India should be ratified by the two houses of parliament which did not happen here) and the subsequent killings of TN fisherman due to this reason and the indifference shown by GOI.(and many Indians themselves who do not get the background behind the TN fishermen getting killed).

While Indian foreign policy is hawkish when it comes to Akshai Chin whose resolution could solve the India-China border issue, the contrast stands out when it comes to Katchatheevu.

So when Katchatheevu was transferred to Sri lanka why were there no protests. How can that idiot Nehru give away Indian territory to others?

Transfer of land to other country is different then signing of some treaty. I hope you realize that! Anyways I am all for taking that land back.

Ratification of parliament is required to convert any Treaty into Law, until then the treaty is just an agreement between two parties and in case one of the parties decides to withdraw from it, they can. That withdrawal cannot be challenged under law, both domestic and international.

If its proven that Kachchatheevu island was under Indian Jurisdiction due to it being held by Indian state (as it was) then parliament has to pass a law to relinquish that Jurisdiction. That is why for any land transfers parliament approvals is required (including Kashmir).

nope, This is already solved matter between two countries, so Indian court decisions does not effect to another country. There is a book about International maritime boundaries By American Society of International Law on Google books, search for it and read. It has all those agreements which happened between India and Sri Lanka. It clearly mentions everything,

India is not a rogue nation like others, GOI handed over Indian territory without consent of parliament according to our law such act is purely unconstitutional so that agreement become invalid and SL can't able to challenge it INC. SC definitely favors TN and GOI forced to obey our court verdict.
