Disgraceful at the least that an Indian citizen is being denied rental accommodation based on her religion. Civic liberties need to be more entrenched in our constitution so victims like this can sue the offender
Nonsense.
No public utilities are denied to Indian citizens based on their religion.
Personal properties can very well be denied to citizens based on religion, caste, skin color, nationality, ethnicity, status or cultural difference. This has nothing to do with 'Civic Liberties'.
Civic liberties does not mean you can take away my right to be an @$$hole and gift that right to someone else.
Civic liberties are not restricted to public utilities or facilities. It extends to your right to dignity and non-discrimination in a country. If a Hindu is refusing a Muslim rental accommodation purely on the basis that he/she is a Muslim then that is an infringement of the person's civic liberties (namely discrimination based on religion). Too little if any recourse in law for such situations
By that logic even stupid people have the right not to be discriminated and should get entry into IIT. Why should only the people who get better rank get in? That is discrimination against the lazy and the stupid. Dont they get civic liberties?
What about discrimination against ugly people by not letting them into discos?
or discrimination against poor people by not allowing them entry into 5 star hotels ?
What about giving your house on rent to convicted pedophiles who have paid their due's to society by going to jail ? Should I also give my house on rent to them ?
There is a huge difference between the right not to be discriminated against on the basis of religion and the right not to be discriminated against on the basis of being stupid or being ugly etc.
So you agree it is OK to discriminate against The Ugly, The Poor, The Stupid and The Lazy. Is there any one else on your list ?
I as a private home individual have complete right to give my house on rent to anyone I want AND also refuse it to anyone I want. If I want to give it to a Hindu and not a Muslim, that is my right. No law can take away that right. Its as simple as that.
Right to Rented house is not a fundamental right. Only Fundamental Rights are overarching enough to supersede other laws.
Try the highlighted stuff in most advanced countries I've been to and see where it lands you. In any event, I always forget that India has a long way to go in restructuring its laws and the mindset of its people. Sadly I've been too long away from India
